1. The subject matter of the contract is the supply of 3 portable computers with touchscreens, hereinafter referred to as the “equipment”, for the International Centre for Theory of Quantum Technologies of the University of Gdańsk. 2. Common Procurement Vocabulary (CPV) classification code: 30213100-6 (portable computers). 3. A detailed description of the subject matter of the contract is set out in Appendix No. 6 to the SWZ – description of the subject matter of the contract. 4. Place of delivery of the equipment: International Centre for Theory of Quantum Technologies, ul. Prof. Marii Janion 4, 80-309 Gdańsk, room 201. 5. Warranty details are contained in § 7 of the draft contract – Appendix No. 5 to the SWZ. 6. In the description of the subject matter of the contract constituting Appendix No. 6 to the SWZ, the Contracting Authority described the requirements concerning management systems relating to the production process of the offered equipment by reference to the standards indicated in item 5 point 2 of the description of the subject matter of the contract. In every instance in which these standards are indicated in the SWZ, including in the appendices to the SWZ, it shall be understood that such indication is accompanied by the words “or equivalent”. Accordingly, the Contracting Authority permits solutions equivalent to the standards indicated in item 5 point 2 of the description of the subject matter of the contract, pursuant to Article 101(4) and (5) of the Pzp. Equivalence shall be understood to mean that the offered equipment comes from production covered by an implemented and current management system that meets, to an equivalent degree, the requirements set out in item 5 point 2 of the description of the subject matter of the contract. The equivalent solutions applied must correspond, in their type and scope, to the purposes served by the standards referred to in item 5 point 2 of the description of the subject matter of the contract. 7. Due to the fact that various equivalent proposals are permitted, the Contractor is required to verify and treat all solutions as interrelated. Demonstrating equivalence, i.e. meeting to an equivalent degree the requirements specified by the Contracting Authority in the description of the subject matter of the contract, is the responsibility of the Contractor. If equipment is offered that comes from production covered by a management system compliant with an equivalent standard or another solution equivalent to the standards indicated in item 5 point 2 of the description of the subject matter of the contract, the Contractor is required to indicate this solution in point 4 of the tender form constituting Appendix No. 1 to the SWZ, provide information on the equivalent solution offered, justification of its equivalence, and evidence confirming equivalence. The Contracting Authority shall not reject the Contractor’s tender solely because the offered equipment does not come from production covered by management systems compliant with the standards indicated in item 5 point 2 of the description of the subject matter of the contract, provided that the Contractor proves in the tender, in particular by means of the subject-matter evidence referred to in Articles 104–107 of the Pzp, that the proposed solutions meet, to an equivalent degree, the requirements specified by the Contracting Authority in item 5 point 2 of the description of the subject matter of the contract (Article 101(5) of the Pzp).
