Opportunity description
1. The subject of the contract is the supply of a high-speed oscilloscope with a 20-30GHz bandwidth for the construction of the test stand “Broadband spectrometer for the THz and far-infrared wave range in a double-ridge configuration” for the Department of Field Theory, Electronic Systems and Optoelectronics of Wrocław University of Science and Technology. All costs related to the performance of the subject of the contract, including delivery, insurance and risk, shall be borne by the Contractor. The Contracting Authority declares that the Project has been co-financed by the European Union under Measure 2.4 Research Infrastructure for a Modern Economy, co-financed by the European Union from Priority 2 of the European Funds for a Modern Economy Programme 2021–2027 (FENG). 2. A detailed description of the subject of the contract is provided in Appendix No. 3 to the SWZ - OPZ. 3. The detailed scope of performance of the subject of the contract, constituting the draft provisions of the public procurement contract, is provided in the model contract constituting Appendix No. 2 to the SWZ. 4. Place of delivery: Wrocław University of Science and Technology, Department of Field Theory, Electronic Systems and Optoelectronics, ul. Janiszewskiego 9, 50-372 Wrocław, Building C-5, room 203. 5. Warranty for the delivered and installed equipment: The warranty period is min. 36 months. The Response Time to a Service Request, understood as the period between the Contracting Authority sending the Service Request and the Contractor confirming receipt of the Service Request, shall be 48 hours on working days. The Repair Time shall be a maximum of 60 working days. 6. The delivered subject of the contract must be factory-new, not displayed at exhibitions, complete and technically operational. The term “factory-new” shall mean a subject of the contract that is originally packaged and unused before the delivery date, excluding use necessary to test its proper operation after manufacture. The subject of the contract must be free from any physical and legal defects and third-party claims. 7. The delivered subject of the contract must originate from the manufacturer’s official distribution channel, which does not exclude distribution to the European Union market and ensures the exercise of warranty rights. 8. By the deadline for submission of Tenders, the offered subject of the contract may not be designated by the manufacturer for discontinuation of production or sale (End of Life, End of Support, End of Sale). 9. Delivery completion deadline: up to 12 weeks from the date of conclusion of the contract. 10. Pursuant to Art. 257 of the uPzp, the Contracting Authority provides for the possibility of cancelling this procedure if the funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been awarded to it. 11. The Contracting Authority provides for the application of the so-called reversed procedure referred to in Art. 139(1) of the uPzp, i.e. the Contracting Authority shall first examine and evaluate the tenders and then perform the subjective qualification of the Contractor whose tender received the highest evaluation, with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 12. The Contractor shall be bound by the tender from the date of expiry of the tender submission deadline for no longer than 90 days, i.e. until 05.12.2026. 13. The tender must consist of: 13.1. the Contractor’s tender form – an interactive form available on the e-Zamówienia Platform, indicating in particular the tender price for the entire subject of the contract) 13.2. the declaration referred to in Chapter VII point 1 of the SWZ - JEDZ - an interactive form available on the e-Zamówienia Platform 13.3. the declaration referred to in Chapter VII point 1a of the SWZ - (as applicable) Declarations in Appendices No. 5.1 and 5.2 to the SWZ; 13.4. (if applicable) the commitment of the entity making resources available referred to in Chapter VII point 6 of the SWZ; 13.5. (if applicable) demonstration of the reservation of information constituting a trade secret in accordance with Chapter X point 6; 13.6. the document(s) establishing the right to sign the Tender, i.e. in order to confirm that the person acting on behalf of the Contractor is authorised to represent it, the Contracting Authority requires the Contractor to provide an extract or information from the National Court Register, the Central Register and Information on Economic Activity or another appropriate register 13.7. (if applicable) Declaration of Contractors jointly applying for the contract - in accordance with Art. 117(4) of the uPzp. 13.8. subject-matter evidence in accordance with point 13 of Chapter II of the SWZ with regard to an equivalent tender (if applicable). 13.9. Appendix No. 3 to the SWZ OPZ - description of the offered subject of the contract (technical specification)– confirming the Contractor’s fulfilment of the Contracting Authority’s requirements (together with any Information for Contractors). The Contractor shall submit, together with the Tender, the appropriately completed and signed: Appendix No. 3 to the SWZ. The Contracting Authority shall consider the parameters indicated by the Contractor in Appendix 3 to the SWZ OPZ – the parameters offered by the Contractor (column “Parameters offered”) as subject-matter evidence. The requirement to indicate: “Name, type/model, manufacturer of the offered device” - does not constitute subject-matter evidence and shall not be subject to supplementation. 13.10. The manufacturer’s technical specification confirming fulfilment of the technical requirements/parameters arising from Appendix No. 3 to the SWZ – OPZ. 14. Contractors who are not subject to exclusion under the rules set out in Chapter VI of the SWZ and who meet the conditions for participation in the procedure specified by the Contracting Authority may apply for the award of the contract. Contractors who meet the conditions concerning the following may apply for the award of the contract: 14.1. capacity to conduct business transactions. The Contracting Authority does not impose a condition in the above scope. 14.2. authorisation to conduct specific business or professional activities, insofar as this results from separate provisions. The Contracting Authority does not impose a condition in the above scope. 14.3. economic or financial standing. The Contracting Authority does not impose a condition in the above scope. 14.4. technical or professional capacity. The Contracting Authority does not impose a condition in the above scope.
