Opportunity description

1. The subject of the contract is the service entitled “Maintenance of flood embankments in the area of the Tczew Catchment Management Board, divided into lots”. 2. The Contracting Authority permits the submission of tenders for individual lots. 2.1 The contract consists of the following lots: 1) Lot 1: Maintenance of flood embankments in the area of the Water Supervision Authority (NW) in Tczew – facility 1, 2) Lot 2: Maintenance of flood embankments in the area of the Water Supervision Authority (NW) in Tczew – facility 2, 3) Lot 3: Maintenance of flood embankments in the area of the Water Supervision Authority (NW) in Tczew – facility 3, 4) Lot 4: Maintenance of flood embankments in the area of the Water Supervision Authority (NW) in Tczew – facility 4, 5) Lot 5: Maintenance of flood embankments in the area of the Water Supervision Authority (NW) in Grudziądz, 6) Lot 6: Maintenance of flood embankments in the area of the Water Supervision Authority (NW) in Kwidzyn – facility 1, 7) Lot 7: Maintenance of flood embankments in the area of the Water Supervision Authority (NW) in Kwidzyn – facility 2. The detailed description of the subject of the contract and the conditions for performing the contract for each lot are specified in: ­- Description of the Subject of the Contract (OPZ) for each lot – Appendix 1 to the SWZ, ­- Draft Contractual Provisions (PPU) – Appendix 8 to the SWZ. 2.2 The Contracting Authority does not permit the contract to be divided within individual lots. 2.3 The Contractor may submit a tender for one or more lots of the contract. The Contractor may submit a tender for no more than 3 lots of the contract. 3. The Contracting Authority does not permit the submission of variant tenders. 4. Separately for each of lots 1–7, the Contracting Authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Pzp Act, constituting no more than 100% of the value of the basic contract for the relevant lot, consisting in the repetition of similar services and consistent with the subject of the basic contract, and the total value of this contract has been included when calculating the contract value for the relevant lot. The contract consists in the repetition of similar services, consistent with the subject of the basic contract, in the scope of flood embankment maintenance. Conditions under which contracts for similar services will be awarded: if such a need arises and the Contracting Authority has financial resources for this purpose. 5. The Contracting Authority does not reserve the obligation for the Contractor to personally perform key parts of the contract. 6. The Contractor may entrust the performance of part of the contract to a subcontractor. The Contracting Authority requires the Contractor to indicate in the tender the parts of the contract that it intends to entrust to subcontractors and to provide the names of any subcontractors, if already known. Subcontracting requirements are specified in the PPU. 7. The Contracting Authority does not provide for the possibility of exercising the option right referred to in Article 441 of the PZP. 8. Pursuant to Article 95(1) of the PZP, the Contracting Authority requires the Contractor to employ, under an employment relationship, persons hereinafter referred to as “Employees” who, during the performance of the contract for the relevant lot, will perform the activities specified by the Contracting Authority in the OPZ (Appendix 1 to the SWZ, as applicable to the contract lot) and in the PPU. 9. The Contracting Authority does not impose requirements concerning the Contractor’s employment of persons referred to in Article 96(2)(2) of the PZP. 10. The Contracting Authority does not require the Contractor to conduct a site visit or inspect documents necessary for performance of the contract that are available at the Contracting Authority’s premises. 11. All costs connected with participation in the procedure, in particular the preparation and submission of the tender, shall be borne by the Contractor submitting the tender. The Contracting Authority does not provide for reimbursement of the costs of participating in the procedure. 12. The Contracting Authority informs that the estimated value of this contract is PLN 1 362 628,81 net, including: lot 1 – PLN 233 723,65 net, lot 2 – PLN 161 050,05 net, lot 3 – PLN 180 045,00 net, lot 4 – PLN 214 644,35 net, lot 5 – PLN 184 163,25 net, lot 6 – PLN 185 927,21 net, lot 7 – PLN 203 075,30 net. 13. The Contracting Authority does not require a tender guarantee in this procedure. The Contracting Authority does not require a performance bond in this procedure. 