The subject of the contract is the supply of medicines in the assortment, estimated quantity, and according to the requirements specified in Annex No. 3 to the SWZ. Deliveries will be made successively, in the quantities and assortment specified in the Contracting Authority’s partial orders. The contractor will be required to deliver the assortment at its own expense to the Hospital Pharmacy. Pursuant to Article 139 of the Public Procurement Law, the Contracting Authority provides for the reverse order of evaluation of tenders, i.e. it may first examine and evaluate the tenders and then perform the subjective qualification of the contractor whose tender received the highest evaluation, with respect to the absence of grounds for exclusion and fulfillment of the conditions for participation in the procedure. 12.6. Before selecting the most advantageous tender, the Contracting Authority will call upon the Contractor whose tender received the highest evaluation to submit, within a specified period of no less than 10 days, the following subjective evidence valid as of the date of submission (the request will be sent to the contractor via the purchasing platform https://platformazakupowa.pl/transakcja/1296691 12.6.1. an extract or information from the National Court Register or from the Central Register and Information on Economic Activity, within the scope of Article 109(1)(4) of the Act, issued no earlier than 3 months before its submission, if separate provisions require entry in a register or records; 12.6.2. information from the National Criminal Register within the scope specified in Article 108(1)(1), (2), and (4) of the Act, issued no earlier than 6 months before its submission; 12.6.3. a declaration by the Contractor, within the scope of Article 108(1)(5) of the Act, that it does not belong to the same capital group, within the meaning of the Act of 16 February 2007 on Competition and Consumer Protection, as another contractor that submitted a separate tender, partial tender, or request to participate in the procedure, or a declaration that it belongs to the same capital group, together with documents or information confirming that the tender, partial tender, or request to participate in the procedure was prepared independently of another contractor belonging to the same capital group. The declaration template is provided in Annex No. 6 to the SWZ 12.6.4. a declaration by the Contractor that the information contained in the declaration referred to in Article 125(1) of the Act remains current, within the scope relating to the grounds for exclusion specified in Article 108(1)(3)–(6) of the Act, i.e.: a) Article 108(1)(3) of the Act, b) Article 108(1)(4) of the Act, concerning a ruling prohibiting participation in public procurement procedures as a preventive measure, c) Article 108(1)(5) of the Act, concerning the conclusion of an agreement with other contractors aimed at distorting competition, d) Article 108(1)(6) of the Act—in accordance with the template constituting Annex No. 7 to the SWZ. 12.6.5. Authorization to conduct the activity covered by the subject of the contract—i.e. authorization to operate a pharmaceutical wholesaler or manufacturing authorization if the contractor is a manufacturer, or, as applicable, in the case of a contractor operating a consignment warehouse—authorization to operate a warehouse that includes authorization to trade in medicinal products, and in the case of packages No. 1, 5, 33, and 40, authorization to trade in narcotic drugs and psychotropic substances. 12.7. If the contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in: 12.7.1. point 12.6.1. of the SWZ, it shall submit a document or documents issued in the country in which the contractor has its registered office or place of residence, confirming that its liquidation has not been opened, bankruptcy has not been declared, its assets are not managed by a liquidator or court, it has not entered into an arrangement with creditors, its business activity is not suspended, and it is not in any other similar situation resulting from a comparable procedure provided for under the laws of the place where such a procedure was initiated; 12.7.2. point 12.6.2 of the SWZ, it shall submit information from the relevant register, such as a court register, or, if there is no such register, another equivalent document issued by the competent judicial or administrative authority of the country in which the contractor has its registered office or place of residence, or in which the person to whom the information or document relates has their place of residence, within the scope specified in Article 108(1), (2), and (4) of the Act; 12.8. The document referred to in point 12.7.2. of the SWZ should be issued no earlier than 6 months before its submission. The document referred to in point 12.7.1. of the SWZ should be issued no earlier than 3 months before its submission. 12.9. If, in the country in which the contractor has its registered office or place of residence, or in which the person to whom the document relates has their place of residence, the documents referred to in point 12.7. are not issued, or if such documents do not address all the cases referred to in Article 108(1)(1), (2), and (4) of the Act, they shall be replaced, as appropriate, in whole or in part, by a document containing, as applicable, a declaration by the contractor identifying the person or persons authorized to represent it, or a declaration by the person to whom the document was to relate, made under oath, or, if the country in which the contractor has its registered office or place of residence, or in which the person to whom the document was to relate has their place of residence, has no provisions concerning declarations under oath, made before a judicial or administrative authority, a notary, or a professional or economic self-government body competent for the contractor’s registered office or place of residence or the place of residence of the person to whom the document was to relate. The provision of point 12.8. shall apply. The authority of persons signing the tender to represent the contractor in the procedure must arise directly from the documents attached to the tender. This means that, to confirm that a person acting on behalf of the contractor is authorized to represent it, the Contracting Authority requires the contractor to submit an extract or information from the National Court Register, CEIDG, or another appropriate register.
