Opportunity description
1. The subject matter of the basic contract is the rental of a complex of office, sanitary and storage containers, including fencing and utility connections, hereinafter referred to in the SWZ as the assortment. 2. A detailed description of the subject matter of the basic contract is provided in Annex No. 5 to the SWZ and Chapter XIX of the SWZ. 3. Contract term: up to 40 months from the date the contract is signed by the Parties, provided that: a) delivery, assembly and commissioning of the containers – up to 120 days from signing the contract, b) the rental will apply for a period of 36 months, calculated from the date the containers are commissioned and the acceptance report is signed. 4. The Contracting Authority requires that the ICT products offered do not include: 1) ICT products indicated in the recommendation referred to in Art. 34(4) of the Act of 5 July 2018 on the National Cybersecurity System, finding that they have an adverse impact on the fundamental national security interest; 2) an ICT product whose type has been specified in a decision recognizing a supplier as a high-risk supplier, as referred to in Art. 67b(15) of the Act of 5 July 2018 on the National Cybersecurity System; Failure to meet the above requirement will result in rejection of the tender, as applicable, pursuant to Art. 226(1)(17) or (19) of the Act. 5. The Contracting Authority requires the Contractor to indicate in the tender the parts of the contract whose performance it will entrust to Subcontractors and to provide the names of any Subcontractors, if already known. 6. The Contracting Authority does not require subject-matter evidence to be submitted with the tender. 7. The Contracting Authority does not permit the submission of tenders for individual lots. 8. The Contracting Authority permits the performance of part of the contract to be entrusted to a Subcontractor. 9. Pursuant to Art. 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (i.e. OJ EU L 119 of 04.05.2016, p. 1), hereinafter referred to as the “GDPR”, the Contracting Authority informs that: 1) the controller of your personal data is the Warsaw Metropolitan Police Commander; 2) supervision of the proper processing of personal data is exercised by the data protection officer: address: ul. Contractors that are not subject to exclusion pursuant to Art. 108(1) of the Act and Art. 109(1)(1), (4), (7), (8) and (10) of the Act, and Art. 7(1) of the Act of 13 April 2022 on special arrangements for counteracting support for aggression against Ukraine and protecting national security (consolidated text, Journal of Laws of 2025, item 514), and Art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU No L 229 of 31.7.2014, p. 1), as amended, hereinafter: Regulation 833/2014, as amended by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU No L 111 of 8.4.2022, p. 1), and as amended by Council Regulation (EU) 2025/2033 of 23 October 2025 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine, may apply for the award of this contract. 12. The Contracting Authority provides for cancellation of the procedure if the public funds it intended to allocate to finance all or part of the contract have not been granted. 13. Contractors may apply for the award of the contract if they: 1) are not subject to exclusion pursuant to Art. 108(1) of the Act and Art. 109(1)(1), (4), (7), (8) and (10) of the Act, and Art. 7(1) of the Act of 13 April 2022 on special arrangements for counteracting support for aggression against Ukraine and protecting national security (consolidated text, Journal of Laws of 2025, item 514), and Art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU No L 229 of 31.7.2014, p. 1), as amended, hereinafter: Regulation 833/2014, as amended by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (OJ EU No L 111 of 8.4.2022, p. 1), and as amended by Council Regulation (EU) 2025/2033 of 23 October 2025 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine; 2) meet the conditions for participation in the procedure specified by the Contracting Authority in the contract notice and this SWZ. 14. The Contracting Authority requires the Contractor to demonstrate compliance with the conditions specified in Art. 112(2)(4) of the Act concerning professional capacity (experience). The Contractor will meet the condition if it demonstrates that, within the 5 years preceding the tender submission deadline, it completed at least 1 delivery with a value of no less than PLN 200,000.00, consisting of the delivery and assembly of a set of office or modular containers. 1. The subject matter of the basic contract is the rental of a complex of office, sanitary and storage containers, including fencing and utility connections, hereinafter referred to in the SWZ as the assortment. 2.
