The contract includes: the supply of medicinal products and compounded products divided into 45 Packages. 1. The Contracting Authority informs that the so-called "reverse order of tender evaluation", referred to in Art. 139 of the PPL Act, will be applied in this public procurement procedure. By applying the above procedure, the Contracting Authority will first examine and evaluate the tenders and will then perform the qualitative selection of the Contractor whose tender received the highest evaluation with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 2. The Contracting Authority does not envisage awarding contracts referred to in Art. 214(1)(7) and (8) of the PPL Act. 3. The Contracting Authority does not envisage exercising the option right referred to in Art. 441 of the PPL Act. 4. The Contracting Authority does not envisage making advance payments toward performance of the contract, as referred to in Art. 442 of the PPL Act. 5. In this procedure, the Contracting Authority does not envisage selecting the most advantageous tender using the electronic auction referred to in Art. 227 of the PPL Act. 6. The Contracting Authority permits the submission of tenders for individual lots. Each package will be considered separately. The entire assortment specified in Appendix No. 1 must be offered for a given package. Number of packages: 45 Note: The Contracting Authority does not envisage the possibility of separating items from a given package for separate consideration or combining packages and items from a given package. 7. The Contracting Authority does not permit the submission of variant tenders referred to in Art. 92 of the PPL Act. 8. The procedure is not being conducted for the purpose of concluding a framework agreement. 9. The Contracting Authority does not envisage employment requirements based on an employment relationship, as referred to in Art. 95 of the PPL Act. The Contracting Authority does not envisage requirements concerning the employment of persons referred to in Art. 96(2)(2) of the PPL Act. 10. The Contracting Authority does not reserve the right to apply for the award of the contract exclusively to Contractors referred to in Art. 94 of the PPL Act. 11. The Contracting Authority does not envisage reimbursing the costs of participation in the procedure. The costs of participation in the procedure, in particular the costs of preparing the tender, shall be borne by the Contractor. 12. The Contracting Authority requires a tender security deposit. Detailed information in this regard is provided in point 13 of the SWZ. 13. The Contracting Authority does not require a performance bond. 14. The Contracting Authority will settle accounts with the Contractor exclusively in Polish currency. 15. The Contracting Authority reserves the right not to use the full quantitative limit of the subject matter of the contract specified in Appendix No. 1 to the SWZ, without the Contractor having the right to assert claims on this account. 16. Substantive and formal requirements a) each numbered item will be considered as a separate package, to be selected by the tenderer; b) all doses must be offered within each numbered item; c) provision of information, at the stage of preparing the tender, about the temporary or complete discontinuation of production of a product included in the tender; d) supply of goods consistent with those offered. The supply of a substitute must be agreed with the Contracting Authority; e) the Contracting Authority permits changes to package sizes only with prior consent; f) provision, with each delivery, of the temperature log recorded during the transport of medicinal products; g) submission of a refusal to fulfil a request for medicinal products to: apteka@spzoz.jgora.pl ; h) delivery of the goods by 11:00; i) delivery within a maximum of 2 working days; j) the Contracting Authority reserves the right to return goods without stating a reason within 7 days of receiving the order; k) in all packages (except part No. VII), supply of goods labelled in Polish on both the immediate and outer packaging and accompanied by a package leaflet in Polish. l) in parts I and II, offering products registered in Poland as medicinal products. m) in package 12, offering a gross price no higher than the reimbursement limit specified in part B of the currently applicable Announcement of the Ministry of Health on the list of reimbursed medicines n) provision, together with the delivery of medicinal products imported pursuant to Art. 4(8) of the Pharmaceutical Law, of the consent of the Ministry of Health, information on the imported batches, and a package leaflet in Polish translated by a sworn translator, to apteka@spzoz.jgora.pl o) With each delivery of medicinal products imported into the country pursuant to Art. 4(8) of the Act of 6 September 2001, Pharmaceutical Law (i.e. Journal of Laws of 2025, item 750, as amended), the Contractor shall provide the following to apteka@spzoz.jgora.pl: • consent of the Ministry of Health for temporary admission to the market • information on the imported batches • a package leaflet in Polish or the manufacturer's package leaflet translated into Polish by a sworn translator. p) The Contractor undertakes to send to fakturyapteka@spzoz.jgora.pl the sales document (delivery specification, WZ document) in the OSOZ-EDI standard or another standard enabling it to be imported into the EskulapNT program.
