1. The subject matter of the Contract is the successive supply of spare parts for SOLARIS buses operated by MPK w Radomiu Sp. z o.o. 2. The names and codes relating to the Subject Matter of the Contract specified in the Common Procurement Vocabulary (CPV): 34
Opportunity description
1. The subject matter of the Contract is the successive supply of spare parts for SOLARIS buses operated by MPK w Radomiu Sp. z o.o. 2. The names and codes relating to the Subject Matter of the Contract specified in the Common Procurement Vocabulary (CPV): 34 30 0 00-0 – parts and accessories for vehicles and their engines. 3. The Contracting Authority has divided the contract into 4 parts, in accordance with Appendix No. 2 to the SWZ: 1) Part I: Cooling system, belts, pneumatics; 2) Part II: Drivetrain, chassis; 3) Part III: Electrical system; 4) Part IV: Bodywork. 3.1. The Contractor is required to submit a tender for the full range of products within a given part of the contract. Failure to complete or price any item in Appendix No. 2 for a given part of the contract will result in rejection of the tender as non-compliant with the contract conditions. 3.2. Tenders will be evaluated separately for each part of the contract. 3.3. The Contracting Authority will select the most advantageous tender separately for each part. 3.4. A separate contract covering only that part of the contract will be concluded with the Contractor whose tender is selected as the most advantageous for a given part of the contract, the template for which constitutes Appendix No. 6 to this SWZ. 3.5. One Contractor may be awarded one, several, or all parts of the contract. 4. The supplied Spare Parts will be: a) new, from the current Spare Parts catalog of the manufacturer of the given bus brand, b) original, i.e. they will be of the same quality as the components used for the assembly of the motor vehicle, manufactured in accordance with the specifications and production standards established by the manufacturer of these buses for the production of components or Spare Parts for the given bus, including Spare Parts manufactured on the same production line as the components of the given bus, c) Spare Parts for the buses referred to in point a), related to bus operating safety and environmental protection, should meet at least one of the following conditions: • they are marked with international approval marks used in the approval of the United Nations Economic Commission for Europe (UNECE) – "E" or the European Union – "e"; • they are marked with the identifiers of the manufacturer of the bus for which a national vehicle type-approval certificate has been issued; this marking should be reported to the authorized body for registration; • they are marked with the identifiers of the supplier to the manufacturer of the bus for which a national bus type-approval certificate has been issued; this marking should be reported to the authorized body for registration; • they are marked with a conformity mark in accordance with the regulations on the conformity assessment and accreditation system; this provision does not apply to equipment items and parts marked with a safety mark pursuant to the existing regulations on testing and certification. d) the supplied product range will bear on its packaging at least a logo-trademark, the part manufacturer’s catalog number, and information about the brand/model of bus for which it was ordered. 5. The Subject Matter of the Contract has been specified on an estimated basis. The actual quantity and product range will depend on the Contracting Authority’s current needs. The quantities and range of parts specified by the Contracting Authority in Appendices No. 2 to the SWZ may not constitute the basis for claims by the Contractor if the Contracting Authority’s needs are lower. 6. The Spare Parts must be brand new, free from defects, complete, fully operational, and unencumbered by third-party rights or claims. 7. The Contractor is required to perform the contract in accordance with the rules and conditions described in Appendix No. 6 to the SWZ – Draft contract. 8. The Contracting Authority requires that, in the supply concerned, the share of goods originating from Member States of the European Union or countries with which the European Community has concluded agreements on the equal treatment of businesses exceed 50%. The Contractor shall submit a declaration concerning the share of goods, the content of which is included in the Tender Form constituting Appendix No. 1 to this SWZ. Pursuant to Article 393(1)(4) of the Pzp Act, the Contracting Authority will reject a tender that does not meet this requirement.
