1. The subject of the contract is the purchase and successive delivery of various medicines, oncology medicines and medical devices, specified in 9 parts, for the Fryderyk Chopin University Clinical Hospital in Rzeszów. 2. A detailed description of the subject of the contract and the Contracting Authority’s requirements are set out in the Price and Tender Forms – Annexes Nos. 1, 2 and 3 to the SWZ for the individual parts, which constitute an integral part of the SWZ. 3. The Contracting Authority requires that the offered subjects of the contract: 3.1. meet the requirements contained in the Price and Tender Forms. 3.2. in Parts Nos. 1, 2, 3 and 5, 6, 7, 8 and 9 – insofar as the subject of the contract comprises medicinal products – be medicinal products authorised for marketing in the territory of the Republic of Poland in accordance with the Act of 6 September 2001 – Pharmaceutical Law (Journal of Laws of 2026, item 612, as amended). The Contracting Authority does not permit the offering of medicinal products authorised for marketing pursuant to Article 4(1) and (2) of the Act of 6 September 2001 – Pharmaceutical Law (Journal of Laws of 2026, item 612, as amended). 3.3. in Part No. 4 and insofar as the subject of the contract in Parts Nos. 1 and 2 comprises vaporisers and other medical devices specified in Annex No. 2 to the SWZ, be medical devices in accordance with the Act of 7 April 2022 on medical devices (Journal of Laws of 2024, item 1620, as amended) and meet the requirements specified in that Act and in the applicable provisions of European Union law, particularly with regard to placing on the market and putting into service, classification, conformity assessment, packaging and labelling. 3.4. in the case of reimbursed medicinal products – meet the requirements specified in the Act of 12 May 2011 on the reimbursement of medicines, foodstuffs intended for particular nutritional uses and medical devices (Journal of Laws of 2026, item 253, as amended), insofar as applicable to the subject of the contract. The Contracting Authority reserves the right to require the Contractor, at every stage of the procedure, to present documents confirming compliance with the requirements specified in this point, in particular documents confirming authorisation of the offered medicinal products for marketing in the territory of the Republic of Poland and documents confirming the conformity of the offered medical devices with the requirements of the applicable provisions of law. Note to point 3.4: If it is determined that the chemical substance in the dosage and form indicated in the SWZ is included in the Announcement of the Minister of Health concerning the list of reimbursed medicines, foodstuffs intended for particular nutritional uses and medical devices – Annex B and/or C – current as at the tender submission date, and the offered medicinal product is not listed therein, the tender will be rejected. The tender will also be rejected if the price of the offered medicinal product is higher than the official price indicated in the Announcement of the Minister of Health concerning the list of reimbursed medicines, foodstuffs intended for particular nutritional uses and medical devices current as at the tender submission date, provided that the official price applies to the medicinal product concerned. 4. The scope of the contract covers the delivery of the subjects of the contract in the quantities specified in the Price and Tender Forms for a period of: - for Parts Nos. 1, 2, 3 and 4 – 24 months from the date of conclusion of the contract. - for Parts Nos. 5, 6, 7, 8 and 9 – 12 months from the date of conclusion of the contract. 5. TIME LIMIT FOR PERFORMANCE OF THE CONTRACT: 1. The subject of the contract with regard to Parts Nos. 1 to 4 will be performed in the form of successive deliveries for a period of 24 months from the date of conclusion of the contract. 2. The subject of the contract with regard to Parts Nos. 5 to 9 will be performed in the form of successive deliveries for a period of 12 months from the date of conclusion of the contract. 3. If, during the term of the contract, the subject of the contract has not been performed in full with regard to Parts Nos. 1 to 9, the Contracting Authority reserves the option to extend the term of the contract. The term of the contract will be changed by means of a written annex signed by the Parties. The Contracting Authority will inform the Contractor of its intention to extend the term of the contract before the expiry of the term for which it was concluded. 6.
