Poland – Pharmaceutical products – Supply of medicines, infusion fluids, preparations for enteral and parenteral nutrition, and contrast agents

Opportunity description

1. The subject matter of the contract is the successive supply, upon the Contracting Authority’s order, of medicines, infusion fluids, preparations for enteral and parenteral nutrition, and contrast agents, divided into 50 lots. 2. A detailed description of the subject matter of the contract, including the assortment, doses, forms, and quantities, is specified in Appendix No. 2 to the SWZ – Assortment and Price Form. 3. The assortment constituting the subject matter of the contract must be authorized for marketing and use in the territory of the Republic of Poland in accordance with the Act of 6 September 2001 – Pharmaceutical Law (consolidated text: Journal of Laws 2026, item 612). The Contractor is required to possess all documents required by law authorizing the offered medicinal products for marketing and to present them at the Contracting Authority’s request (excluding medicinal products imported under the named-patient import procedure). 4. The submitted tenders must specify the trade name of the preparation, package size, manufacturer’s name, GTIN/EAN code, marketing authorization number, and detailed product information. If the offered medicine package contains a different number of units (e.g. tablets, ampoules), the Contractor is required to recalculate the number of packages accordingly. If the resulting number of packages is not a whole number, the quantity must be rounded up to a full package. The EAN (GTIN) code indicated in the Assortment and Price Form is for information purposes and serves to identify the offered product as of the tender submission date. A change to the EAN (GTIN) code during the term of the contract resulting from a change in packaging, distributor, or trade designation, while retaining the same active substance, dose, pharmaceutical form, and marketing authorization number, does not constitute a change to the content of the tender or an amendment to the contract. 5. The Contracting Authority permits the substitution of tablets with capsules (and vice versa) and the substitution of ampoules with vials (and vice versa), provided that the same form of the medicine is retained. However, it does not permit the substitution of extended-release and modified-release medicines with a medicine in the form of a conventional tablet, coated tablet, or capsule. 6. To ensure the safety of pharmacotherapy, the Contracting Authority requires that different doses of the same medicinal product included in one Task come from a single manufacturer – this applies to the same form of the medicine.
