Opportunity description
1. The subject matter of the basic scope of the contract is the modernization of passenger information systems (SIP) and selected IT systems, i.e. the Passenger Information System (SIP), Internal and External Monitoring System (CCTV), Dynamic Timetable System (SDRJ), Passenger Counting System, Advertising Display System (SER), and fuel consumption measurement and level system in 20 diesel multiple units of the SA103, SA131, SA132, SA133, SA136, SA137 and SA138 series owned by the Pomeranian Voivodeship, including equipment replacement, delivery of a dispatcher application and user training. The operator providing transport services using the above-mentioned vehicles is POLREGIO S.A., Pomeranian Branch in Gdynia. The purpose of the modernization is to achieve a high level of functionality of the systems installed in the vehicles, enabling, among other things, increased safety in the vehicles, increased cybersecurity, analysis of passenger flows, information provided to passengers, etc. 2. In addition to the basic scope, the Contracting Authority is entitled to exercise the option referred to in Article 441 of the Public Procurement Law. The option covers the modernization of the Passenger Information System (SIP), Internal and External Monitoring System (CCTV), Dynamic Timetable System (SDRJ), Passenger Counting System, Advertising Display System (SER), and fuel consumption measurement and level system in a maximum of 6 SA133 series diesel multiple units, together with the performance of full functional tests and commissioning of the system. The Contracting Authority may exercise the option in whole or in part. The Contracting Authority will decide whether it is able and willing to exercise the reserved option in accordance with its available financial resources. It is stipulated that the option does not constitute a contractual obligation (including a financial obligation) of the Contracting Authority incurred upon conclusion of the procurement contract, and the anticipated optional scope of the contract is not guaranteed to be implemented. The optional scope indicated above constitutes the maximum scope of the reserved option. The Contractor is obliged to perform under the reserved option if and to the extent that the Contracting Authority exercises it in accordance with the content of the Contracting Authority’s submitted declaration on exercising the option and the conditions specified in the contract—upon submission of such a declaration, the Contracting Authority incurs a financial obligation in the amount resulting from the scope of work covered by the option implemented pursuant to the given declaration. The Contractor shall have no claim against the Contracting Authority if the Contracting Authority does not exercise the option. 3. The Contracting Authority stipulates that the unit prices covered by the option will be identical to the prices offered under the basic contract and will remain unchanged throughout the contract performance period, subject to remuneration indexation. 4. The rules for performing the subject matter of the contract covered by the option concerning the manner of its performance, acceptance, required standards and technical conditions, method of payment, method of providing security, method of calculating contractual penalties, exercise of rights and obligations arising from the warranty, and cooperation between the Parties will be the same as those applicable to the basic subject matter of the contract. 5. The Contracting Authority will notify the Contractor of the exercise of the option, depending on its needs, no later than 30 days from the date of conclusion of the contract. The Contracting Authority may exercise the option once. 6. The deadline for performing the contract referred to in paragraph 2 is the same as the deadline for performing the basic scope of the contract. 7. A detailed description of the subject matter of the contract is set out in the Description of the Subject Matter of the Contract constituting Annex No. 1 to the SWZ, in the annexes to the OPZ, and in the draft contract constituting Annex No. 2 to the SWZ. 8. The Contracting Authority does not reserve the possibility of applying for the contract exclusively to Contractors referred to in Article 94 of the Public Procurement Law. 9. Subcontracting: 1) The Contractor may entrust the performance of part of the contract to a subcontractor (subcontractors). 2) In connection with the performance of the contract, the Contracting Authority does not reserve the obligation to personally perform the key tasks of the contract. 3) The Contracting Authority requires that, where part of the contract is entrusted to subcontractors, the Contractor indicate in the tender the parts of the contract that it intends to entrust to subcontractors and provide the names of those subcontractors (if already known). 4) Entrusting part of the contract to subcontractors does not release the Contractor from responsibility for proper performance of the contract. 10. The Contracting Authority does not permit the submission of a variant tender referred to in Article 92 of the Public Procurement Law, i.e. a tender providing for a method of performing the contract different from that specified in this SWZ. 11. The Contracting Authority does not envisage concluding a framework agreement or establishing a dynamic purchasing system, nor does it envisage selecting the most advantageous tender using an electronic auction. 12. The Contracting Authority does not envisage awarding contracts pursuant to Article 214(1)(8) of the Public Procurement Law. 13. The Contracting Authority does not permit tenders to be submitted in the form of electronic catalogues or electronic catalogues to be attached to the tender in the situations specified in Article 93 of the Public Procurement Law. 14. The Contracting Authority does not envisage settlement in foreign currencies. The contract will be settled in PLN. 15. The Contracting Authority does not envisage reimbursement of the costs of participation in the procedure. 16. The Contracting Authority does not envisage granting an advance payment for performance of the contract. 17. The Contracting Authority requires the subject matter of the contract to be performed in accordance with the requirements contained in the SWZ, including the description of the subject matter of the contract (constituting Annex No. 1 to the SWZ), and in accordance with the draft contract (constituting Annex No. 2 to the SWZ).
