Poland – Planting and maintenance services of green areas – Maintenance of cleanliness in municipal green areas in Kędzierzyn-Koźle over a period of 24 months – divided into four parts

Opportunity description

1. The subject of the contract is the ongoing, year-round maintenance of cleanliness and greenery in municipal areas from 1 November 2026 to 31 October 2028. The summer period covers the months from April to October, and the winter period covers the months from November to March. 2. The contract has been divided into four geographically separate parts: Part I of the contract – maintenance of cleanliness in municipal green areas in the Koźle residential district Part II of the contract – maintenance of cleanliness in municipal green areas in the Śródmieście, Pogorzelec and Kłodnica residential districts Part III of the contract – maintenance of cleanliness in municipal green areas in the Azoty, Wschód, Cisowa and Sławięcice residential districts Part IV of the contract – Maintenance of cleanliness in municipal green areas in the Blachownia residential district 3. Emergency duty The Contractor shall provide emergency duty on weekdays from 15:00–21:00, and on statutory public holidays from 8:00–21:00. The time to commence performance of an emergency request shall be – in accordance with the tender – up to 60, ,90, 120 or 150 minutes from the effective transmission of the request. Commencement means the physical arrival of the persons assigned by the Contractor at the indicated location and the actual commencement of activities aimed at remedying the irregularities. 4. Option right and change to the scope of area maintenance 1) Under the option right, the Contracting Authority provides for an increase in the scope of the contract comprising: a) inclusion of additional areas in summer maintenance requiring ongoing maintenance of cleanliness, one-time mowing, lawn maintenance, removal of waste and contaminants, raking and removal of leaves, removal of weeds, self-seeded growth and overgrowth, keeping paths, pavements, squares, access routes and paved surfaces clean, emptying and cleaning waste bins, and maintenance of typical street furniture located in the area, b) inclusion of additional areas in winter maintenance requiring ongoing maintenance of cleanliness, removal of waste, contaminants, leaves and branches, emptying and cleaning waste bins, keeping paths, pavements, squares, access routes and paved surfaces clean, snow clearing, removal of snow, slush and ice, combating slipperiness, removal of abrasive material and contaminants resulting from winter maintenance, and cleaning typical street furniture located in the area, where weather conditions permit c) commissioning additional mowing of selected surfaces within areas covered by the basic contract or areas included in maintenance under the option right. 2) Additional areas corresponding in nature, development and scope of maintenance to the areas covered by the basic contract may be included in maintenance. 3) The option right does not include the incorporation of areas requiring a different method or standard of maintenance from that specified in the procurement documents, in particular new playgrounds, national memorial sites, sports facilities, graduation towers, stages, fountains, slopes requiring specialist equipment, extensive paved surfaces or areas equipped with a significant number of street furniture elements requiring separate maintenance. 4) The option right shall be exercised by providing the Contractor with the Contracting Authority’s declaration in documentary form 5) Services covered by the option right shall be settled according to the prices specified in Annex A/B/C/D to the tender form, in accordance with the rules set out in § 7 and § 10 PPU. 6) Detailed provisions concerning the option right are set out in § 2, 7, 10 PPU 7) The Contracting Authority provides for the possibility of excluding from maintenance areas or parts thereof covered by the basic contract or previously included in maintenance under the option right increasing the scope of the contract. 8) The total area simultaneously excluded from maintenance may not exceed 200 ar, subject to point 9. 9) The limit referred to in point 8 shall not apply in the event of the temporary exclusion from maintenance of an area or part thereof if the exclusion is caused by an investment project, renovation, construction works, reconstruction, revitalisation, a change in the organisation of the use of the area or other work preventing or rendering pointless the performance of services in that area or part thereof. 10) In the case referred to in point 9, the exclusion may cover the entire surface area of the given area indicated in the list of areas applicable to the given part of the contract. 11) Irrespective of the provisions of points 8-10, the guaranteed volume of the service provided shall amount to at least 80% of the remuneration indicated in § 7(1) of the PPU 5. Employment requirement under an employment contract. Pursuant to Article 95(1) of the Pzp Act, the Contracting Authority requires the Contractor or Subcontractor to employ, under an employment relationship, persons performing the following activities related to the performance of the contract: - cleaning work involved in maintaining cleanliness and care work involved in maintaining municipal greenery The method of verifying employment, the Contracting Authority’s inspection powers and sanctions for failure to meet the requirements are specified in the Draft contractual provisions. 