Opportunity description

1. The subject matter of the contract is the design, development, implementation, and provision of technical support and maintenance for the SOZP 2.0 application used to handle public procurement in the Municipality of Kraków, and the granting of a license. A detailed description of the subject matter of the contract is contained in the model contract together with its annexes, constituting Annex No. 11 to the SWZ. 2. The Contracting Authority does not require the contract to be performed by sheltered workshops, social cooperatives, or other contractors covered by the provision of Art. 94(1) of the Act of 11 September 2019 – Public Procurement Law (consolidated text: Journal of Laws of 2026, item 793, as amended), hereinafter referred to as the “Act”. 3. The Contracting Authority envisages the possibility of awarding contracts referred to in Art. 214(1)(7) of the Act in an amount not exceeding 30% of the value of the basic contract. Consequently, when determining the value of this contract, the Contracting Authority included the value of the contracts referred to in Art. 214(1)(7) of the Act in the amount of: PLN 615 725 net. These contracts will consist of the repetition of similar services in relation to those described in this procedure in the model contract and its annexes, particularly in the areas of pre-implementation analysis, programming work, integration with other systems, modification or expansion of functionality, as well as technical support and maintenance. The conditions under which the above-mentioned contracts will be awarded will correspond to the conditions specified in this procedure in the model contract and its annexes, while the conditions for participation in the procedure may be limited as appropriate to the repeated scope of the contract. 4. In this procedure, the Contracting Authority does not divide the contract into lots and does not permit the submission of tenders for individual lots. For organizational and technical reasons, the construction of the IT system cannot be divided into smaller elements due to the need to ensure the consistent implementation and operation of all ordered components. For the same reason, technical support and maintenance of the new system, which requires stabilization after its implementation, cannot be separated from its construction. The absence of division of the contract into lots does not prevent entities in the small and medium-sized enterprise sector from applying for this contract. 5. Due to the nature of the services constituting the subject matter of the contract, the Contracting Authority does not require persons to be employed (by the Contractor or subcontractors) under an employment relationship. 6. The Contracting Authority does not permit the submission of variant tenders. 7. The Contracting Authority does not envisage conducting an electronic auction. 8. Before initiating the procedure, the Contracting Authority conducted preliminary market consultations. 9. In this procedure, the Contracting Authority does not require Contractors to submit subject-matter evidence. 10. Within the limits specified by Art. 462 et seq. of the Act, the Contracting Authority permits the Contractor to perform the subject matter of the contract using subcontractors. A Contractor intending to entrust the performance of part of the contract to subcontractors shall indicate in the tender the parts of the contract it intends to entrust to subcontractors and provide the names of any subcontractors, if already known. 1.
