Opportunity description
1. The subject matter of the contract is the conduct of an information and promotional campaign promoting measures to improve air quality in the Pomeranian Voivodeship, in particular measures resulting from anti-smog resolutions, aimed at people aged 18–25. 2. The description of the subject matter of the contract is set out in: • the Description of the subject matter of the contract, constituting Annex No. 1 to the SWZ; • the draft contract, which constitutes Annex No. 2 to the SWZ. 3. The law applicable to this contract (including the contract concluded as a result of this procedure and the assessment of the legal effects of all documents in this contract) is Polish law, taking into account European Union law. 4. The Contracting Authority does not reserve the obligation for the Contractor to personally perform key parts of the contract. The Contractor may entrust the performance of part of the contract to a Subcontractor. In such a situation, the Contracting Authority requires the Contractor to indicate the parts of the contract that it intends to entrust to Subcontractors and to provide the company names of the Subcontractors (if known). 5. In all provisions of the SWZ and its annexes in which the Contracting Authority refers to standards, approvals, technical specifications or reference systems, or where trademarks, parameters or sources of origin (names of manufacturers or equipment) are indicated, pursuant to Article 99(5) and Article 101(4) of the Pzp Act, the Contracting Authority permits equivalent solutions. 6. Where the description of the subject matter of the contract specifies the names of materials or products of specific manufacturers, this should be treated solely as an indication of the desired standard and quality. In all such situations, the Contractor may offer equivalent materials and products with at least the same technical and quality parameters. Product equivalence means offering a product whose technical parameters of the materials used, performance, durability and quality are no worse than the quality of the materials and products described in the SWZ. 7. A Contractor relying on equivalent solutions is required to demonstrate that the solution it offers meets the requirements specified by the Contracting Authority. In such a case, the Contractor shall attach to the tender a list of equivalent solutions together with their description or standards. 8. The Contracting Authority does not reserve the possibility of applying for the contract exclusively to Contractors referred to in Article 94 of the Pzp Act. 9. Subcontracting: 1) The Contractor may entrust the performance of part of the contract to a Subcontractor (Subcontractors). 2) In connection with the performance of the contract, the Contracting Authority does not reserve the obligation to personally perform the key tasks of the contract. 3) The Contracting Authority requires that, where part of the contract is entrusted to Subcontractors, the Contractor indicate in the tender the parts of the contract that it intends to entrust to Subcontractors and provide (if already known) the names of those Subcontractors. 4) Entrusting part of the contract to Subcontractors does not release the Contractor from liability for due performance of the contract. 10. The Contracting Authority does not provide for an obligation for the Contractor to conduct a site visit or for the Contractor to inspect the documents necessary for the performance of the contract available on site at the Contracting Authority’s premises. 11. The Contracting Authority does not permit the submission of a variant tender referred to in Article 92 of the Pzp Act, i.e. a tender providing for a method of performing the contract different from that specified in this SWZ. 12. The Contracting Authority does not provide for the conclusion of a framework agreement or the establishment of a dynamic purchasing system, nor does it provide for selecting the most advantageous tender using an electronic auction. 13. The Contracting Authority does not provide for awarding contracts pursuant to Article 214(1)(7) of the Pzp Act. 14. The Contracting Authority does not permit tenders to be submitted in the form of electronic catalogues or electronic catalogues to be attached to the tender in the situations specified in Article 93 of the Pzp Act. 15. The Contracting Authority does not provide for settlement in foreign currencies. Settlement of the contract shall be made in PLN. 16. The Contracting Authority does not provide for reimbursement of the costs of participation in the procedure. 17. The Contracting Authority does not provide for advance payments toward the performance of the contract. 1. Contractors who meet the conditions for participation in the procedure specified by the Contracting Authority may apply for the award of this contract. 