6. A detailed description of the subject of the contract is specified, among other things, in point 3 of the SWZ, the Rules for maintaining the cleanliness of municipal green areas applicable to the given part of the contract, and the Draft contractual provisions together with annexes published electronically on the website of the procurement procedure, which constitute an integral part of the SWZ. 1. Activities specific to this part of the contract – maintenance of the playground and the Teresa Haremza Outdoor Stage in Planty Miejskie, the stairs and ramp from Zamkowa Street, removal of street furniture thrown or abandoned in the Lineta River, separate rules for maintaining flower meadows and new plantings, and, from 1 August 2027, maintenance of plantings after the end of the warranty period; washing the Józef Piłsudski monument and benches in Plac Rady Europy; an enhanced standard of maintenance for Promenada nad Odrą; cleaning Rynek Koźle twice a day and maintaining the surface of Rynek, planters, billy-goat figures, coats of arms, benches, play equipment and other street furniture, including winter maintenance of passageways according to the diagram. 4. The detailed description and scope of the services covered by the subject of the contract, and the standard for their performance, have been specified in detail in the rules for maintaining the cleanliness of municipal green areas in the Koźle residential district, the draft contractual provisions and the content of these specifications of the terms of procurement. 5. Location of the areas: Planty Miejskie, Skwer Władysława Bartoszewskiego, Plac Rady Europy, Promenada nad Odrą, Rynek Koźle and green spaces on M. Konopnickiej Street and Targowa Street. Plantings established as part of the performance of the public contract entitled Wykonanie nasadzeń na Plantach Miejskich w Koźlu - w ramach projektu: Partnerstwo na rzecz ochrony różnorodności biologicznej Gminy Kędzierzyn-Koźle, Gminy Ujazd oraz Nadleśnictwa Kędzierzyn - ETAP II are currently maintained under warranty in the Koźle Planty area. The area of plantings covered by the warranty is approximately 3,7050 h. The aforementioned warranty is valid until 31 July 2027. After that period, i.e. from 1 August 2027, the Contractor’s obligations under this contract will include maintaining the aforementioned plantings. Consequently, in Part I, a separate summer price applicable from 1 April 2027 to 31 July 2027 (4 months), and a summer price applicable from 1 August 2027 to 31 October 2027 and from 1 April 2028 to 31 October 2028. 10 months) are established, taking into account the assumption of responsibility for maintaining the plantings after the end of the currently applicable warranty. 1. Activities specific to this part of the contract – washing tables and benches in Skwer Kolejarzy; maintaining the playground in Park Pojednania; emptying the selective waste collection sets in Park Orderu Uśmiechu at least twice a week, washing the obelisk twice – once in July and a second time at the Contracting Authority’s instruction – and applying separate rules to flower meadows; cleaning under the shelter and on the shelter roof beside the square behind Hala Manhattan; cleaning the fitness zone and weeding the surface in Plac Richarda Wagnera. 4. The detailed description and scope of the services covered by the subject of the contract, and the standard for their performance, have been specified in detail in the rules for maintaining the cleanliness of municipal green areas in the Śródmieście, Pogorzelec and Kłodnica residential districts, the draft contractual provisions and the content of these specifications of the terms of procurement. 5. Location of the areas: Skwer Kolejarzy, Park Pojednania, Park Orderu Uśmiechu, the square at the intersection of Jana Pawła II Avenue and Miła Street, the squares on Harcerska Street and beside the District Police Headquarters, the square behind Hala Manhattan, Plac Rodła, Plac Richarda Wagnera and Skwer im. dr. Leo Gottsteina. Activities specific to this part of the contract – maintenance of the playground in Park Sławięcice, including washing equipment and benches as needed, for the first time by the end of April, and raking leaves within a strip of up to 2 m from the paths; for the remaining areas, the scope must be adapted to their equipment, layout of pavements and green surfaces indicated in the lists and maps. 4. Location of the areas: Green areas on Witosa Street and Waryńskiego Street and on Witosa Street and Grabskiego Street, the square on Krzywoustego Street, the square between Fredry Street and Barbary Street, Park Sławięcice and the square on Dembowskiego Street. Activities specific to this part of the contract maintenance of the playground, squares and heathlands in Park Lotników, replenishment of bark or wood chips, and operation, maintenance and servicing of the water intake well and irrigation system, including preparing the installation for winter and commissioning it for the summer season on dates agreed with the Contracting Authority. 5.
