The public procurement procedure is conducted under the open tender procedure, pursuant to Eng. 132 of the Act of 11 September 2019, Public Procurement Law (Journal of Laws of 2024, item 1320), hereinafter referred to as the “Pzp Act”, the implementing regulations issued pursuant thereto, and the Civil Code. In matters not regulated by this SWZ, the provisions of the Pzp Act shall apply. 2. The Contracting Authority, pursuant to Art. 139 of the Pzp Act, provides for the reverse order of activities, i.e. it may first examine and evaluate the tenders and then carry out the qualification of the Contractor whose tender was rated highest with regard to the absence of grounds for exclusion. The Contracting Authority shall exclude Contractors who are subject to exclusion on the basis of the grounds referred to in Art. 108 sec. 1 of the Pzp Act and Art. 7 sec. 1 of the Act of 13 April 2022 on special solutions to counteract support for aggression against Ukraine and to protect national security (Journal of Laws of 2025, item 514), and Art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (Official Journal of the EU No L 229 of 31.7.2014, p. 1), hereinafter: Regulation 833/2014, as amended by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (Official Journal of the EU No L111 of 8.4.2022, p. 1). 7. Where Contractors jointly apply for the award of the contract, the Contracting Authority shall examine whether grounds for exclusion apply to each of those Contractors. 8. If a Contractor intends to entrust the performance of part of the contract to a Subcontractor, the Contracting Authority shall examine whether the grounds for exclusion provided for in respect of the Contractor apply to that Subcontractor. 9. Before selecting the most advantageous tender, the Contracting Authority shall call upon the Contractor whose tender was rated highest to submit, within a specified period of no less than 10 days, the following entity-related means of evidence, current as of the date of submission: 1) absence of grounds for exclusion: a) information from the National Criminal Register within the scope of Art. 108 sec. 1 points 1, 2 and 4 of the Pzp Act, drawn up no earlier than 6 months before its submission; b) a statement by the Contractor, within the scope of Art. 108 sec. 1 point 5 of the Pzp Act, that it does not belong to the same capital group, within the meaning of the Act of 16 February 2007 on competition and consumer protection, as another Contractor that submitted a separate tender, or a statement of belonging to the same capital group together with documents or information confirming that the tender was prepared independently of another Contractor belonging to the same capital group; the statement must be prepared using a form with content consistent with Appendix No. 5 to the SWZ; c) a statement concerning the validity of the information contained in the JEDZ form, prepared using a form with content consistent with Appendix No. 7 to the SWZ. The subject of the contract is the supply of a large-format monitor. A detailed description of the subject of the contract is contained in Appendix No. 2 to the SWZ. The Contracting Authority provides for optional orders under the rules specified in the draft contractual provisions constituting Appendix No. 3 to the SWZ. Procedure: open.