2. The Contracting Authority requires compliance with the condition for participation in the procedure concerning the Contractor’s technical or professional capacity: 1) The Contractor shall demonstrate that, during the last four years, or, if the period of business activity is shorter, during that period, it has performed at least two services consisting of: • preparing and conducting an advertising, promotional or information campaign for public administration bodies and/or • preparing and conducting an advertising, promotional or information campaign concerning environmental protection or social matters, together with the names and addresses of those bodies and the dates on which the service was performed. NOTE: • The Contracting Authority requires that, in the case of Contractors jointly applying for the award of the contract, all the experience required under this point be demonstrated by at least one of the Contractors jointly applying for the contract. • If, in order to confirm compliance with the conditions for participation in the procedure, the Contractor relies on the technical or professional capacities of another entity, the above condition shall be deemed fulfilled if that entity fulfills it in its entirety. 3. When assessing technical or professional capacity, the Contracting Authority may, at any stage of the procedure, determine that the Contractor does not possess the required capacities if the Contractor’s conflicting interests, in particular the engagement of the Contractor’s technical or professional resources in the Contractor’s other business ventures, may adversely affect the performance of the contract. 4. With regard to Contractors jointly applying for the award of the contract, they may rely on the capacities of those Contractors who will perform the services for which those capacities are required. 5. Where the Contractor uses the resources of another entity (third party), Contractors may rely on the capacities of entities making resources available if those entities perform the services for which those capacities are required. 6. After the deadline for submission of tenders, the Contractor may not rely on the capacities or situation of entities making resources available if, at the tender submission stage, it did not rely, in the given respect, on the capacities or situation of entities making resources available. 1. The tender, together with the annexes, must be prepared in Polish, submitted electronically and signed with a qualified electronic signature under pain of nullity. A Contractor using for the first time the Procurement Platform on which the Contracting Authority conducts this procedure should begin the tender submission process sufficiently in advance. The time required to submit the tender should be taken into account (including due to the need to become familiar with the platform’s technical conditions or various other technical difficulties) so as to be able to submit the tender within the designated deadline. 2. The Contractor has the right to submit only one tender. Tenders from a Contractor that submits more than one tender shall be rejected. 3. The Contractor shall submit the tender together with the required declarations and documents indicated in Chapter IX(1) and (2) of the SWZ and Chapter IX.I of the SWZ. 4. If documents or declarations prepared in a foreign language are attached to the tender, they must be submitted together with a translation into Polish. 5. The Contractor may withdraw the tender until the tender submission deadline. The procedure for a tender in the system is described in the Instructions for Using the Platform. 1. The Contractor shall submit the tender, under pain of nullity, in electronic form, signed with a qualified electronic signature. 2. The tender should be signed by a person/persons authorized to represent the Contractor, whose authority to represent it arises from the provisions of law, from data disclosed in the relevant register or from another authorization. 3. If a person acting on behalf of the Contractor does not derive their authorization to represent it from registration documents (KRS, CEiDG or another relevant register), the Contractor shall attach to the tender a power of attorney or another document confirming authorization to represent the Contractor, as referred to in Chapter IX(2)(2) of the SWZ. 4. A power of attorney to submit a tender or the declaration referred to in Article 125(1) of the Pzp Act shall be transmitted electronically and bear a qualified electronic signature. Where the power of attorney to submit a tender or the declaration referred to in Article 125(1) of the Pzp Act was prepared as a paper document and bears a handwritten signature, a digital reproduction of that document bearing a qualified signature shall be transmitted, certifying the conformity of the digital reproduction with the paper document. The digital reproduction of the power of attorney should confirm the validity of the authorization as at the date of submission of the tender or declaration referred to in Article 125(1) of the Pzp Act. 5. In the case of Contractors jointly applying for the award of the contract, the tender must include a power of attorney for the representative to represent them in the contract award procedure or to represent them in the procedure and conclude the public procurement contract. 6. The Contractor shall submit the tender via the Procurement Platform. Procedure: open. Estimated value: 119,000 PLN.
