Opportunity description

The subject of the contract is the purchase and delivery of unmarked police motor vehicles for the needs of the Silesian garrison under a framework agreement divided into three tasks. The Contracting Authority will conclude a framework agreement for each task separately with a maximum of six (6) Contractors whose tenders meet all the requirements of the SWZ and the Pzp Act and receive the highest number of points based on the tender evaluation criteria specified in section XX of the SWZ. If fewer tenders not subject to rejection are submitted, the Contracting Authority will conclude a framework agreement with all Contractors for the given task who meet all the requirements of the SWZ and the Pzp Act. If one tender not subject to rejection is received, the Contracting Authority will conclude a framework agreement with one contractor. The Contracting Authority informs that, after concluding the framework agreement, it will award partial (performance) contracts successively as needs arise and financial resources for performance are obtained, in accordance with the contract terms specified in the framework agreement, without conducting a competitive procedure pursuant to Art. 314(1)(1) of the Pzp Act, in the form of cascading contract awards based on the unit prices offered in the procedure conducted for the purpose of concluding the framework agreement, as described in points 3.1-3.4 of section IV of the SWZ, subject to § 7 and § 9(3) of the draft contractual provisions. After selecting the tenders of the contractors with whom the framework agreement will be concluded, the Contracting Authority will prepare a ranking according to the order of the points obtained under the tender evaluation criterion, starting with the highest-rated tender. When the need to award a partial (performance) contract arises, the contracting authority will ask the contractor whose tender was deemed the most advantageous at the time the framework agreement was concluded, i.e. the highest-rated in accordance with the tender evaluation criteria in section XX of the SWZ and according to the ranking, for information on whether it is able to perform this contract in full. If the contractor informs the Contracting Authority that it is able to perform the partial contract in full, the Contracting Authority will sign a performance contract with that contractor, and the value will result from multiplying the unit price offered in the procedure for concluding the framework agreement by the number of vehicles; If the contractor (first in the ranking) informs the Contracting Authority that it is unable to perform the partial contract in full, but only in part, e.g. it can deliver only two out of five vehicles, the Contracting Authority will then ask the next (second) contractor in the ranking whether it is able to perform the contract for the missing vehicles. In the event of a positive response, the Contracting Authority will sign two performance contracts with these contractors (the first and second in the ranking). If information is received from the second contractor that it is unable to perform the partial contract in full, but only in part, the Contracting Authority will ask the next (third) contractor in the ranking whether it is able to perform the contract for the missing vehicles and, in the event of a positive response, the Contracting Authority will sign three performance contracts. If information is received from the second contractor that it is unable to perform the partial contract, the Contracting Authority will ask the next (third) contractor in the ranking whether it is able to perform the contract. If the contractor (first in the ranking) informs the Contracting Authority that it is unable to perform the partial contract, the Contracting Authority will ask the next (second) contractor in the ranking whether it is able to perform the contract. Each indexation of unit prices during the term of the framework agreement necessitates redetermining the ranking (order) of contractors according to which partial contracts will be commissioned, counting from the date of conclusion of the amendment with the given contractor. The ranking is prepared by the Contracting Authority based on the tender evaluation criterion in section XX of the SWZ. As a result of recalculating the points, there may be a change in the first position in the ranking of contractors with whom partial (performance) contracts will be performed first. When a contractor's position in the ranking changes, the rules specified in paragraphs 3.2 to 3.2.3 of section IV of the SWZ apply. The Contracting Authority will award partial (performance) contracts on a cascading basis to successive contractors according to the ranking prepared on the basis of the highest-rated contractors' tenders with whom the framework agreement will be concluded, or on the basis of the ranking prepared in connection with the conclusion of an amendment to the framework agreement for the indexation of the unit price, or on the basis of the ranking prepared in connection with a change in the assortment in the situation described in paragraph 14 of section IV of the SWZ. At the stage of performing performance contracts based on the framework agreement, the unit prices of the assortment offered by the