Opportunity description

1. The subject of the contract is the conclusion of a framework agreement for the supply of basic laptop-type portable computers in a maximum quantity of 2,000 units during the 24-month term of the framework agreement. 2. The supply includes new basic laptop-type portable computers meeting all the minimum requirements specified in Annex No. 1.1 to the SWZ (technical description of the equipment offered), Annex A to the Description of the Subject Matter of the Contract (concerning software for managing the computer network and printing devices), and Annex B to the Description of the Subject Matter of the Contract (concerning the terms of the agreement), which constitute annexes to the agreement (PPU). 2.1. All requirements specified in the documents indicated above constitute minimum requirements, and compliance with them is mandatory. Failure to meet the above-mentioned minimum requirements will result in rejection of the tender as non-compliant with the contract conditions pursuant to Article 226(1)(5) of the Pzp Act. 3. The Contracting Authority requires that, as of the tender submission date, the offered performance (equipment), including all ICT products, ICT services and ICT processes used to perform the contract, both as main elements and as components, elements of the service delivery environment or accompanying solutions, must not include: 3.1. ICT products, ICT services or ICT processes indicated in the recommendation referred to in Article 33(4) of the Act of 5 July 2018 on the National Cybersecurity System, finding that they have a negative impact on the fundamental interest of state security; 3.2. An ICT product whose type has been specified in a decision on recognizing a supplier as a high-risk supplier, as referred to in Article 67b(15) of the Act of 5 July 2018 on the National Cybersecurity System, or ICT services or ICT processes specified in that decision. 4. If the content of the tender, a declaration or documents submitted with the tender, or the Contractor's explanations, shows that the tender includes the solutions referred to above in points 3.1–3.2, that tender shall be rejected pursuant to Article 226(1)(17) or (19) of the Pzp Act. 5. In order to confirm the compliance of the offered subject matter of the contract with the requirements specified above in points 3.1–3.2, the Contractor shall submit with the tender the relevant subject-matter evidence, i.e. a declaration, the template of which constitutes Annex No. 1.2 to the SWZ—List of ICT elements used during contract performance. In the above-mentioned list, the Contractor is required to unambiguously identify each ICT solution offered by providing the information required in the table. 6. The Contracting Authority does not divide the contract into lots. Therefore, the Contracting Authority does not permit the submission of partial tenders referred to in Article 7(15) of the PZP Act. The Contractor should submit a tender covering the entire range of products constituting the subject matter of the contract. 6.1. The contract has been covered by one lot concerning the purchase of one type of laptop because the subject matter of the contract is homogeneous in terms of function, technical characteristics and intended use. All devices ordered have identical technical requirements and will be used for similar everyday official tasks. A framework agreement providing for one basic type of laptop brings both economic and organizational benefits. It serves to eliminate increases in contract performance costs and complications associated with managing supplies, servicing and warranties, while ensuring a uniform hardware and IT environment. 7. The Contracting Authority intends to conclude a framework agreement with 5 (five) Contractors whose tenders prove to be the most advantageous among all tenders submitted, after points have been awarded in accordance with the tender evaluation criteria specified in Chapter XIX of the SWZ. The rules for awarding implementing contracts are indicated in Chapter VI, point 13 of the SWZ and in § 2 of the Draft provisions of the framework agreement (Annex No. 2.1 to the SWZ). The tender validity period expires on 26.12.2026. The GDPR information clause is included in Chapter II of the SWZ. The Contracting Authority does not envisage applying the procedure referred to in Article 139 of the Pzp Act, the so-called “reverse procedure.” The Contracting Authority requires all contractors to submit a JEDZ with the tender. The Contracting Authority envisages granting advance payments toward contract performance in accordance with the rules specified in § 2(13) of the framework agreement and § 2(16) of the draft implementing contract. The Contracting Authority does not require a performance bond. The delivery locations will be the Contracting Authority's warehouses located in Wrocław: the KWP warehouse in Wrocław at ul. Podwale 31-33, ul. Poznańska 48-80, or another warehouse indicated by the Contracting Authority. The exact delivery address will be indicated to the Contractor in the invitation to submit a tender. The performance deadlines for implementing contracts under individual invitations will be indicated in the implementing contract and will be determined depending on the type and quantity of equipment. The Contracting Authority envisages the possibility of amending the concluded agreement in relation to the content of the selected tender to the extent indicated in § 4 of the FRAMEWORK PPU, constituting Annex No. 2 to the SWZ. 1. The persons authorized to contact Contractors are: 1.1. regarding formal matters: an employee of the Public Procurement and Assistance Funds Department of the KWP in Wrocław—Mr Adam Balicki, tel. 47 8713973; 1.2. regarding substantive matters related to the subject matter of the contract: an employee of the ICT Department of the KWP in Wrocław—Mr Łukasz Kwieciński, tel. 47 871 4215. 2. Pursuant to Article 61(1) of the PZP Act, “Communication in a contract award procedure and in a competition, including the submission of tenders, requests to participate in the procedure or competition, the exchange of information, and the transmission of documents or declarations between the contracting authority and the contractor, subject to the exceptions specified in the Act, shall take place using electronic means of communication.” 