14. The Contracting Authority reserves the right to cancel this procedure pursuant to Article 257 of the PZP if the funds it intended to allocate to performance of the contract are not granted to it in whole or in part. The Contracting Authority is entitled to cancel the procedure on the above-mentioned grounds at any stage and in relation to selected lots of the contract. The Contracting Authority retains the right to cancel the procedure on the above-mentioned grounds both when it receives unambiguous information that it will not be granted funds for performance of the contract and in the event of a delay in obtaining them relative to the planned deadline for completion of the task, if the lack of funds by the deadline prevents performance of the contract. The Contractor is not entitled to make a demand of the Contracting Authority to take action aimed at obtaining funds intended for performance of the contract if those funds are not granted to it from the anticipated source. If the procedure is cancelled pursuant to Article 257 of the PZP, Contractors shall not be entitled to claim reimbursement of any costs of participation in the procedure, including, in particular, reimbursement of site-visit costs and the costs of calculating and preparing the tender, which – by participating in the procedure under the rules set out in this documentation – the Contractors accept without reservation 15. Lot 1: Maintenance of flood embankments in the area of the Water Supervision Authority (NW) in Tczew, facility 1 (municipalities of Tczew, Suchy Dąb, Cedry Wielkie, city of Gdańsk). 1.1 Scope of work: the subject of this contract is the performance of a service consisting of: mowing twice the left flood embankment of the Vistula River at km 0+000-30+500 and mowing twice the left and right flood embankments of the Młyński canal, the left one at km: 0+000-0+966, 0+000-0+830, 0+000-0+705, 0+000-3+444 and the right one at km: 0+000-0+610. Mowing vegetation to a height of 5cm above the ground, together with shredding the mown growth. This service includes the following work: mechanical or manual mowing of the embankment slopes, berms and crests, together with shredding the mown growth. 1.2 Scope of environmental supervision: environmental supervision will consist of inspecting and supervising the maintenance work being performed in order to minimise any potential negative effects of the work on the natural environment. The scope of environmental supervision includes: 1) identifying sites and habitats of plants or animals and breeding sites or temporary locations of protected plant or animal species within the boundaries of the facility covered by the maintenance work, 2) proposing protective measures to prevent potential negative effects of the work, 3) monitoring the Contractor’s performance of the maintenance work and compliance with protective recommendations if their application is necessary, 4) a final report on the supervision conducted, containing the results of the observations, a description of actions taken to eliminate the potential negative impact of the work on the natural environment, and conclusions from the actions taken. Mowing vegetation to a height of 5cm above the ground, together with shredding the mown growth. This service includes the following work: mechanical or manual mowing of the embankment slopes, berms and crests, together with shredding the mown growth. 1.2 Scope of environmental supervision: environmental supervision will consist of inspecting and supervising the maintenance work being performed in order to minimise any potential negative effects of the work on the natural environment. Lot 6: Maintenance of flood embankments in the area of the Water Supervision Authority (NW) in Kwidzyn – facility 1 (municipalities of: Grudziądz, Sadlinki, Kwidzyn, Susz). 1.1 Scope of work: the subject of this contract is the performance of services divided into elements on the right flood embankment of the Vistula River and the flood embankments of the Liwa River, consisting of: - mowing the crest, waterside slope and landside slope twice (manual supplementary mowing around posts, stairs, buildings, fences and places that the boom cannot reach), - removal of small shrubs from the embankment, removal of shrubs leaning over the embankment, and trimming branches of trees leaning over the embankment. The work must be performed successively over the entire width of the embankment. Grass must be mown to a height of 5 cm. Driving a tractor or other equipment onto the landside slope is prohibited; it may only be driven at the toe of the embankment after prior agreement with the owners of the adjacent land at km 0+000–19+700. Driving heavy agricultural equipment onto the embankments of the Liwa River is prohibited. 2.2 Scope of environmental supervision: environmental supervision will consist of inspecting and supervising the maintenance work being performed in order to minimise any potential negative effects of the work on the natural environment.
