(Numbering in accordance with the SWZ): 4.1 The subject matter of the contract is the purchase, delivery and planting of plants in the city of Łódź. 4.2 A detailed description of the subject matter of the contract is provided in Appendices No. 1a, 1b and 1c to the SWZ and in the model contract (Appendix No. 10 to the SWZ). 4.3 The contract is divided into the following 3 parts: 4.3.1. Part 1 - Planting of trees in the city of Łódź, 4.3.2. Part 2 - Planting of shrubs in the city of Łódź, 4.3.3. Part 3 - Planting of perennials and bulbous plants and creation of flower meadows in the city of Łódź. 8.4 Information regarding reliance on the resources of the entity making resources available 8.5 In order to confirm compliance with the conditions for participation in the procedure, in appropriate situations and with regard to a specific contract, or a part thereof, the Contractor may rely on the technical or professional capacities or the financial or economic standing of entities making resources available, regardless of the legal nature of the legal relationships between it and such entities. 8.6 A Contractor that relies on the capacities or standing of other entities making resources available shall submit, together with the tender, the commitment of the entity making resources available to place the necessary resources at its disposal for the purposes of performing the contract concerned, or another entity-related means of evidence confirming that, when performing the contract, the Contractor will have the necessary resources of those entities at its disposal - in accordance with Appendix No. 7 to the SWZ; continuation of the provisions is provided in points 8.6.1 - 8.14 of the SWZ. Pursuant to Article 95 of the Pzp Act, the Contracting Authority requires the Contractor or Subcontractor to employ, on the basis of an employment relationship, persons performing activities specified by the Contracting Authority within the scope of contract performance, if the performance of those activities consists in performing work in the manner specified in Article 22 §1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2025, item 277), i.e. physical work related to planting plants. 33.2 The type of activities related to contract performance, the method of verifying the employment of those persons, the Contracting Authority’s powers regarding verification of the Contractor’s compliance with the requirements related to the employment of those persons, and sanctions for failure to comply have been specified in the description of the subject matter of the contract (Appendix No. 1 to the SWZ) and in the model contract (Appendix No. 10 to the SWZ). 27. INFORMATION ON THE ENVISAGED CONTRACTS REFERRED TO IN ARTICLE 214(1)(7) AND (8) OF THE PZP ACT, IF THE CONTRACTING AUTHORITY ENVISAGES AWARDING SUCH CONTRACTS Part 1: As part of a repeat contract, the Contracting Authority envisages planting trees in the city of Łódź in the form of tree species used in the basic contract and the following species: Honey locust (Gleditsia), Black locust (Robinia), Birch (Betula), Hornbeam (Carpinus), Alder (Alnus), Beech (Fagus), Oak (Quercus), Horse chestnut (Aesculus), Maple (Acer), Hazel (Corylus), Linden (Tilia), Magnolia (Magnolia), Tulip tree (Liriodendron), Ginkgo (Ginkgo), Ash (Fraxinus), Plane (Platanus), Bird cherry (Prunus), Hawthorn (Crateagus), Pear (Pyrus), Apple (Malus), Rowan (Sorbus), Plum (Prunus), Serviceberry (Amelanchier), Cherry (Prunus, Cerasus), Fir (Abies), Larch (Larix), Pine (Pinus), Spruce (Picea), Elm (Ulmus), Poplar (Populus), Willow (Salix), standard-form trained trees. For the above species, the minimum trunk circumference measured at a height of 100 cm is specified as min. 18 cm, and the trunk height as, among others, 220 cm; for natural forms, the trunk circumference measured at a height of 5 cm is min. 18 cm. The remaining guidelines for the material should comply with the quality requirements of the Polish Nurserymen Association, including the required characteristics and defects that could disqualify planting material in the City of Łódź. The Contracting Authority reserves the right to use the increase in the contract to a partial extent, depending on needs and available financial resources, up to 100% of the contract value. 27.2 Part 2: As part of a repeat contract, the Contracting Authority envisages planting shrubs in the city of Łódź in the form of species used in the basic contract and with the same parameters. The Contracting Authority reserves the right to use the increase in the contract to a partial extent, depending on needs and available financial resources, up to 100% of the contract value. 27.3 Part 3: As part of a repeat contract, the Contracting Authority envisages planting perennials and bulbous plants and creating flower meadows in the city of Łódź in the form of plant species used in the basic contract and the following species: Periwinkle, Chinese silver grass, Japanese fountain grass, coneflower, sage, verbena, catmint, lavender, bee balm, Arends’ astilbe, masterwort, hydrangea, forget-me-not, daylily, foamflower, black-eyed Susan, cranesbill, houseleek, stonecrop. The Contracting Authority reserves the right to use the increase in the contract to a partial extent, depending on needs and available financial resources, up to 100% of the contract value. 23. REQUIREMENTS CONCERNING THE BID BOND, IF THE CONTRACTING AUTHORITY ENVISAGES AN OBLIGATION TO PROVIDE A BID BOND 23.1 The Contracting Authority requires the Contractor to provide a bid bond: For part No. 1 – in the amount of PLN 29 000,00 (in words: twenty-nine thousand zlotys 00/100). For part No. 2 – in the amount of PLN 7 000,00 (in words: seven thousand zlotys 00/100). For part No. 3 – in the amount of PLN 17 500,00 (in words: seventeen thousand five hundred zlotys 00/100).
