1. The subject matter of the contract is the supply of medicines for the entire Megrez Sp. z o.o. hospital. 2. The subject matter of the contract is governed by the provisions of the Act of 12 May 2011 on the reimbursement of medicines, foodstuffs intended for particular nutritional uses and medical devices (Journal of Laws of 2011, No. 122, item 696, as amended). 3. In the case of reimbursed medicines, foodstuffs intended for particular nutritional uses and medical devices, the prices offered and applied by the Contractor may not exceed the maximum prices determined pursuant to Article 9(1) of the Act of 12 May 2011 on the reimbursement of medicines, foodstuffs intended for particular nutritional uses and medical devices. 4. A detailed description of the subject matter of the contract is set out in the assortment and price form – Annex No. 2 to the SWZ. 5. The Contractor is obliged to perform the contract in accordance with the terms and conditions in the draft contractual provisions constituting Annex No. 4 to the SWZ. 6. Common Procurement Vocabulary CPV: 33600000-6 – pharmaceutical products. The Contracting Authority permits the submission of tenders for individual lots. The contract consists of 15 packages (parts). The Contractor is entitled to submit a tender covering at least 1 package (part). Packages must be priced in full. Tenders that do not contain the full scope of the subject matter of the contract specified in the package will be rejected. 7. In the assortment and price form, in the fields “Manufacturer and catalogue number, product name”, only one name of the offered goods must be provided (unless the description of the subject matter of the contract requires more), together with the name of the manufacturer of those goods, allowing the goods to be identified unambiguously on the market. 8. Whenever a standard is indicated in this SWZ or the annexes to the SWZ, it shall be assumed that the phrase “or equivalent” has been used in relation to it. The Contracting Authority envisages applying the option right: Under Task 4, up to 25% of the value of the basic contract. Under Task 7, up to 25% of the value of the basic contract. Under Task 10, up to 25% of the value of the basic contract. Under Task 11, up to 25% of the value of the basic contract. The Contracting Authority reserves the possibility of exercising the option right (in whole or in part) if, during the term of the contract, the basic scope is exhausted and, additionally, the purchase of an additional quantity of the product is in the interest of the Contracting Authority and results from its current needs. To activate the option right, the Contracting Authority will submit to the Contractor a written declaration of intent regarding the exercise of the option right to a specified extent. The declaration will contain confirmation of the financial resources for performing the contract and will constitute an annex to the contract. The option right is a unilateral entitlement of the Contracting Authority, which it may, but is not obliged to, exercise as part of the performance of the subject matter of the contract. If the Contracting Authority does not exercise the option right, the Contractor shall not be entitled to any claims on that account. If the Contracting Authority exercises the option right, the Contractor’s contractual obligation is to perform the services within the scope covered by the exercised option right under the same conditions as the basic contract. The Contracting Authority has the right to exercise the option right multiple times after the basic scope of the contract has been completed – but only until the maximum scope of the option right has been exhausted.
