1. The subject matter of the contract is the service entitled Maintenance of waters and water facilities and other structures related to water management within the area of the Catchment Management Board in Gdańsk. This procedure is being conducted for the purpose of concluding framework agreements. The subject matter of the contract has been divided into nine parts. For each of these parts, the Contracting Authority intends to conclude framework agreements with a maximum of five Contractors. A framework agreement is not a public procurement contract, but merely the basis for awarding individual (implementing) contracts covered by that agreement. The conclusion of a framework agreement does not oblige the Contracting Authority to award an implementing contract to a given Contractor. The procedure for awarding implementing contracts is governed by the framework agreement, the template of which constitutes Annex 8 to the SWZ – Draft Provisions of the Framework Agreement (PPUR). 2. The Contracting Authority permits the submission of tenders for individual parts. The contract consists of the following parts: -Part 1: Maintenance of canals within the area of the Water Supervision Authority in Gdańsk; -Part 2: Maintenance of watercourses and canals within the area of the Water Supervision Authority in Gdynia; -Part 3: Maintenance of watercourses within the area of the Water Supervision Authority in Kartuzy; -Part 4: Maintenance of watercourses within the area of the Water Supervision Authority in Bytów; -Part 5: Maintenance of watercourses and canals within the area of the Water Supervision Authority in Lębork; -Part 6: Maintenance of watercourses and canals within the area of the Water Supervision Authority in Pruszcz Gdański; -Part 7: Maintenance of watercourses and canals within the area of the Water Supervision Authority in Puck; -Part 8: Maintenance of watercourses and canals within the area of the Water Supervision Authority in Reda; -Part 9: Maintenance of watercourses and canals within the area of the Water Supervision Authority in Słupsk. The detailed description of the subject matter of the contract and the contract performance conditions for each part of the contract are specified by: Description of the subject matter of the contract for the individual parts of the contract: Annex 1 to the SWZ, PPUR: Annex 8 to the SWZ. The Contracting Authority does not permit the division of the contract within the individual parts. The Contractor may submit a tender for one or more parts of the contract. The Contracting Authority does not permit the submission of variant tenders. The Contracting Authority does not provide for the possibility of awarding contracts referred to in Article 214(1)(7) of the PZP. 3. The Contracting Authority does not reserve the obligation for the Contractor to personally perform key parts of the contract. The Contractor may entrust the performance of part of the contract to a subcontractor. The Contracting Authority requires the Contractor to indicate in the tender the parts of the contract that it intends to entrust to subcontractors and to provide the names of any subcontractors, if already known. The requirements concerning subcontracting have been specified in the Draft Provisions of the Implementing Agreement (PPUW), constituting Annex 5 to the PPUR. 4. The Contracting Authority does not provide for the possibility of exercising the option right referred to in Article 441 of the PZP. 5. In accordance with Article 95(1) of the PZP, the Contracting Authority requires the Contractor to employ, on the basis of an employment relationship, persons hereinafter referred to as “Employees”, who, during the performance of the contract for a given part, will perform the activities specified by the Contracting Authority in the Description of the subject matter of the contract (Annex 1 to the SWZ, as applicable to the given part of the contract), in the PPUR and PPUW. The Contracting Authority does not impose requirements concerning the Contractor’s employment of persons referred to in Article 96(2)(2) of the PZP. 6. The Contracting Authority does not require the Contractor to conduct a site visit or inspect the documents necessary for the performance of the contract that are available on site at the Contracting Authority’s premises. 7. The Contracting Authority informs that the estimated value of the contract in question is PLN 125 199 807,02 net, PLN 135 215 791,59 gross, including: part 1 – PLN 38 717 972,80 net, PLN 41 815 410,62 gross, part 2 – PLN 1 534 161,20 net, PLN 1 656 894,10 gross, part 3 – PLN 4 607 560,60 net, PLN 4 976 165,45 gross, part 4 – PLN 3 933 298,24 net, PLN 4 247 962,10 gross, part 5 – PLN 8 826 556,00 net, PLN 9 532 680,48 gross, part 6 – PLN 54 762 718,89 net, PLN 59 143 736,40 gross, part 7 – PLN 1 092 521,85 net, PLN 1 179 923,60 gross. part 8 – PLN 1 650 810,60 net, PLN 1 782 875,45 gross. part 9 – PLN 10 074 206,84 net, PLN 10 880 143,39 gross. 8. The Contracting Authority does not require a bid bond in this procedure. The Contracting Authority does not require a performance bond in this procedure. 9. All costs related to participation in the procedure, in particular the preparation and submission of the tender, shall be borne by the Contractor submitting the tender. Maintenance work will be carried out on the following natural watercourses and canals: - Gizdepka River, Płutnica River, Struga Młyńska, Struga Darzlubska, Struga Werblinia 1, Struga Werblinia 2, Struga Werblinia 3, Potok Błądzikowski, - Kanał Pompowy Puckie Błota, kanał B Puckie Błota, Kanał Mrzezino, kanał B Puckie Błota and related work. The detailed description of the subject matter of the contract and the contract performance conditions for each part of the contract are specified by: -Description of the subject matter of the contract for the individual parts of the contract – Annex 1 to the SWZ, -Draft Provisions of the Framework Agreement – Annex 8 to the SWZ. 2. This procedure is being conducted for the purpose of concluding framework agreements. A framework agreement is not a public procurement contract, but merely the basis for awarding individual (implementing) contracts covered by that agreement. The conclusion of a framework agreement does not oblige the Contracting Authority to award an implementing contract to a given Contractor. The procedure for awarding implementing contracts is governed by the framework agreement (PPUR). 3. Term of the framework agreement: a maximum of 2 years from the date of conclusion of the framework agreement, provided that this period may be shortened if the total gross value of all implementing agreements concluded under the framework agreements for a given part of the contract reaches at least 95% of the maximum gross value of the framework agreement.
