Opportunity description
1.The subject of the contract is the supply of factory-new technical materiel, batteries and tires for aircraft, i.e. manufactured in the year of delivery or in the year preceding the year of delivery, in the assortment and quantities specified in the Pricing Form constituting Appendix No. 1 to the SWZ. 2.The Contracting Authority has divided the subject of the contract into 16 tasks (lots), in accordance with the Pricing Form constituting Appendix No. 1 to the SWZ. 3. The products should meet the quality requirements specified in the manufacturer’s technical documentation for the given product. 4.The Contractor’s quality management system must meet the requirements contained in PN:EN ISO 9001:2015. 5. The Contractor shall provide a warranty for the supplied products for a period of 24 months/200 operating hours (whichever occurs first), calculated from the date of acceptance. 6. For the supplied tires (tires and inner tubes), the Contractor shall ensure a total service life of no less than 7 years. 7. Furthermore, for the supplied aircraft batteries for aircraft, the Contractor shall ensure: - a minimum battery service life on the aircraft of 15 months; - a minimum battery storage period in warehouses of no less than 3 years; - no restrictions on operation in aircraft under vertical and horizontal overloads. Additionally, the Contractor shall provide: - for each 12-SAM-28 aircraft battery: a set of ventilation/operating plugs (12 operating plugs +2 spare plugs with washers), 1 package (70g) of odorless sodium sulfate; - for each individual battery of the following types: 20KSX-25P, 20FP25H1CT-R, SAFT 26108-7, a minimum quantity of 2 spare cells. The cells in question must be identical to those in the battery offered. 8. The subject of the contract will be subject to a quality supervision process in accordance with the rules specified in the Draft Contractual Provisions constituting Appendix No. 2 to the SWZ. 9. The products must be preserved for a period of 24 months and in accordance with the rules specified in defense standard NO-16-A800:2007. The use of protection methods other than those specified in defense standard NO-16-A800:2007 is permitted, provided that they ensure equivalent or better protection. 10. The supplied items, including all their assembly components, etc. (if any), must be adequately protected against the loss of any of their functional qualities. 11. The requirements contained in AQAP 2131, edition C, version 1, apply to this contract for Item Nos. 1 to 16 of Appendix No. 1 to the Draft Contractual Provisions constituting Appendix No. 2 to the SWZ. 12. At the same time, together with the products under tasks (lots) 1÷11, 14÷16 of the contract, the Contractor shall provide an OiB declaration of conformity issued in accordance with the Act of 17 November 2006 on the conformity assessment system for products intended for the needs of national defense and security (Journal of Laws of 2022, item 747, as amended) and indicated in the Regulation of the Minister of National Defense of 11 January 2013 on the detailed list of products subject to conformity assessment and the manner and procedure for conducting the conformity assessment of products intended for the needs of national defense (Journal of Laws of 2021, item 1628, as amended) - i.e. under conformity assessment procedure I. 13. In accordance with Article 455 of the Pzp Act, the Contracting Authority permits the possibility of amending the contract without conducting a new contract award procedure in the cases and under the conditions specified in § 20 of the Draft Contractual Provisions. 14. The subject of the contract is the supply of military equipment, including technical materiel, which the Contracting Authority cannot describe in a sufficiently precise and comprehensible manner, unambiguously and exhaustively, by specifying sufficiently precise technical or quality parameters; therefore, the Pricing Form constituting Appendix No. 1 to the SWZ indicates product designations (designation, Part Number, NSN, name), together with information on the type of equipment of which they are a part, component or accessory, while permitting the submission of equivalent tenders in all 16 lots of the contract. 15. In order to meet the requirement arising from Article 99(6) of the Pzp Act, the Contracting Authority indicates that the criterion used to assess equivalence will be the approval of the equivalent product offered for use on specific types of equipment in service with the Armed Forces of the Republic of Poland. 16. When offering equivalent products, the Contractor is required to indicate in box 6 of the Pricing Form constituting Appendix No. 1 to the SWZ, under the individual tasks (lots) of the contract for which it offers equivalent products, the (name/designation, Part Number, NSN). If column 6 is not completed, the Contracting Authority will consider that the Contractor is submitting a tender for the subject of the contract indicated by the Contracting Authority. 17. The Contracting Authority requires the submission, together with the tender, of the subject-matter evidence indicated in Chapter IV of the SWZ. 18. The obligation to submit the subject-matter evidence referred to in Chapter IV, point 2 of the SWZ applies exclusively to Contractors offering equivalent products. If products indicated by the Contracting Authority in the SWZ are offered, submission of this evidence is not required. 19. The detailed conditions for performance of the contract are specified in the Draft Contractual Provisions constituting Appendix No. 2 to the SWZ. 20. The Contracting Authority reserves the possibility of exercising the option right. The Contracting Authority stipulates that the contract described as the “option right” is an entitlement, not an obligation. The contract under the option right will be performed at the same unit prices as for the basic contract, in accordance with the rules specified in Appendix No. 1 to the SWZ.
