Poland – Pharmaceutical products – Supply of medicinal products, infusion fluids, enteral and parenteral nutrition preparations, and contrast agents

Opportunity description

1. The subject matter of the contract is the successive supply, upon the Contracting Authority’s orders, of medicinal products, infusion fluids, enteral and parenteral nutrition preparations, and contrast agents, divided into 50 lots. 2. A detailed description of the subject matter of the contract, including the assortment, doses, forms, and quantities, is set out in Annex No. 2 to the SWZ – Assortment and Price Form. 3. The assortment constituting the subject matter of the contract must be authorized for marketing and use in the territory of the Republic of Poland in accordance with the Act of 6 September 2001 – Pharmaceutical Law (consolidated text: Journal of Laws 2026, item 612). The Contractor is required to possess all documents required by law authorizing the offered medicinal products for marketing and to present them at the Contracting Authority’s request (excluding medicinal products imported under the target import procedure). 4. The submitted tenders must specify the trade name of the preparation, package size, manufacturer’s name, GTIN/EAN code, marketing authorization number, and detailed product information. Where the offered medicinal product package contains a different number of units (e.g. tablets, ampoules), the Contractor is required to recalculate the number of packages accordingly. If the calculation results in an incomplete number of packages, the quantity must be rounded up to a full package. The EAN (GTIN) code indicated in the Assortment and Price Form is for information purposes and serves to identify the offered product as of the tender submission date. A change to the EAN (GTIN) code during the term of the contract resulting from a change in packaging, distributor, or trade designation, while retaining the same active substance, dose, pharmaceutical form, and marketing authorization number, does not constitute a change to the content of the tender or an amendment to the contract. 5. The Contracting Authority permits tablets to be replaced with capsules (and vice versa) and ampoules to be replaced with vials (and vice versa), provided that the same form of the medicinal product is maintained. However, it does not permit prolonged-release and modified-release medicinal products to be replaced with a medicinal product in the form of a conventional tablet, coated tablet, or capsule. 6. In order to maintain the safety of pharmacotherapy, the Contracting Authority requires that different doses of the same medicinal product included in one Task originate from a single manufacturer – this applies to the same form of the medicinal product.
