Opportunity description
1. The subject matter of the contract comprises services related to the maintenance of flood embankments, watercourses and reservoirs within the area of operation of the Catchment Management Board in Jasło, divided into 10 lots. 2. A detailed description of the subject matter of the contract for a given lot is contained in Appendix No. 1 to the SWZ – Technical documentation. 3. The Contracting Authority permits the submission of tenders for individual lots. 3. The Contracting Authority does not permit the division of the contract within individual lots. 4. The Contractor may submit a tender for one or more lots of the contract, but no more than 5 lots 5. The Contracting Authority does not permit the submission of variant tenders. 6. The Contracting Authority does not envisage the possibility of awarding the contract referred to in Article 214(1)(7) of the Pzp Act. 7. Rules concerning subcontracting: - The Contracting Authority does not identify key tasks (lots of the contract) within the meaning of Article 121(1) of the Pzp and does not reserve the obligation for the Contractor to personally perform any part of the contract. - The Contractor may entrust the performance of any part of the contract to a subcontractor. - The Contracting Authority requires the Contractor to indicate in the Tender Form the parts of the contract which it intends to entrust to subcontractors and to provide the names of any subcontractors, if already known. - If no Subcontractor is indicated in the tender, the Contracting Authority will consider that the Contractor has declared that it will perform the contract without the participation of subcontractors. - Detailed requirements concerning subcontracting are contained in the model contracts. 8. Contract under the option right – applies to lots 1-7 of the contract 9. The Contracting Authority envisages the possibility of applying the option right for lots 1-7, referred to in Article 441(1) of the Pzp Act, within the scope indicated in the description of the subject matter of the contract for a given lot. 10. The contract under the option right will consist in repeating the same services (activities) as those provided by the Contractor under the basic contract in a given lot, but within the time limits indicated in point 5 of the SWZ. 11. The Contracting Authority reserves the right to exercise the option right in respect of each or selected lots of the contract, depending on its current needs in 2027. 12. The Contracting Authority guarantees the performance of the basic contract. 13. The Contractor is entitled to remuneration for the scope of the subject matter of the contract actually performed. 14. The exercise of the option right will proceed as follows: - The Contracting Authority – no later than two months before the planned date for commencement of the provision of services for stage I under the option right – will submit a declaration to the Contractor on the exercise of the option right. Failure to submit the declaration within the time limit indicated in the preceding sentence will mean that the Contracting Authority waives the exercise of the option right. - Together with the information, the Contracting Authority will provide a written instruction to perform the contract covered by the option right, indicating the scope of its performance and the remuneration due to the Contractor for performing the service under the option right, - Within two weeks of the Contracting Authority’s written submission of the declaration, the Contractor may apply to the Contracting Authority with the request referred to in the model contract (a request for indexation of the lump-sum remuneration). Failure to submit the relevant request within this time limit will mean the Contractor’s consent to perform the services under the option right for the remuneration indicated in the Contracting Authority’s declaration. - If the Contractor applies to the Contracting Authority for indexation of the lump-sum remuneration for the performance of services under the option right, the Contracting Authority will, within two weeks from the date of its receipt, submit to the Contractor a declaration accepting it or a declaration refusing to accept the Contractor’s request. 15. The Contractor will perform the scope of the contract covered by the option right under the conditions specified in this SWZ, the contract concluded with the contractor, and the prices offered in the Tender Form, the tender cost estimate and the Contracting Authority’s declaration, subject to the relevant provisions of the model contracts. 16. The Contracting Authority makes the decision on whether to exercise the option right dependent on its current needs and the Contractor’s proper performance of the service under the basic contract 17. The Contracting Authority’s failure to exercise the option right does not require reasons to be given. The Contractor is not entitled to any claims arising from the Contracting Authority’s failure to exercise the option right 18. Pursuant to Article 95(1) of the Pzp Act, the Contracting Authority requires the Contractor or subcontractor to employ, on the basis of an employment relationship, persons hereinafter referred to as employees who, during the performance of the contract in question, will carry out the activities specified in point 4.8 of the SWZ.
