Opportunity description

1.1 The subject matter of the contract is the service entitled: “Maintenance of flood embankments in the area of the Toruń Catchment Management Board”. 1.2 The Contracting Authority permits the submission of tenders for individual lots. 1.2.1 The contract consists of the following lots: 1) Lot 1: Maintenance of flood embankments in the area of the Chełmno Water Supervision Authority (right bank); 2) Lot 2: Maintenance of flood embankments in the area of the Chełmno Water Supervision Authority (left bank) and the Brodnica Water Supervision Authority; 3) Lot 3: Maintenance of flood embankments in the area of the Aleksandrów Kujawski Water Supervision Authority; 4) Lot 4: Maintenance of flood embankments in the area of the Toruń Water Supervision Authority. The detailed description of the subject matter of the contract and the contract performance conditions for each lot are specified in: ­ Description of the subject matter of the contract for each lot – Annex No. 1 to the SWZ, ­ Draft contractual provisions – Annex No. 8 to the SWZ. 2. The Contracting Authority does not permit the contract to be divided within individual lots. The Contractor may submit a tender for one or more lots of the contract. The Contracting Authority does not permit the submission of variant tenders. Separately for each of contract lots Nos. 1–4, the Contracting Authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Pzp Act, amounting to no more than 100% of the value of the basic contract for the given lot, consisting in the repetition of similar services and consistent with the subject matter of the basic contract, and the total value of this contract has been taken into account when calculating the contract value for the given lot. The contract consists in the repetition of similar services, consistent with the subject matter of the basic contract, within the scope of flood embankment maintenance. Conditions under which contracts for similar services will be awarded: if such a need arises and the Contracting Authority has financial resources for this purpose. 3. The Contracting Authority does not reserve the obligation for the Contractor to perform key parts of the contract personally. The Contracting Authority permits the participation of subcontractors in the performance of the contract. If subcontractors participate in the performance of the contract, the Contracting Authority, pursuant to Article 462(2) of the Pzp Act, requires the Contractor to indicate in the tender the parts of the contract that it intends to entrust to subcontractors and to provide the company names of the subcontractors, if already known. Entrusting the performance of part of the contract to subcontractors does not release the Contractor from liability for proper performance of the contract. 4. The Contracting Authority does not provide for the possibility of exercising the option right referred to in Article 441 of the PZP. 5. Pursuant to Article 95(1) of the Pzp Act, the Contracting Authority requires the Contractor to employ, on the basis of an employment relationship, persons hereinafter referred to as “Employees”, who, during the performance of the contract, will perform activities specified by the Contracting Authority in the Description of the subject matter of the contract (Annex No. 1 to the SWZ, as applicable to the contract lot) and in the Draft contractual provisions (Annex No. 8 to the SWZ). 6. The Contracting Authority does not provide for a requirement that the Contractor conduct a site visit or inspect documents necessary for the performance of the contract that are available at the Contracting Authority’s premises. 7. The Contracting Authority states that the estimated net value of the contract in question is PLN 561 230,61, including: 1) lot 1 – PLN 190 099,84 net, 2) lot 2 – PLN 145 601,39 net, 3) lot 3 – PLN 50 088, 97 net, 4) lot 4 – PLN 175 440,41 net. 8. The Contracting Authority does not require a bid bond to be lodged in this procedure. The Contracting Authority does not require security for proper performance of the contract to be lodged in this procedure. 9. All costs associated with participation in the procedure, in particular with preparing and submitting the tender, shall be borne by the Contractor submitting the tender. The Contracting Authority does not provide for reimbursement of the costs of participation in the procedure. 10. The Contracting Authority reserves the right to cancel this procedure pursuant to Article 257 of the Pzp Act if the funds it intended to allocate to performance of the contract are not awarded to it in whole or in part. The Contracting Authority is entitled to cancel the procedure on the aforementioned grounds at any stage thereof and with respect to selected lots of the contract. The Contracting Authority retains the right to cancel the procedure on the aforementioned grounds both when it receives unequivocal information that it has not been awarded funds for performance of the contract and when there is a delay in obtaining them relative to the anticipated completion date of the task, if the lack of funds by the deadline makes performance of the contract impossible. The Contractor is not entitled to make a demand of the Contracting Authority that it take actions aimed at obtaining funds intended for performance of the contract if such funds are not awarded to it from the anticipated source. If the procedure is cancelled pursuant to Article 257 of the Pzp Act, Contractors shall not be entitled to claim reimbursement of any costs of participation in the procedure, including, in particular, reimbursement of the costs of conducting a site visit and the costs of calculating and preparing the tender, which—through the fact of participating in the procedure under the rules set out in this documentation—the Contractors accept without reservation. 11. Procedure plan No. in BZP: 2026/BZP 00116193/02/P, plan item: 2.3.141. 1. Maintenance of flood embankments in the area of the Toruń Water Supervision Authority. The detailed description of the subject matter of the contract and the performance conditions for contract lot No. 4 are specified in: - Description of the subject matter of the contract (OPZ) for lot 4 – Annex No. 1 to the SWZ, - Draft contractual provisions (PPU) – Annex No. 8 to the SWZ. 2. Contract term: up to 6 months from the date of signing the contract. 3. The Contracting Authority requires the contract to be performed within the following deadlines: Maintenance Stage I – within 30 calendar days from the date the site is handed over to the Contractor, (anticipated date for handing over the site for maintenance I – June 2026) Maintenance Stage II – within 30 calendar days from the date the site is handed over to the Contractor, (anticipated date for handing over the site for maintenance II – September 2026) 4.
