Opportunity description
1.The subject matter of the contract is: Supply of shearer picks for the Branches of Polska Grupa Górnicza S.A. – group no. 295-9. 2.A detailed description of the subject matter of the contract, as well as the legal requirements and technical and operational parameters, is set out in Annex No. 1 to this SWZ. The quantitative scope of the subject matter of the contract is an estimated scope determined by the Contracting Authority with due diligence. Despite exercising due diligence, due to the nature of its business activities, the Contracting Authority does not guarantee performance of the contract in its full scope. 3.In order to confirm that the offered supply complies with the Contracting Authority's requirements, the submission of subject-matter evidence together with the tender is required. 4.The Contracting Authority does not permit the submission of variant tenders. 5.The Contracting Authority permits more than one product (products from different manufacturers) to be offered under one item of the tender form. If the contractor offers more than one product (products from different manufacturers) under a given item of the tender form, the following is required: a) each offered product must meet the requirements specified in the SWZ, b) subject-matter evidence concerning all offered products must be submitted together with the tender. A tender in which products from different manufacturers have been offered under one item of the tender form is deemed compliant with the requirements of the SWZ, provided that all products offered under the given item of the tender form meet the requirements. If even one of the offered products does not meet the requirements, the tender shall be rejected pursuant to Article 226(1)(5) of the Pzp Act. 6.The Contracting Authority reserves the right to change the quantities of goods ordered within individual assortment items and to place orders according to actual needs. 7.The Contracting Authority declares that the minimum guaranteed level of contract performance is 50% of the value of the awarded contract. The Contractor shall not be entitled to claims for performance of the contract to a greater extent. 8. The procurement procedure for the award of a sectoral contract is conducted as an open tender pursuant to the provisions of the Act of 11 September 2019 – Public Procurement Law (Journal of Laws, item 2019, as amended), hereinafter referred to as the Pzp Act. 9.The procedure is conducted in Polish. 10.The information obligation arising from Articles 13 and 14 of the Regulation of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (OJ EU L.2016.119.1 of 4 May 2016) (hereinafter referred to as “RODO”) has been fulfilled on the PGG S.A. website under the RODO tab, in the annex “Contractors/Contractors' Employees”. In the case of personal data processing for a purpose related to a public procurement procedure, the Contracting Authority has fulfilled the information obligation in the Buyer Profile on the Polska Grupa Górnicza website under the “PZP information obligation” tab. 11.Additionally, the Contracting Authority informs that a) the exercise by the data subject of the right to rectification or completion referred to in Article 16 of RODO may not result in a change to the outcome of the procurement procedure or a change to the provisions of the public procurement contract to an extent inconsistent with the Act. b) in a procurement procedure, the submission of a request for restriction of processing referred to in Article 18(1) of RODO shall not restrict the processing of personal data until the completion of that procedure. 12.Pursuant to Article 393(1)(4) of the Pzp Act, the Contracting Authority shall reject a tender in which the share of products originating from Member States of the European Union, states with which the European Union has concluded agreements ensuring equal treatment of entrepreneurs, or states to which, by virtue of a Council decision, the provisions of Directive 2014/25/EU apply, does not exceed 50%. 13.The Contracting Authority permits the submission of partial tenders for individual parts of the contract (tasks) listed in Annex No. 2 to the SWZ. The submitted tender should cover the entire material and quantitative scope of the part of the contract. The number of parts of the contract (tasks) is: 8. 14.The Contracting Authority provides for the possibility of one Contractor submitting a tender for one or more parts of the contract (tasks).
