Opportunity description

1. The subject of the contract is the supply of medicinal products under target import for UCK in the assortment, estimated quantity and in accordance with the requirements specified in Annex No. 3 to the SWZ. 2. The Contracting Authority permits the submission of tenders for parts. A tender for a part is understood as individual items specified in Annex No. 3 to the SWZ. The Contractor may submit a tender for one or several items. 3. The Contracting Authority does not consent to amendments being made to Annex No. 3 to the SWZ – the assortment and price form, under penalty of rejection, except for the situation referred to below: The Contracting Authority consents to: - changing the form of the proposed preparations, e.g. from vials to ampoules or pre-filled syringes and vice versa; - changing the form of the proposed preparations, e.g. from tablets to film-coated tablets or capsules or dragees and vice versa; - changing package sizes after appropriate conversion of units. 4. Deliveries will be made successively, in the quantity and assortment specified in the Contracting Authority’s partial orders, within 21 days from the date the order is placed. The Contractor will be obliged to deliver the ordered assortment at its own expense to the Hospital Pharmacy. 5. The Contracting Authority requires that the prices of the medicines offered be no higher than the official prices specified in Article 9(1) and (2) of the Act of 12.05.2011 on the year of reimbursement of medicines, foodstuffs for particular nutritional uses and medical devices (Journal of Laws 2025, item 907), applicable on the tender submission date – if applicable. 6. The medicinal products offered must comply with the Pharmaceutical Law Act of 6 September 2001 (Journal of Laws 2025, item 750) – if applicable. The medicinal products offered must be authorised for marketing in Poland under the rules set out in Article 3 or 4a of the Pharmaceutical Law Act. 7. The medical devices offered must comply with the Act of 7 April 2022 on medical devices (Journal of Laws of 2024, item 1620) and with the implementing acts issued pursuant to that Act – if applicable. 8. The Contracting Authority permits the submission of an equivalent tender for items 20 and 52. The Contracting Authority advises that all proprietary names used in the description of the subject of the contract define the required standard of the assortment ordered. The Contracting Authority permits the submission of tenders with equivalent quality parameters and an identical chemical composition in terms of the basic substances. The burden of proving compliance with the equivalence condition rests with the Contractor. 9. Where the Contracting Authority has used in the description of the subject of the contract designations of standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the Pzp Act, equivalent solutions are permitted. Whenever a standard is indicated in this SWZ or the annexes to the SWZ, it must be assumed that the phrase “or equivalent” has been used in relation to it. Where the description of the subject of the contract refers to standards, technical assessments, technical specifications and technical reference systems referred to in paragraph 1(2) and paragraph 3, the Contracting Authority may not reject a tender solely because the supplies offered do not comply with the standards, technical assessments, technical specifications and technical reference systems to which the description of the subject of the contract refers, provided that the Contractor proves in the tender, in particular by means of the subject-matter evidence referred to in Articles 104–107, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent degree. 10. The Contracting Authority requires tenders to be submitted electronically. A detailed description (instructions) for submitting tenders electronically is contained in Section XIV of the SWZ. The Contracting Authority advises that the so-called “reverse order of tender evaluation” referred to in Article 139 of the PZP Act will be applied in this public procurement procedure. In applying the above procedure, the Contracting Authority will first examine and evaluate the tenders and will then perform the entity-related qualification of the Contractor whose tender was rated highest with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 14. The Contractor may entrust the performance of part of the contract to a subcontractor. 15. The Contracting Authority does not permit the submission of variant tenders. 16.
