The subject of the contract is the successive delivery of medicinal products and foodstuffs for special medical purposes to the Hospital Pharmacy of the Healthcare Complex in Bolesławiec. A detailed description of the subject of the contract is contained in the Price Form – Annexes Nos. 2.1–2.12 to the SWZ. Each Contractor may submit only one tender for the entire contract or for a given task/task(s), in writing, otherwise it shall be null and void. If a Contractor submits more than one tender for the entire contract or for a given task/task(s), all tenders submitted by that Contractor will be rejected by the Contracting Authority. The contract consists of 12 tasks. The Contracting Authority permits the submission of partial tenders. The Contracting Authority shall consider a tender submitted for all items in a given task to be a partial tender. The Contracting Authority does not permit the submission of tenders for individual items. The Contracting Authority stipulates that the offered subject of the contract must belong to the group of: a) medicinal products in accordance with Article 2(32) and Article 2(40) of the Pharmaceutical Law Act of 6 September 2001 (consolidated text: Journal of Laws of 2023, item 1938), b) foodstuffs for particular nutritional uses in accordance with the Regulation of the Minister of Health of 16 September 2010 on foodstuffs for particular nutritional uses (consolidated text: Journal of Laws of 2015, item 1026), or c) medical devices in accordance with the Act of 7 April 2022 on medical devices (Journal of Laws of 2022, item 974) and Regulation (EU) 2017/745 of the European Parliament and of the Council of 5 April 2017 on medical devices, amending Directive 2001/83/EC, Regulation (EC) No. 178/2002 and Regulation (EC) No. 1223/2009 and repealing Council Directives 90/385/EEC and 93/42/EEC. The offered products must have the appropriate certificates or approvals permitting their use in healthcare in accordance with Polish law and European Union law. Medicinal products (medicines) must be entered in the Official Register of Medicinal Products Authorised for Marketing in the Territory of the Republic of Poland.