Contractor in the procedure conducted for the purpose of concluding the framework agreement remain unchanged, subject to § 7 of the draft contractual provisions. The Contracting Authority agrees to the supplied vehicle being changed to one other than that offered in the tender form where the Contractor demonstrates that the offered vehicle has been withdrawn from sale or its production has been discontinued or it is unavailable on the Polish market (confirmed by the manufacturer or the commercial representative for the Polish market). The Contracting Authority permits another vehicle/other vehicles to be offered and delivered provided that its/their technical specifications meet the contract terms indicated in the description of the subject of the contract and the price is identical to the price offered in the tender form for a period of up to 6 months from the date of conclusion of the contract. After this period, indexation of unit prices applies in accordance with § 7 of the draft contractual provisions. The technical specifications of the assortment described in appendices Nos. 3.1-3.3 to the SWZ constitute the Contracting Authority's minimum requirements. Failure to meet the minimum requirements will result in rejection of the tender. The subject of the contract is the purchase and delivery of unmarked police hatchback/sedan vehicles with enhanced specifications. A detailed description of the subject of the contract is contained in appendix No. 3.1 to the SWZ. The technical specifications of the assortment described in appendix No. 3.1 to the SWZ constitute the Contracting Authority's minimum requirements. Failure to meet the minimum requirements will result in rejection of the tender as non-compliant with the contract terms pursuant to Art. 226(1)(5) of the Pzp Act. The Contracting Authority requires the offered vehicle to be brand new, first grade, unused, unregistered, manufactured no earlier than in the year preceding the performance contract, free from manufacturing and legal defects, with a maximum mileage not exceeding 30 km, authorized for marketing, and compliant with the quality and performance standards required by the regulations and indicated by the Contracting Authority in appendix No. 3.1 to the SWZ. The Contracting Authority requires the Contractor to specify the make, model, version, symbol or other additional data enabling unambiguous identification of the offered vehicle in appendix No. 1 to the SWZ (tender form). Failure to enter data in the dotted spaces in the tender form will result in rejection of the tender pursuant to Art. 226(1)(5) of the Pzp Act – as non-compliant with the contract terms, if they cannot be determined from any document submitted with the tender by the tender submission deadline. The Contracting Authority requires a warranty for the vehicle's mechanical, electrical and electronic components for a minimum period of 24 months without a mileage limit, as well as a minimum 36-month warranty for the paint coating, a warranty against perforation of bodywork components, and a warranty for the entire vehicle conversion and equipment. The warranty will be calculated from the date of acceptance of the subject of the contract by the contracting authority, as documented in the acceptance report. The Contracting Authority requires periodic inspections and repairs under the offered warranty to be carried out at authorized service stations. The Contracting Authority requests that authorized service stations for the offered vehicle make be indicated in the tender form (at least two within the Silesian Voivodeship).The Contracting Authority requests that the delivered vehicles undergo pre-delivery inspections performed by the Contractor and at its expense, which must be confirmed in the documentation of each vehicle. The Contracting Authority requests that the delivered vehicles have an amount of fuel above the reserve level (the low-fuel warning light must not be illuminated). If the subject of the contract is delivered with fuel at or below the reserve level, the contractor will replenish the required amount of fuel at the place of acceptance, at its own expense. The Contracting Authority requires the Contractor to bear all costs associated with warranty service, including transport, during the warranty period granted. The value of the agreement will amount to the sum that the Contracting Authority intends to allocate to performance of the contract as stated in the contract notice, and payment for completed deliveries will be made successively on the basis of separately concluded performance contracts, based on the unit prices indicated in the tender form - appendix No. 1 to the SWZ, subject to § 7 of the draft contractual provisions. At the same time, the Contracting Authority informs that if an amount remains under the agreement that does not constitute the full unit price of a vehicle, the Contracting Authority may increase the value of the agreement to make up the unit price of the vehicle, enabling its purchase. The offered gross unit price of the vehicle and the technical specifications entered in appendix No. 1 to the SWZ - the tender form, in accordance with the instruction in section XX of the SWZ, will be used by the Contracting Authority to select a maximum of six highest-rated tenders.
