1. The subject matter of the contract is the supply of factory-new firewall Devices, Licenses, UTP Subscriptions, Technical Support contracts and optical transceivers, as well as the provision of technical support and warranty service. 2. The subject matter of the contract is described in detail in Chapter II of the SWZ – Description of the subject matter of the contract (also “OPZ”). 3. All requirements specified in Chapter II of the SWZ – Description of the subject matter of the contract constitute minimum requirements, and compliance with them is mandatory. Failure to meet the above-mentioned minimum requirements will result in rejection of the tender pursuant to Art. 226 sec. 1 point 5 of the Pzp Act, as non-compliant with the contract conditions. 4. Pursuant to Art. 139 of the Pzp Act, the Contracting Authority provides for a reversed order of tender evaluation, i.e. it will first examine and evaluate the tenders and then conduct the qualification of the Contractor whose tender received the highest evaluation, with regard to the absence of grounds for exclusion and fulfillment of the conditions for participation in the procedure. 5. The Contracting Authority is the controller of personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.4.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, hereinafter “RODO”. 6. The Contractor submits the tender via the eZamówienia Platform of the Public Procurement Office - https://ezamowienia.gov.pl/pl/. 7. The Contracting Authority stipulates that, pursuant to Art. 257 of the Pzp Act, it may cancel the contract award procedure if the public funds that the Contracting Authority intended to allocate to finance the contract are not granted to it. 8. The tender shall be submitted, under pain of invalidity, in electronic form, in accordance with the requirements strictly specified in the SWZ. 9. The Contracting Authority will not award the contract if the circumstances referred to in Art. 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning organizational measures in connection with Russia’s actions destabilizing the situation in Ukraine (Official Journal of the EU No L 229/1 of 31.7.2014) occur, and will exclude the Contractor if at least one of the grounds for exclusion specified in Art. 7 sec. 1 of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving to protect national security (consolidated text: Journal of Laws of 2025, item 514) occurs – in order to confirm the absence of grounds for exclusion, a declaration constituting Annex No 7 to the Tender Form must be submitted together with the tender. 10. If an equivalent solution is offered, the Contracting Authority requires the submission, together with the tender, of subject-matter evidence confirming compliance with the software equivalence criteria specified in Chapter II of the SWZ – Description of the Subject Matter of the Contract - in accordance with point 6 of Chapter I of the SWZ. in accordance with the OPZ Procedure: open.
