Opportunity description

1. The subject of the contract is the delivery of 2 pick-up vehicles in an unmarked police version, hereinafter referred to in the SWZ as the “vehicles”. 2. A detailed description of the subject of the contract is provided in Annex No. 5 to the SWZ and Chapter XIX of the SWZ. 3. The Contracting Authority requires that subject-matter evidence be submitted together with the tender to confirm the compliance of the offered vehicles with the requirements specified in the description of the subject of the contract in points: 1.4.1.1, 1.4.1.5, 1.4.1.6, 1.4.1.7, 1.4.1.8, 1.4.2.1, 1.4.2.2, 1.4.2.3, 1.4.5.1 of Annex No. 5 to the SWZ. 4. The Contracting Authority accepts equivalent subject-matter evidence if it confirms that the offered vehicles meet the requirements specified by the Contracting Authority. Subject-matter evidence produced by the Contractor (e.g. the Contractor’s own declaration) will not be considered equivalent. 5. The Contracting Authority will award points under the tender evaluation criteria (ratio of maximum net engine power to the actual weight of the vehicle and fuel consumption in the combined cycle) on the basis of data from the specimen EC certificate of conformity for the base vehicle. Despite allowing the specimen EC certificate of conformity for the base vehicle to be supplemented, the Contracting Authority will not award points under these criteria if the document in question is not submitted together with the tender. 6. If the Contractor does not submit the subject-matter evidence or the subject-matter evidence is incomplete, the Contracting Authority will request its submission or supplementation within a specified time limit, subject to paragraph 7. 7. The Contracting Authority informs that, despite providing for such a request, it will not request the submission or supplementation of subject-matter evidence if, despite the submission of the subject-matter evidence, the tender is subject to rejection or there are grounds for cancelling the procedure. 8. The Contracting Authority may request explanations from Contractors regarding the content of the subject-matter evidence. 9. Subject-matter evidence drawn up in a foreign language must be submitted together with a translation into Polish. 10. Information clause concerning the processing of personal data Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (i.e. OJ EU L 119 of 04.05.2016, p. 1), hereinafter referred to as the “GDPR”, the Contracting Authority informs that: 1) the controller of your personal data is the Commander of the Warsaw Metropolitan Police; 2) supervision over the proper processing of personal data is exercised by the data protection officer: address: ul. Nowolipie 2, 00-150 Warszawa; e-mail address: iod@ksp.policja.gov.pl 3) your personal data will be processed pursuant to Article 6(1)(c) of the GDPR for the purpose connected with the public procurement procedure conducted under the open tender procedure for the Delivery of 2 pick-up vehicles in an unmarked police version, ref. No.: WZP-2610/26/148/T; 4) the recipients of your personal data will be persons or entities to whom the procedure documentation will be made available pursuant to Article 18 and Article 74(1) of the Act; 5) your personal data will be stored, pursuant to Article 78 of the Act, for a period of 4 years from the date of completion of the public procurement procedure, and if the duration of the contract exceeds 4 years, the storage period will cover the entire duration of the contract; 6) the obligation to provide personal data relating directly to you is a statutory requirement specified in the provisions of the Act, connected with participation in the public procurement procedure; the consequences of failing to provide specific data arise from the Act; 7) decisions concerning your personal data will not be made by automated means, in accordance with Article 22 of the GDPR; 8) you have: a) pursuant to Article 15 of the GDPR, the right of access to your personal data; b) pursuant to Article 16 of the GDPR, the right to rectify your personal data*; c) pursuant to Article 18 of the GDPR, the right to request that the controller restrict the processing of personal data, subject to the cases referred to in Article 18(2) of the GDPR**; d) the right to lodge a complaint with the President of the Personal Data Protection Office if you consider that the processing of your personal data infringes the provisions of the GDPR; 9) you do not have: a) in connection with Article 17(3)(b), (d) or (e) of the GDPR, the right to erasure of personal data; b) the right to data portability referred to in Article 20 of the GDPR; c) pursuant to Article 21 of the GDPR, the right to object to the processing of personal data, because the legal basis for the processing of your personal data is Article 6(1)(b), (c) and (f) of the GDPR. *Explanation: exercising the right to rectification may not result in a change to the outcome of the public procurement procedure or a change to the provisions of the contract to an extent inconsistent with the Act, and may not compromise the integrity of the report and its annexes. **Explanation: the right to restriction of processing does not apply to storage, for the purpose of ensuring the exercise of legal remedies or protecting the rights of another natural or legal person, or for important reasons of public interest of the European Union or a Member State. 11. Pursuant to Article 257 of the Act, the Contracting Authority provides for the possibility of cancelling the procedure if the financial resources for which it applied are not awarded. 12. The Contractor is bound by the tender for 90 days from the expiry of the deadline for the submission of tenders, i.e. until 16.12.2026, with the first day of the tender validity period being the day on which the deadline for the submission of tenders expires. 13. Pursuant to Article 139 of the Act, the Contracting Authority provides for the reverse order of operations, i.e. it may first examine and evaluate the tenders and then perform the qualitative selection of the Contractor whose tender received the highest evaluation, with regard to the absence of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 1.