3. This public procurement procedure is conducted in Polish via platformazakupowa.pl (hereinafter also: the “Platform”), at: https://platformazakupowa.pl/transakcja/1356776 I. Contractors are required to attach the following to the tender: 1. The tender form (tender), duly completed and signed by persons authorized to represent the contractor (Annex No. 1 to the SWZ). The tender form (tender) shall be submitted, under pain of invalidity, in electronic form, i.e. in electronic format bearing (signed with) a qualified electronic signature. 2. Subject-matter evidence (Annexes Nos. 1.1–1.2 to the SWZ) referred to in Chapter VII of the SWZ. 3. The contractor shall attach to the tender a declaration (JEDZ) concerning the absence of grounds for exclusion and compliance with the conditions for participation in the procedure to the extent indicated by the Contracting Authority. The Contractor shall submit this declaration on the JEDZ form. The JEDZ constitutes evidence confirming the absence of grounds for exclusion and compliance with the conditions for participation in the procedure as at the tender submission date, and constitutes evidence temporarily replacing the entity-related evidence required by the Contracting Authority, indicated below in Section II of this chapter of the SWZ. 3.1. The Contractor shall submit the JEDZ, under pain of invalidity, in electronic form. The template JEDZ declaration constitutes Annex No. 3 to the SWZ. 3.2. The Contractor may complete the JEDZ attached to the SWZ in an editable version or complete the JEDZ by downloading the electronic version in XML format from the Contracting Authority's website and, using available tools or software, importing the JEDZ file saved in XML format into a tool that enables completion of the JEDZ and creation of an electronic document, e.g. https://www.uzp.gov.pl/e-uslugi/jedz. 3.2.1. Instructions for completing the JEDZ form are available on the website of the Public Procurement Office at: https://www.uzp.gov.pl/__data/assets/pdf_file/0015/32415/Instrukcja-wypelniania-JEDZ-ESPD.pdf 3.3. When completing the JEDZ form, the Contractor: 3.3.1. Part I (Information concerning the procurement procedure and the contracting authority or contracting entity)—must complete it; 3.3.2. Part II (Information concerning the contractor)—must complete it to the extent applicable to the requirements specified by the Contracting Authority in this procedure; 3.3.2.1. NOTE: The Contractor shall include information about the certificate in Part II, Section A, in the field concerning entry in the official list of approved contractors or possession of an equivalent certificate. The Contractor should provide data enabling: 3.3.2.1.1. identification of the certificate; 3.3.2.1.2. determination of the certifying entity; 3.3.2.1.3. location of the certificate in the database; 3.3.2.1.4. determination of the scope in which the Contractor intends to use it. 3.3.2.2. Note: A Contractor that intends to entrust the performance of part of the contract to subcontractors is required, at the public procurement procedure stage, to complete Part II, Section D of the JEDZ, including, if known, the names of the subcontractors. 3.3.3. with regard to Part III (Grounds for exclusion), the Contractor completes the fields indicated by the Contracting Authority in the posted XML file of the JEDZ form; 3.3.3.1. NOTE: Since the ground for exclusion indicated in Article 7(1) of the Act on special solutions for counteracting support for aggression against Ukraine and serving to protect national security (consolidated text: Journal of Laws of 2022, item 835) constitutes a national ground for excluding a contractor from participation in a public procurement procedure, contractors shall submit a preliminary declaration regarding this ground in Part III D of the form. 3.3.4. in Part IV (Selection criteria), only the alpha field (general declaration concerning all selection criteria) should be completed; 3.3.5. Part V of the JEDZ form does not apply to the open procedure, and therefore the Contractor does not complete this part of the form; 3.3.6. Part VI (Concluding statements) must be completed by the Contractor. 3.4. A separate JEDZ shall be prepared by: 3.4.1. the contractor/each of the contractors jointly applying for the award of the contract. In such a case, the JEDZ confirms the absence of grounds for exclusion of the contractor and compliance with the conditions for participation in the procedure to the extent that each contractor demonstrates compliance with the conditions for participation in the procedure; 3.4.2. a third party on whose capacity the Contractor relies in order to confirm compliance with the conditions for participation in the procedure. In such a case, the JEDZ confirms the absence of grounds for exclusion of the entity and compliance with the conditions for participation in the procedure to the extent that the entity makes its resources available to the Contractor; 3.4.3. In this procedure, the Contracting Authority does not verify the grounds for exclusion with regard to subcontractors and does not require subcontractors to submit a JEDZ declaration. 4. The Contractor's declaration concerning the additional contract condition arising from Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine (Official Journal of the EU No L 111 of 8.4.2022, p. 1), submitted in electronic form, i.e. in electronic format bearing a qualified electronic signature. The Contractor's declaration is to confirm that the Contractor has acquainted itself with the above-mentioned condition and intends to comply with it, and that the prohibitions arising from Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilizing the situation in Ukraine, as amended by Regulation 2025/2033, do not apply to it. The template of the declaration referred to above constitutes Annex No. 3.1 to the SWZ. 5. A power of attorney in electronic form authorizing submission of the tender, if the tender is submitted by an attorney-in-fact (signed in accordance with the information contained below in Section III of Chapter XI of the SWZ).
