Opportunity description

1. The subject matter of the contract is the supply of a Central Police Operations Support Vehicle in an unmarked police version, hereinafter referred to as the vehicle. 2. A detailed description of the subject matter of the contract is provided in Chapter XIX of the SWZ and Annex No. 5 to the SWZ. 3. The Contractor is required to indicate in the tender form (template – Annex No. 1 to the SWZ) the make, type, variant, version and commercial designation of the offered vehicle, in accordance with the data contained in the EC certificate template. If the Contractor does not indicate the above data, the Contracting Authority will reject the tender pursuant to Article 226(1)(5) of the Act as non-compliant with the contract conditions. 4. Each vehicle must be covered by a warranty for a period of: 1) min. 36 months without a mileage limit or 36 months with a limit of min. 100,000 km – warranty for the mechanical, electrical and electronic components of the vehicle on which the bodywork was installed, 2) min. 36 months – warranty for the paint coating, 3) min. 72 months – warranty against perforation of body components, 4) min. 36 months – warranty for the entire bodywork, 5) min. 24 months – warranty for the vehicle equipment, 6) min. 36 months – warranty for the vehicle’s priority-status installation and devices, 7) min. 36 months – warranty for the communications installation and equipment, calculated from the date the vehicle is accepted by the Contracting Authority. 5. The Contracting Authority requires the submission, together with the tender, of subject-matter evidence confirming that the offered vehicles comply with the requirements specified in the description of the subject matter of the contract, i.e. a template EC certificate of conformity for the base vehicle confirming the parameters contained in Annex No. 5 to the SWZ in points: 1.4.1.4, 1.4.1.5, 1.4.1.7, 1.4.2. 6. The Contracting Authority accepts equivalent subject-matter evidence if it confirms that the offered vehicles meet the requirements specified by the Contracting Authority. Subject-matter evidence produced by the Contractor (e.g. the Contractor’s own declaration) will not be considered equivalent. 7. The Contracting Authority will award points under the tender evaluation criteria (4x4 all-wheel drive and a spark-ignition engine) on the basis of data from the template EC certificate of conformity for the base vehicle. Despite allowing the template EC certificate of conformity for the base vehicle to be supplemented, the Contracting Authority will not award points under these criteria if the document in question is not submitted together with the tender. 8. If the Contractor does not submit the subject-matter evidence or if the subject-matter evidence is incomplete, the Contracting Authority will call for its submission or supplementation within a specified time limit, subject to paragraph 7. 9. The Contracting Authority states that, despite providing for such a call, it will not call for the submission or supplementation of subject-matter evidence where, notwithstanding the submission of the subject-matter evidence, the tender is subject to rejection or grounds exist for cancelling the procedure. 10. The Contracting Authority may request explanations from Contractors concerning the content of the subject-matter evidence. 11. Subject-matter evidence drawn up in a foreign language must be submitted together with a translation into Polish. 12. The Contracting Authority requires that the offered ICT products do not include: 1) ICT products indicated in the recommendation referred to in Article 33(4) of the Act of 5 July 2018 on the National Cybersecurity System, finding that they have a negative impact on the fundamental security interest of the state; 2) an ICT product whose type was specified in a decision recognising the supplier as a high-risk supplier, as referred to in Article 67b(15) of the Act of 5 July 2018 on the National Cybersecurity System; Failure to meet the above requirement will result in rejection of the tender, as applicable, pursuant to Article 226(1)(17) or (19) of the Public Procurement Law (i.e. Journal of Laws of 2026, item 793, as amended). 13. The following used by the Contracting Authority in this documentation: • trademarks, patents or origin, sources or a particular process that characterises the products or services supplied by a specific contractor, as referred to in Article 99(4) of the Act, and • standards, European technical assessments, approvals, technical specifications and technical reference systems, as referred to in Article 101(4) of the Act – constitute solely a quality, functional, technical, technological or aesthetic benchmark, and in all cases where they are used, the use of equivalent materials, devices, technical systems and other elements, hereinafter referred to as “equivalent solutions”, is permitted. The specified materials, devices, technical systems and other elements of the description identified by means of “restrictive wording” may be replaced by equivalent solutions with correspondingly no worse technical, technological and aesthetic properties and no worse quality or functional characteristics than those described in this documentation. The use of “restrictive wording” is not intended to favour a particular manufacturer or its product, but serves only to indicate a solution that should have properties and characteristics no worse than those specified in this documentation. In the case of tenders containing equivalent solutions, the Contracting Authority will verify them in terms of compliance with the requirements of the individual requirement items contained in this documentation. The Contractor is obliged to prove in the tender the equivalence of the offered materials. The Contracting Authority will not consider the offered solutions equivalent if they have worse properties or characteristics than those indicated in this documentation. 14. The Contracting Authority does not permit the submission of tenders for parts of the contract. 15. The Contracting Authority permits the performance of part of the contract to be entrusted to a Subcontractor. 16. The Contracting Authority requires the Contractor to indicate in the tender the parts of the contract whose performance it intends to entrust to Subcontractors and to provide the names of any Subcontractors, if already known. 17. The Contractor is bound by the tender for 90 days from the expiry of the tender submission deadline, with the first day of the tender validity period being the day on which the tender submission deadline expires, i.e. until 26.12.2026. 1.
