Opportunity description

1 The subject of the contract is the maintenance and ongoing operation of water reservoirs in the area of operation of the Piotrków Trybunalski Catchment Management Authority in 2027/2028 (mowing vegetation, monitoring and operation, replenishing prohibition signs and information boards, removing blockages within the reservoir, etc.) – divided into 9 lots. 1.1 A detailed description of the subject of the contract is contained in Appendices No. 1.1 to No. 1.9 (description of the subject of the contract for each lot of the basic contract and that envisaged under the option right) to the SWZ, and Appendices No. 2.1 to No. 2.9 (tender pricing form for each lot of the contract). 1.2 The contract performed under the option right in each lot will consist of repeating the same activities as those provided under the basic contract. 1.3 The Contractor is responsible for carrying out the work in accordance with the contract and OPZ. During the performance of the work, the recommendations of the person designated by the Contracting Authority to supervise the work must be followed. 1.4 Detailed descriptions of the subject of the contract, separately for each lot of the contract, are contained in the Descriptions of the Subject of the Contract (Appendices 1.1–1.9), Tender Pricing Forms (Appendices 2.1–2.9), and the draft contractual provisions common to all lots (Appendix No. 6). The descriptions of the subject of the contract have been prepared separately for each lot and contain information concerning the detailed location, scope, and conditions for performing the task, together with excerpts from overview maps indicating the locations of the individual tasks. 1.5 The tender price forms have been prepared separately for each lot 1.6 Pursuant to Art. 91(3) of the Pzp, the Contracting Authority informs that the Contractor may submit a tender for a maximum of 5 lots of the contract. The Contracting Authority specified the number of lots of the contract for which one contractor may submit a tender in order to obtain a guarantee that one and the same contractor will not perform the entire contract. If a tender is submitted for more lots than the limit stipulated by the Contracting Authority, all partial tenders shall be rejected due to the tender’s content being inconsistent with the contract conditions (Art. 226(1)(5) of the Pzp). 1.7Certificate. The subjective means of evidence indicated in points 10.3 and 10.4 may be replaced by a valid public procurement contractor certificate referred to in Art. 124(2) of the Pzp Act, solely to the extent that the certificate confirms the absence of grounds for exclusion or compliance with the conditions for participation in the procedure to the extent corresponding to the requirements specified in the SWZ. The certificate does not replace subjective means of evidence concerning grounds for exclusion not covered by certification, in particular Art. 108(1)(6) of the Pzp Act, Art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (Official Journal of the EU No L 229), Art. 7(1) of the Act of 13 April 2022 on special solutions to counteract support for aggression against Ukraine and to protect national security, as well as circumstances arising in the course of this procedure. The certificate replaces subjective means of evidence solely to the extent covered by valid certification and indicated by the contractor in the declaration contained in Appendix No. 2 to the SWZ. If the certificate covers only some of the grounds for exclusion or part of a condition for participation in the procedure, or confirms compliance with a condition at a level lower than that required in the SWZ, the contractor shall submit subjective means of evidence for the remaining scope. To the extent resulting from a valid certificate, the Contracting Authority shall not require other subjective means of evidence from the contractor, subject to Art. 124(4) of the Pzp Act and Art. 31(6) of the Act on Certification of Public Procurement Contractors. Pursuant to Art. 125(1) of the Pzp Act, before selecting the most advantageous tender, the Contracting Authority shall call upon the contractor whose tender received the highest score to submit, within a specified period of no less than 10 days from the date of the request, the subjective means of evidence indicated in point 10.5.1, current as of the date of submission, to the extent that they have not been replaced by a valid public procurement contractor certificate, taking into account points 10.7.5–10.7.11 below. If the declaration (Appendix No. 2 to the SWZ) indicates that the contractor will use a certificate and the contractor has provided the data required under Art. 124 of the Pzp Act, the Contracting Authority shall independently verify the certificate in the certification database and shall not call upon the contractor to submit subjective means of evidence to the extent that the circumstances required by the Contracting Authority are evident from that certificate. If the certificate does not cover all circumstances required by the Contracting Authority, the Contracting Authority shall call upon the contractor to submit subjective means of evidence solely to the extent not covered by certification. If the data indicated by the contractor do not allow the certificate to be found or verified in the certification database, the Contracting Authority may call upon the contractor to submit, supplement, correct, or clarify those data under the rules set out in Art. 128(1) or (4) of the Pzp Act. If, despite the request, the Contracting Authority is unable to verify the certificate, the certificate shall not be taken into account to the extent that it cannot be verified.
