Opportunity description

1. The subject of the contract is the supply of 12 multimedia boards together with mobile stands for classrooms at ZSTiO No. 3 in Katowice. 2. A detailed description of the subject of the contract is contained in Appendix No. 6 to the SWZ – which is also the Description of the equipment offered. Additional information: Appendix No. 6 to the SWZ constitutes subject-matter evidence confirming that the supplies offered meet the requirements, characteristics or criteria specified by the Contracting Authority, as referred to in Article 106(1) of the Pzp Act. The Description of the Equipment Offered must be submitted with the tender, in accordance with the template constituting Appendix No. 6 to the SWZ (i.e. on the tender submission date), because the specification therein of the performance that will be provided if the tender is selected as the most advantageous forms part of the content of the tender. However, the content of the tender consists exclusively of those items in the “Description of the Equipment Offered” in which Contractors must not only confirm the compliance of the parameters of the device offered with the Contracting Authority’s minimum requirements – on a “complies/does not comply” basis – but also provide the full name of the manufacturer, type and model of the equipment offered for the purpose of its unambiguous identification and/or specify the values of the technical parameters or characteristics of the devices offered. Specifying this information is necessary for the Contracting Authority to conduct the procedure and forms part of the content of the tender. Therefore, any failure to submit the Description of the Equipment Offered on the tender submission date, or failure to complete it, or incorrect completion of the Description of the Equipment Offered preventing the Contracting Authority from identifying the device offered, or the inability to determine whether the devices offered meet the minimum technical requirements referred to in the template constituting Appendix No. 6 to the SWZ, will result in the unconditional rejection of the tender pursuant to Article 226(1)(2)(c) and/or Article 226(1)(5) of the Pzp Act. By contrast, those items in the Description of the Equipment Offered in which Contractors are required only to confirm the compliance of the parameters of the device offered with the Contracting Authority’s minimum requirements on a “complies/does not comply” basis (without the need to specify information) do not form part of the content of the tender, but constitute subject-matter evidence confirming that the supplies offered meet the requirements, characteristics or criteria specified by the Contracting Authority, as referred to in Article 106(1) of the Pzp Act. The Contracting Authority stipulates that if the original Description of the Equipment Offered is incomplete or imprecise in the “complies/does not comply” items, the Contracting Authority will call upon the Contractor to submit or supplement the Description of the Equipment Offered, but only in the part covering those “complies/does not comply” items that were completed incorrectly by the Contractor on the tender submission date or were not completed at all. However, it is not permissible, after the tender submission deadline, to submit or supplement the Description of the Equipment Offered in the part constituting the content of the tender if this were intended to supplement information not originally provided or to change the originally specified values of technical parameters or characteristics of the devices offered. The Description of the Equipment Offered will not be subject to supplementation if it is not submitted, and its absence will result in the unconditional rejection of the tender pursuant to Article 226(1)(2)(c) and/or Article 226(1)(5) of the Pzp Act. 3. The tender must cover the entire contract; the Contracting Authority does not permit the submission of tenders for parts. 4. A tender for part of the contract will constitute a tender whose content is inconsistent with the contract conditions and will be rejected in accordance with Article 226(1)(5) of the Pzp Act. 5. The Contracting Authority requires that the subject of the contract offered, including all ICT products, ICT services and ICT processes used to perform the contract, must not include: a) ICT products, ICT services or ICT processes indicated in the recommendation referred to in Article 33(4) of the Act of 5 July 2018 on the National Cybersecurity System (Journal of Laws of 2026, items 20 and 252), stating their adverse impact on the fundamental security interest of the state, b) an ICT product whose type has been specified in a decision on recognising a supplier as a high-risk supplier, as referred to in Article 67b(15) of the Act of 5 July 2018 on the National Cybersecurity System, or an ICT service or ICT process specified in that decision. If the Contractor offers a solution referred to in point 1) or 2) above, the tender will be rejected pursuant to Article 226(1)(17) or point 19) of the Pzp Act. 1. The place of delivery of the subject of the contract is the registered office of the Edward Abramowski Technical and General Education School Complex No. 3 in Katowice. 6. The Contracting Authority requires that the subject of the contract offered, including all ICT products, ICT services and ICT processes used to perform the contract, must not include: a) ICT products, ICT services or ICT processes indicated in the recommendation referred to in Article 33(4) of the Act of 5 July 2018 on the National Cybersecurity System (Journal of Laws of 2026, items 20 and 252), stating their adverse impact on the fundamental security interest of the state, b) an ICT product whose type has been specified in a decision on recognising a supplier as a high-risk supplier, as referred to in Article 67b(15) of the Act of 5 July 2018 on the National Cybersecurity System, or an ICT service or ICT process specified in that decision.
