1) The subject matter of the contract is the supply of network equipment specified in Annexes Nos. 2A-D to the SWZ, hereinafter referred to as the “equipment”. The equipment offered must be brand new and unused, come from current production (year of manufacture: no earlier than 2026), and have the appropriate certificates permitting its sale and use in the Republic of Poland. The Contractor is obliged to provide free warranty service for the equipment. 2) The scope of the contract includes: the purchase and delivery of the equipment to the Contracting Authority’s premises, including unloading and carrying it into the location indicated by the Contracting Authority. 3) A detailed description of the subject matter of the contract is provided in Annexes Nos. 2A-D to the SWZ. 4) Required contract completion period: up to 5 weeks from the date of receipt of the order. The Contractor may shorten the contract completion period in relation to the required period indicated above. A tender providing for a shorter completion period will receive points in the evaluation of tenders under the criterion for selecting the most advantageous tender. 5) Delivery address: a) Parts A, B, D - Zespół Infrastruktury Informatycznej Kampusu Katowickiego, ul. Bankowa 12, 40-007 Katowice; 6) Required minimum manufacturer’s warranty period: 12 months from the date of signing the acceptance protocol. The Contractor may extend the warranty period in relation to the required period indicated above. A tender providing for an extended warranty period will receive points in the evaluation of tenders under the criterion for selecting the most advantageous tender. 7) Required service response time: no later than within 4 working days of notification of a defect. 8) The detailed terms and conditions for performance of the contract and the payment terms are contained in the model contract constituting Annex No. 3 to the SWZ. 9) Amendments to the provisions of the concluded Contract in relation to the content of the tender on the basis of which the Contractor was selected, resulting from the provisions of Art. 455(1)(1) of the Pzp Act, may be made in the circumstances provided for in par. 10(2) of the model contract (Annex No. 3 to the SWZ) 10) The Contractor may submit only one tender for a given part of the procedure. 11) The Contracting Authority requires that the performance offered, including all ICT products, ICT services and ICT processes used to perform the contract, both as main elements and as components, elements of the service delivery environment or accompanying solutions, must not include: - ICT products, ICT services or ICT processes indicated in the recommendation referred to in Art. 33(4) of the Act of 5 July 2018 on the National Cybersecurity System, finding that they have a negative impact on the fundamental security interest of the state; - an ICT product whose type has been specified in the decision on recognizing a supplier as a high-risk supplier, referred to in Art. 67b(15) of the Act of 5 July 2018 on the National Cybersecurity System, or ICT services or ICT processes specified in that decision.
