Opportunity description

1. The subject matter of the contract is the supply of medicinal products for UCK in the assortment, estimated quantity and according to the requirements specified in Annex No. 3 to the SWZ. 2. The Contracting Authority allows the submission of tenders for individual lots. A tender for an individual lot is understood as covering an individual lot specified in Annex No. 3 to the SWZ. The Contractor may submit a tender for one or several lots. 3. With regard to lot 1, the Contracting Authority allows the submission of tenders for individual items. A tender for an individual item is understood as covering an individual item specified under lot 1 in Annex No. 3 to the SWZ. The Contractor may submit a tender for one or several items. 4. For items marked with the symbol (**) in the assortment and price form in Annex No. 3 to the SWZ, the Contracting Authority requires the offered preparation to be included in the catalogue of reimbursed medicines used in drug programmes or in the catalogue of reimbursed medicines used in chemotherapy. 5. The Contracting Authority specified the packaging method in the assortment and price form. For items where no such description is provided, the Contractor may offer any packaging method while maintaining the quantity required by the Contracting Authority and specified for the given item. The Contractor must price the proposed packaging method using an appropriate conversion. 6. Deliveries will be made successively, in the quantities and assortment specified in the Contracting Authority's partial orders, within 2 days from the date the order is placed. The Contractor will be required to deliver the ordered assortment at its own expense to the Hospital Pharmacy. 7. The Contracting Authority requires that the prices of the medicines offered not exceed the official prices specified in Article 9(1) and (2) of the Act of 12.05.2011 on the year of reimbursement of medicines, foodstuffs intended for particular nutritional uses and medical devices (Journal of Laws 2025, item 907), applicable on the tender submission date – if applicable. 8. The offered medicinal products must comply with the Act of 6 September 2001, Pharmaceutical Law (Journal of Laws 2025, item 750) – if applicable. The offered medicinal products must be authorised for marketing in Poland under the rules specified in Article 3 or 4a of the Pharmaceutical Law. 9. The offered medical devices must comply with the Act of 7 April 2022 on medical devices (Journal of Laws of 2024, item 1620) and the implementing acts issued pursuant to that act – if applicable. 10. The Contracting Authority allows the submission of an equivalent tender for items 24, 28, 45, 46, 132, 135, 136 and 137 of lot 1. The Contracting Authority states that all proprietary names used in the description of the subject matter of the contract define the required standard of the assortment being ordered. The Contracting Authority allows the submission of tenders with equivalent quality parameters and an identical chemical composition in terms of the basic substances. The burden of proving compliance with the equivalence condition rests with the Contractor. 11. Where the Contracting Authority used, in the description of the subject matter of the contract, designations of standards, technical assessments, technical specifications and technical reference systems referred to in Article 101(1)(2) and (3) of the Pzp Act, equivalent solutions are permitted. Whenever a standard is indicated in this SWZ or the annexes to the SWZ, it must be assumed that the phrase “or equivalent” has been used in relation to it. Where the description of the subject matter of the contract refers to standards, technical assessments, technical specifications and technical reference systems referred to in paragraph 1(2) and paragraph 3, the Contracting Authority may not reject a tender solely because the supplies offered do not comply with the standards, technical assessments, technical specifications and technical reference systems to which the description of the subject matter of the contract refers, provided that the Contractor proves in the tender, in particular by means of the subject-matter evidence referred to in Articles 104–107, that the proposed solutions satisfy the requirements specified in the description of the subject matter of the contract to an equivalent degree. 12. The Contracting Authority requires tenders to be submitted electronically. A detailed description (instructions) for submitting tenders electronically is contained in Section XIV of the SWZ. The Contracting Authority states that the so-called “reversed order of tender evaluation” referred to in Article 139 of the PZP Act will be applied in this public procurement procedure. When applying the above procedure, the Contracting Authority will first examine and evaluate the tenders and will then assess the eligibility of the Contractor whose tender received the highest evaluation with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 14. The Contractor may entrust the performance of part of the contract to a subcontractor. 15. The Contracting Authority does not allow the submission of variant tenders. 16.
