1. The subject matter of the contract is the “Supply of official vehicles for the Municipal Guard of the City of Kraków II", case reference ST.RL.261.12.2026. 2. Under the contract, the Contractor shall supply five cars, hereinafter also referred to as vehicles, in accordance with the Description of the Subject Matter of the Contract (OPZ) specified in Annex No. 2 to the SWZ. The Contracting Authority provides for an option right described in detail in Section V, subpoint 17 of the SWZ. 3. The Contractor shall provide a full warranty for the cars and equipment components under the conditions specified in the procurement documents, in particular in the draft contractual provisions (PPU) – the contract template constituting Annex No. 8 to the SWZ, and in accordance with the submitted tender. 4. A detailed description of the subject matter of the contract and the scope of the Contractor’s obligations are specified in the annexes to the SWZ, including the Draft contractual provisions and the Description of the Subject Matter of the Contract – OPZ. 5. In accordance with Article 139(1) of the Pzp Act, the Contracting Authority provides for the reverse order of activities, i.e. it shall first examine and evaluate the tenders and then conduct the entity qualification of the Contractor whose tender received the highest evaluation, with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. In connection with the application of the above procedure, the Contracting Authority does not require the submission, together with the tender, of a declaration in the form of the European Single Procurement Document (ESPD). The Contracting Authority requires this declaration to be submitted only by the Contractor whose tender received the highest evaluation. 6. The tender must contain the following declarations and documents: a) Tender Form (together with the required annexes) and the Technical Specification of the subject matter of the contract – by uploading to the Platform completed Annexes No. 1 and 1a to the SWZ, prepared according to the template provided by the Contracting Authority. If a tender is submitted using a form other than Annexes No. 1 and 1a to the SWZ, it should contain all the required information specified in those annexes. The Tender Form and the Technical Specification of the subject matter of the contract may not be supplemented. b) In the case of Contractors relying on the resources of entities making resources available – the Commitment of those entities using the template constituting Annex No. 7 to the SWZ. c) In the case of Contractors jointly applying for the award of the contract – the Declaration under Article 117(4) of the Pzp Act using the template constituting Annex No. 4 to the SWZ. d) The Declaration/Declarations referred to in Section XVI of the SWZ. e) An extract or information from the National Court Register, the Central Register and Information on Economic Activity, or another appropriate register – in order to confirm that the person acting on behalf of the Contractor is authorised to represent it. The Contractor is not required to submit the aforementioned documents if it indicates in the Tender Form the data enabling access to those documents through free and publicly accessible databases. f) If applicable – Powers of attorney. 7. The Contractor is required to submit the documents referred to in point 6(a–f) above via the Platform. 8. The Contractor shall submit only one tender in accordance with the requirements specified in the SWZ. The content of the tender must correspond to the content of the SWZ. 9. The tender should be prepared in Polish and submitted, under penalty of invalidity, in electronic form or as an electronic document via the Platform available at https://strazmiejska-krakow.ezamawiajacy.pl.
