Opportunity description

1. The subject matter of the contract is the purchase, installation and delivery of computer and electronic equipment as part of the project entitled: “Laboratories of Construction of the Future – construction of school workshops at the Complex of Construction and Architecture Schools in Tarnowskie Góry” Place of delivery: Complex of Construction and Architecture Schools, Tarnowskie Góry, ul. Okrzei 3. The contract has been divided into 3 parts: Part 1 – computer equipment Part 2 – electronic equipment – monitors Part 3 – electronic equipment – 3D printers 2. The contract is co-financed by the Just Transition Fund under the European Funds for Silesia 2021–2027 Programme. 3. The detailed scope of the subject matter of the contract and the description of the Contracting Authority’s requirements regarding performance and acceptance are specified in: 1) description of the subject matter of the contract – Annex No. 5 to the SWZ, 2) draft contractual provisions – Annex No. 3 to the SWZ. 4. The required warranty period for the completed subject matter of the contract is a minimum of 24 months from the date on which the Contracting Authority, the User (i.e. the director of the ZSBA or another person designated by him) and the Contractor sign a defect-free handover and acceptance report. 5. The Contracting Authority does not require the submission of subject-matter evidence. 6. The Contracting Authority requires that the offered performance, including all ICT products, ICT services and ICT processes used to perform the contract, both as main elements and as components, elements of the service delivery environment or accompanying solutions, does not include: 1) ICT products, ICT services or ICT processes indicated in the recommendation referred to in Article 33(4) of the Act of 5 July 2018 on the national cybersecurity system, stating their negative impact on the fundamental interest of state security; 2) an ICT product whose type has been specified in the decision on recognising a supplier as a high-risk supplier referred to in Article 67b(15) of the Act of 5 July 2018 on the national cybersecurity system, or ICT services or ICT processes specified in that decision. Failure to meet the above requirement will result in rejection of the tender pursuant, as applicable, to Article 226(1)(17) or (19) of the Act. 7.The Contracting Authority has provided for the application of the procedure referred to in Article 139(1) – the so-called “reverse” procedure. 8.Contractors may jointly apply for the award of the contract. Contractors jointly applying for the award of the contract shall appoint an attorney-in-fact to represent them in the contract award procedure or to represent them in the procedure and conclude the public procurement contract. Contractors jointly applying for the award of the contract are required to submit the relevant power of attorney with the tender. Where Contractors jointly apply for the award of the contract, the declarations referred to in Article 125 of the Act, on the European Single Procurement Document form and in accordance with Annex No. 4 to the SWZ, shall be submitted by each of the Contractors jointly applying for the contract. These declarations confirm fulfilment of the conditions for participation in the procedure to the extent that each Contractor jointly applying for the contract demonstrates fulfilment of the conditions for participation in the procedure and the absence of grounds for exclusion – none of the Contractors may be subject to exclusion from the procedure on the basis of the grounds for exclusion indicated in the SWZ. The above means that declarations concerning the absence of grounds for exclusion must be submitted by each of the Contractors jointly applying for the award of the contract. All correspondence will be conducted exclusively with the entity acting as attorney-in-fact for the Contractors jointly applying for the award of the contract. 9.The contract is awarded in parts. Estimated value of all parts: PLN 4,512,393.39 net. 1. The subject matter of the contract is the purchase, installation and delivery of computer and electronic equipment for the school workshops at the Complex of Construction and Architecture Schools in Tarnowskie Góry as part of the project entitled: “Laboratories of Construction of the Future – construction of school workshops at the Complex of Construction and Architecture Schools in Tarnowskie Góry”. 2. A detailed description of the subject matter of the contract is provided in Annex No. 5 to the SWZ. 3. The subject matter of the contract must: 1) be brand new, manufactured no earlier than 12 months before delivery, not have been used for exhibition purposes and originate from a legal source, 2) be complete, fit for use and authorised for marketing and use, 3) possess all certificates required by law or equivalent documents and require no additional purchases or capital expenditure in order to function as intended, 4) be free from all defects, including, in particular, material and design defects, 5) be ready for use without any additional purchases or investments, 4. The equipment and software comprising the subject matter of the contract must be delivered with complete technical documentation and licence agreements and installed at the Contractor’s expense at the locations indicated by the Contracting Authority, 5. Software delivered as part of the performance of the subject matter of the contract must originate from a legal source, possess the appropriate licences suitable for the Contracting Authority and never have been activated previously 6. As part of the performance of the subject matter of the contract, the Contractor is obliged to deliver the equipment, install, configure and initially commission it, provide technical support during the warranty period and provide warranty servicing for the delivered devices. 7. The Contractor must perform all activities necessary for the proper performance of the subject matter of the Contract. 8.
