Opportunity description

1. The subject matter of the contract is the supply, installation and configuration of Fibre Channel (FC) Storage Area Network (SAN) switches together with the necessary licenses, optical transceivers and implementation services. 2. A detailed description of the subject matter of the contract is contained in Annex No. 2 to the SWZ. 3. The subject matter of the contract must meet all safe product requirements in accordance with Regulation (EU) 2023/988 of the European Parliament and of the Council of 10 May 2023 on general product safety, amending Regulation (EU) No 1025/2012 of the European Parliament and of the Council and Directive (EU) 2020/1828 of the European Parliament and of the Council, and repealing Directive 2001/95/EC of the European Parliament and of the Council and Council Directive 87/357/EEC of 10 May 2023 (OJ EU L 2023.135.1). The Contractor is obliged to supply a brand-new subject matter of the contract (in particular, not repaired, not refurbished, not previously displayed, not previously used, in its original, unopened packaging – if applicable), originating from current production and a legal distribution channel, operational, complete (in particular, with all components, parts and materials) and compliant with the OPZ – as appropriate for the lot. 4. Pursuant to Article 67a and Article 67b point 6 of the Act on the National Cybersecurity System of 5 July 2018, the Contractor declares that: no proceedings are pending against it concerning the designation of an equipment or software supplier as a high-risk supplier, and that the offered devices and software are not subject to proceedings concerning the designation of an equipment or software supplier as a high-risk supplier. 5. Pursuant to Article 8 point 2 letters b) and e) of the Act on the National Cybersecurity System of 5 July 2018, in connection with the need to ensure supply chain security, including security-related aspects concerning relationships between each entity and its direct suppliers or service providers, the Contracting Authority requires that the subject matter of the contract be performed by an authorized commercial partner or authorized representative or manufacturer of the offered equipment and software. 6. The Contractor guarantees that the offered equipment is brand-new, originates from the manufacturer’s official distribution channels for the European Union market and does not contain components originating from high-risk suppliers. 7. The Contractor is obliged to perform the contract in accordance with the rules and conditions described in the detailed description of the subject matter of the contract and in the draft contractual provisions constituting Annex No. 7 to the SWZ. 1.
