1. The subject of the contract is the supply of orthopaedic implants and medical devices for orthopaedic procedures involving arthroscopic procedures, in accordance with Part No. 1, Part No. 2, Part No. 3 and Part No. 4. 2. A detailed description of the subject of the contract is provided in the “Assortment and Price Form”, constituting Appendix No. 3 to the SWZ. 3. The Contracting Authority requires that the offered product be registered as a medical device and comply with the requirements of the Act of 7 April 2022 on medical devices (Journal of Laws 2024.1620 of 2024.11.05) and Regulation (EU) 2017/745 of the European Parliament and of the Council of 5 April 2017 on medical devices (Medical Devices Regulation), and possess the registration certificates, approvals, certificates and other documents required by law permitting the subject of the contract to be marketed and used in Poland, and, where applicable, comply with the requirements of Regulation (EU) 2017/746 of the European Parliament and of the Council of 5 April 2017 on in vitro diagnostic medical devices and repealing Directive 98/79/EC and Commission Decision 2010/227/EU – applies to: a) Part No. 1, items No. 1-2, b) Part No. 2, items No. 1-16, c) Part No. 3, items No. 1-3, d) Part No. 4, items No. 1 and No. 2. 4. In this procedure, tenders are submitted entirely using electronic means of communication; therefore, pursuant to Article 138(4) of the Act of 11 September 2019, Public Procurement Law, the Contracting Authority may set a deadline for the submission of tenders that is 5 days shorter than that specified in Article 138(1) of the Pzp Act. 5. The Contracting Authority intends to award the contract in parts, each of which constitutes the subject of a separate procedure. The Contracting Authority intends to award the contract in two parts, each of which constitutes the subject of a separate procedure. The first part was covered by procedure No. ZP/04/2026. A detailed description of the subject of the contract is provided in the “Assortment and Price Form”, constituting Appendix No. 3 to the SWZ. The Contracting Authority does not permit the submission of partial tenders for individual items within a given part. Procedure: open.
