Opportunity description
1. The subject matter of the contract is the supply of enteral nutrition preparations for UCK in the assortment, estimated quantity and in accordance with the requirements specified in Annex No. 3 to the SWZ. 2. The Contracting Authority permits the submission of tenders for parts. A tender for a part means individual items specified in Annex No. 3 to the SWZ. The Contractor may submit a tender for one or more items. 3. Deliveries shall be made successively, in the quantity and assortment specified in the Contracting Authority’s partial orders, within 2 days from the date of placing the order. The Contractor shall be required to deliver the ordered assortment at its own expense to the Hospital Pharmacy. 4. Where the Contracting Authority has used designations of standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the Pzp Act in the description of the subject matter of the contract, equivalent solutions are permitted. Whenever a standard is indicated in this SWZ or the annexes to the SWZ, it shall be assumed that the phrase “or equivalent” has been used in relation to it. Where the description of the subject matter of the contract refers to standards, technical assessments, technical specifications and technical reference systems referred to in paragraph 1 point 2 and paragraph 3, the Contracting Authority may not reject a tender solely because the offered supplies do not comply with the standards, technical assessments, technical specifications and technical reference systems to which the description of the subject matter of the contract refers, provided that the Contractor proves in the tender, in particular by means of the subject-matter evidence referred to in Articles 104-107, that the proposed solutions satisfy the requirements specified in the description of the subject matter of the contract to an equivalent degree. 5. The Contracting Authority requires tenders to be submitted electronically. A detailed description (instructions) for submitting tenders electronically is included in Section XIV of the SWZ. The Contracting Authority hereby informs that the so-called “reverse order of tender evaluation” referred to in Article 139 of the PZP Act shall be applied in this public procurement procedure. In applying the above procedure, the Contracting Authority shall first examine and evaluate the tenders and shall then assess the eligibility of the Contractor whose tender received the highest evaluation with respect to the absence of grounds for exclusion and fulfillment of the conditions for participation in the procedure. 14. The Contractor may entrust the performance of part of the contract to a subcontractor. 15. The Contracting Authority does not permit the submission of variant tenders. 16.
