Opportunity description

The subject matter of the contract is the purchase and delivery of parts for Renault vehicles for the needs of Rejonowe Przedsiębiorstwo Zieleni i Usług Komunalnych Sp. z o.o. in Kielce. The subject matter of the contract is specified in detail in Annex No. 6 to the SWZ, “Description of the subject matter of the contract”, in Annex No. 1 – Tender Form, and in Annex No. 1a to the Tender Form – quantity and assortment breakdown. 1. Contractors who submit a tender that is not subject to rejection may apply for the award of the contract, and the Contractor whose tender has received the highest score shall, at the Contracting Authority’s request, submit the JEDZ within the specified time limit and, within 10 days, the PŚD required in the SWZ concerning: 1) fulfilment of the conditions for participation in the procedure, 2) absence of grounds for exclusion. 2. The JEDZ declaration shall be submitted only by the Contractor with the highest-scoring tender, and a JEDZ must be submitted for entities submitting a tender jointly and for entities making resources available, separately for each of those entities. The JEDZ submitted upon request shall be in electronic form and bear a qualified electronic signature, concerning fulfilment of the conditions for participation in the procedure and absence of grounds for exclusion. 3. The Contractor shall complete the JEDZ by creating an electronic document. It may use the ESPD tool or other available tools or software that enable completion of the JEDZ and creation of an electronic document, particularly in one of the formats indicated in the SWZ.4. The information contained in the JEDZ constitutes preliminary confirmation that the Contractor is not subject to exclusion and fulfils the conditions for participation in the procedure. NOTE: The JEDZ declaration is submitted in simplified form, which means that in Part IV of the JEDZ – a general declaration of compliance with the selection criteria (section α) shall be submitted, without completing the individual Sections A, B, C and D in Part IV. (It is recommended to use the prepared JEDZ declaration attached to the SWZ. 5. The JEDZ and the Instructions for completion constitute an Annex to the SWZ. 6. When completing the single document, the applicable provisions of the Public Procurement Law must be taken into account; information on the website of the Public Procurement Office concerning completion of the single document will be helpful, and the Contracting Authority recommends reviewing it at: https://www.gov.pl/web/uzp/jednolity-europejski-dokument-zamowienia 7. With regard to a Contractor who, in light of the grounds specified in Article 108(1)(1), (2) and (5), is subject to exclusion, the Contracting Authority permits (self-cleaning) self – cleaning. Under the rules described in Article 110(2) of the Public Procurement Law. 8. Contractors who, at the Contracting Authority’s request and within 10 days of the request, submit a declaration and entity-related evidence confirming: 1) fulfilment of the conditions for participation in the procedure;2) absence of grounds for exclusion may apply for the award of the contract. 9. Authorisation to conduct a specific business or professional activity, insofar as this follows from separate provisions: The Contracting Authority refrains from describing the method for assessing fulfilment of the conditions in this regard. The Contracting Authority will not assess fulfilment of the conditions for participation in the procedure. 10. Technical or professional capacity: In order to confirm that the Contractor fulfils the conditions for participation in the procedure, the Contracting Authority requires the following entity-related evidence: The Contracting Authority refrains from describing the method for assessing fulfilment of the conditions in this regard. The Contracting Authority will not assess fulfilment of the conditions for participation in the procedure. 11. Economic and financial standing: In order to confirm that the Contractor fulfils the conditions for participation in the procedure, the Contracting Authority requires submission of the following entity-related evidence: The Contracting Authority refrains from describing the method for assessing fulfilment of the conditions in this regard. The Contracting Authority will not assess fulfilment of the conditions for participation in the procedure. 12. Reliance on the resources of other entities: 1) In order to confirm fulfilment of the conditions for participation in the procedure, in appropriate situations and with regard to a specific contract or part thereof, the Contractor may rely on the technical or professional capacities or the financial or economic standing of entities making resources available, irrespective of the legal nature of the legal relationships between it and those entities. 2) With regard to conditions concerning education, professional qualifications or experience, Contractors may rely on the capacities of entities making resources available if those entities perform the construction works or services for which those capacities are required. 3) A Contractor relying on the capacities or standing of entities making resources available shall submit, together with the request to participate in the procedure or, as applicable, together with the tender, an undertaking by the entity making resources available to place the necessary resources at its disposal for the purposes of performing the contract concerned, or other entity-related evidence confirming that, when performing the contract, the Contractor will have the necessary resources of those entities at its disposal. 4) The undertaking by the entity making resources available referred to in paragraph 3 confirms that the relationship between the Contractor and the entities making resources available guarantees actual access to those resources and specifies in particular: a) the scope of the resources of the entity making resources available that are available to the Contractor; b) the manner and period in which the resources are made available to and used by the Contractor when performing the contract; c) whether and to what extent the entity making resources available, on whose capacities the Contractor relies with regard to the conditions for participation in the procedure concerning education, professional qualifications or experience, will perform the construction works or services to which the indicated capacities relate. 5) The Contracting Authority shall assess whether the technical or professional capacities or financial or economic standing made available to the Contractor by entities making resources available allow the Contractor to demonstrate fulfilment of the conditions for participation in the procedure referred to in Article 112(2)(3) and (4), and shall also examine whether grounds for exclusion provided for in relation to the Contractor apply to that entity. 6) Where the Contractor relies on the capacities or standing of entities making resources available, it shall present, together with the declaration referred to in Chapter V, paragraph 1 of the SWZ, a declaration by the entity making resources available confirming the absence of grounds for exclusion.
