Poland – Police cars – The procedure is being conducted for the purpose of concluding a framework agreement for: Purchase and delivery of official vehicles for the needs of the Mazovian Police garrison.

Opportunity description

1. The subject of the contract is the conclusion of a framework agreement for the supply of official vehicles for the needs of the Mazovian Police garrison. 2. The purpose of concluding the framework agreement is to establish the terms concerning contracts that may be awarded during the term of the framework agreement, in particular prices, anticipated quantities, the performance deadline, and warranty terms. 3. The contracting authority anticipates concluding a framework agreement with a maximum of five contractors within the task. 4. If, in the procedure, tenders not subject to rejection are submitted by more than five contractors not subject to exclusion, the contracting authority will rank the tenders on the basis of the tender evaluation criteria and conclude an agreement with the five contractors that obtained the highest number of points. 5. If several contractors receive the same number of points under the tender evaluation criteria, the contracting authority will select the tenders according to the rules specified in Chapter XXII, points 3-5 of the SWZ. 6. If, in the procedure, tenders not subject to rejection are submitted by five or fewer than five contractors not subject to exclusion, the contracting authority will conclude a framework agreement with all contractors. 7. None of the provisions of the framework agreement may be treated as an obligation of the Contracting Authority to award contracts. 8. The failure to award contracts or the award of contracts for a lower amount may not constitute the basis for any claims by the contractor against the contracting authority, including for failure to perform the framework agreement. 9. During the term of the framework agreement, the contracting authority will award specific contracts under the terms specified in the framework agreement. Detailed provisions concerning the conduct of specific procedures are contained in Chapter XXVII of the SWZ. 10. The subject of the contract is divided into 3 tasks: 1) Task No. 1 – Purchase and delivery of SUV-type official vehicles – max. 40 units 2) Task No. 2 – Purchase and delivery of SUV-type official vehicles in an unmarked police version – max. 20 units 3) Task No. 3 – Purchase and delivery of SUV-type official vehicles in a marked police version – max. 20 units 11. The contracting authority does not limit the number of lots for which a contractor may submit a tender. 12. The contracting authority requires the delivered vehicles to be manufactured in accordance with: a) the TECHNICAL SPECIFICATIONS specified for each task, which constitute Annexes Nos. 1.1–1.3 to the SWZ, respectively for Tasks Nos. 1 through 3, b) the principles of technical knowledge and the generally applicable norms and standards in this field, taking into account the applicable regulations, c) and to possess the required certificates and type approvals with respect to functional qualities. 13. The contractor warrants that the delivered vehicles will be free from defects and will meet the conditions referred to in the Act of 20 June 1997, Road Traffic Law, and the regulations issued pursuant thereto, as well as other generally applicable regulations. 14. For the delivered vehicles, the contracting authority requires the contractor to provide the warranty specified in the TECHNICAL SPECIFICATION under the relevant task, with the proviso that the contracting authority requires the subject of the contract to be covered by a warranty for the vehicle’s mechanical, electrical, and electronic components for a minimum period of 36 months with a mileage limit of 120,000 km. 15. The contracting authority requires the offered vehicle to be brand-new, first grade, unused, and unregistered. For deliveries with a performance deadline in 2026, the Contracting Authority permits the delivery of vehicles manufactured in 2025 and 2026. For deliveries with a performance deadline in 2027, the Contracting Authority permits the delivery of vehicles manufactured in 2026 and 2027. For deliveries with a performance deadline in 2028, the Contracting Authority permits the delivery of vehicles manufactured in 2027 and 2028. In the case specified in § 2(3) of the framework agreement, the Contracting Authority permits the delivery of vehicles manufactured in the year of delivery or manufactured in the year preceding the year of delivery. 16. The Contracting Authority consents to replacing the delivered vehicle with one other than that offered in the tender form where the Contractor demonstrates that the offered vehicle has been withdrawn from sale or its production has been discontinued; the Contracting Authority permits another vehicle to be offered and delivered provided that its technical parameters are no worse than those of the vehicle offered and its price is no higher than that offered in the tender form, taking into account any indexation or change in the Contractor’s remuneration in accordance with § 8 and § 9 of this agreement. a) In the case referred to in paragraph 2, the Contractor must obtain the Contracting Authority’s consent to change the offered vehicle. b) The Contracting Authority has the right to refuse consent to changing the offered product range if the contractor does not prove that the offered vehicle has been withdrawn from sale or its production has been discontinued, or that its technical parameters are no worse than those of the vehicle offered. In such a case, the Contractor will be obliged to deliver the offered vehicle compliant with the content of Annex No. 1 to the framework agreement. c) The Contracting Authority will provide the Contractor in writing with the consent or refusal, together with the justification, referred to in point a) or point b). 17. Place of delivery/acceptance of the subject of the contract: Provincial Police Headquarters based in Radom, ul. 11-go Listopada 37/59, 26-600 Radom. 18. On the day of delivery of the subject of the contract, the Contractor will provide the contracting authority with the complete documentation in Polish specified in the TECHNICAL SPECIFICATION for the relevant task. 19. The vehicles prepared for acceptance must have undergone pre-delivery inspections performed by the contractor and at its expense, which will be recorded in the vehicle’s warranty booklet. 20. Acceptance of the vehicles will be confirmed by a delivery acceptance report according to the template constituting Annex No. 2 to the specific contract, signed by authorized representatives of the contracting authority and the contractor. 1. The contracting authority will award specific contracts successively as needs arise and financial resources are obtained for performance of the contract. 2. The contracting authority will award specific contracts whose subject matter is covered by the framework agreement. Specific contracts will be awarded only to those contractors with which the contracting authority concludes a framework agreement. 3. Specific contracts will be awarded under the terms specified in the framework agreement (including price, performance deadline, and warranty terms). 4. The contracting authority will specify the number of vehicles being purchased each time in the Specific Specification sent to the contractor according to the template constituting Annex No. 3 to the framework agreement. 5. Number of vehicles in one specific contract:  a minimum of 1 unit and a maximum of 10 units under one specific contract for a given task. When the need to award a specific contract arises, the contracting authority will send the specific specification to the contractor whose tender was rated highest—in accordance with the ranking of contractors. The deadline for responding to the sent specific specification is three business days and will be indicated each time in the sent specific specification. b.1) If the contractor (first in the ranking) declares that it will deliver all the vehicles within the scope and deadline covered by the specific specification, the contracting authority will conclude a specific contract with that contractor; b.2) - if the contractor (first in the ranking) declares that it will deliver some of the vehicles within the scope and deadline covered by the specific specification, the contracting authority will send the specific specification to the next (second) contractor in the ranking, indicating the number of vehicles still required, - if the contractor (second in the ranking) declares that it will deliver all the (still required) vehicles within the scope and deadline covered by the specific specification, the contracting authority will conclude two specific contracts with those contractors (first and second in the ranking); - if the contractor (second in the ranking) declares that it will deliver some of the vehicles within the scope and deadline covered by the specific specification, the contracting authority will send the specific specification to the next (third) contractor in the ranking, indicating the number of vehicles still required to perform the specific contract, - if the contractor (third in the ranking) declares that it will deliver all the (still required) vehicles within the scope and deadline covered by the specific specification, the contracting authority will conclude three specific contracts with those contractors (first, second, and third in the ranking); - if the contractor (third in the ranking) declares that it will deliver some of the vehicles within the scope and deadline covered by the specific specification, the contracting authority will send the specific specification to the next (fourth) contractor in the ranking, indicating the number of vehicles still required to perform the specific contract, - if the contractor (fourth in the ranking) declares that it will deliver all the (still required) vehicles within the scope and deadline covered by the specific specification, the contracting authority will conclude four specific contracts with those contractors (first, second, third, and fourth in the ranking); - if the contractor (fourth in the ranking) declares that it will deliver some of the vehicles within the scope and deadline covered by the specific specification, the contracting authority will send the specific specification to the next (fifth) contractor in the ranking, indicating the number of vehicles still required to perform the specific contract, - if the contractor (fifth in the ranking) declares that it will deliver all the (still required) vehicles within the scope and deadline covered by the specific specification, the Contracting Authority will conclude five specific contracts with those contractors (first, second, third, fourth, and fifth in the ranking); b. 3) - if the contractor (first in the ranking) informs the contracting authority that it will not deliver all the vehicles within the scope and deadline covered by the specific specification, the contracting authority will send the specific specification to the next (second) contractor in the ranking regarding the possibility of fulfilling the vehicle delivery, - if the contractor (second in the ranking) informs the contracting authority that it will not deliver all the vehicles within the scope and deadline covered by the specific specification, the contracting authority will send the specific specification to the next (third) contractor in the ranking regarding the possibility of fulfilling the vehicle delivery, - if the contractor (third in the ranking) informs the contracting authority that it will not deliver all the vehicles within the scope and deadline covered by the specific specification, the contracting authority will send the specific specification to the next (fourth) contractor in the ranking regarding the possibility of fulfilling the vehicle delivery, - if the contractor (fourth in the ranking) informs the contracting authority that it will not deliver all the vehicles within the scope and deadline covered by the specific specification, the contracting authority will send the specific specification to the next (fifth) contractor in the ranking regarding the possibility of fulfilling the vehicle delivery, b.4) - the contracting authority will award specific contracts successively in a cascade to subsequent contractors (a maximum of 5 contractors) according to the contractor ranking drawn up on the basis of the tenders of contractors with which the framework agreement was concluded. c) If the contractor does not respond within the specified deadline to the specific specification constituting Annex No. 3 to the agreement, the contracting authority will consider that the contractor is unable to deliver the vehicles. In such a case, the provisions of paragraph 7, point b), apply accordingly. 8. The failure to award specific contracts or the award of contracts for an amount lower than that indicated in the framework agreement may not constitute the basis for any claims by the contractor against the contracting authority, including for failure to perform the framework agreement. 9. The contracting authority sets the deadline for performance of contracts under partial (specific) contracts as follows: Task No. 1 within 30 days calculated from the day following the date of conclusion of the specific contract. 12. The draft provisions of the specific contract constitute Annex No. 10 to the SWZ. 1. The contracting authority will award specific contracts successively as needs arise and financial resources are obtained for performance of the contract. 2. The contracting authority will award specific contracts whose subject matter is covered by the framework agreement. Specific contracts will be awarded only to those contractors with which the contracting authority concludes a framework agreement. 3. Specific contracts will be awarded under the terms specified in the framework agreement (including price, performance deadline, and warranty terms). 4. The contracting authority will specify the number of vehicles being purchased each time in the Specific Specification sent to the contractor according to the template constituting Annex No. 3 to the framework agreement. 5. Number of vehicles in one specific contract:  a minimum of 1 unit and a maximum of 10 units under one specific contract for a given task. In such a case, the provisions of paragraph 7, point b), apply accordingly. 8. The failure to award specific contracts or the award of contracts for an amount lower than that indicated in the framework agreement may not constitute the basis for any claims by the contractor against the contracting authority, including for failure to perform the framework agreement. 9. The contracting authority sets the deadline for performance of contracts under partial (specific) contracts as follows: Task No. 3 within 70 days calculated from the day following the date of conclusion of the specific contract. 12.
