1. The subject matter of the contract is the supply of components for the construction of digital radio nodes as part of work carried out under the project entitled “National research infrastructure for the development of GNSS/ADS-B systems, with particular emphasis on the automatic detection of ŚWIATOWID threats”. 2. The detailed requirements concerning the subject matter of the contract constitute an integral part of the description of the subject matter of the contract and are set out in Part IV of the SWZ, where, in accordance with Article 99(6) of the Public Procurement Law, the contracting authority specified the criteria applied to assess equivalence. 3. The subject matter of the contract will be performed for the contracting authority and the following receiving entities: 1) Institute of Bioorganic Chemistry of the Polish Academy of Sciences – Poznań Supercomputing and Networking Center (PCSS), ul. Jana Pawła II 10, 61-139 Poznań – with respect to tasks No. 1.1a and 1.1b; 2) Space Research Centre of the Polish Academy of Sciences (CBK), ul. Bartycka, 18a, 00-716 Warszawa – with respect to tasks No. 1.2a and 1.2b; 3) Jarosław Dąbrowski Military University of Technology in Warsaw (WAT), ul. gen. Sylwestra Kaliskiego 2, 00-908 Warszawa – with respect to tasks No. 1.3a and 1.3b. The scope of the individual tasks is specified in Part IV of the SWZ. 4. The locations (places of delivery) of the complete subject matter of the contract comprising a given task, together with their assignment to the individual receiving entities, are specified in Part IV of the SWZ. 5. The contractor is required to provide each receiving entity with a quality guarantee and is required to perform the obligations arising therefrom. The guarantee requirements are specified in Parts III and IV of the SWZ. 6. The contractor is required to purchase from the Manufacturer of the SDR Software-Defined Radio a Manufacturer’s guarantee for a period at least equal to the period of the quality guarantee provided to the Contracting Authority by the Contractor. The guarantee requirements for the SDR Software-Defined Radio are specified in Parts III and IV of the SWZ. 7. The supplied subject matter of the contract must be brand new, not displayed at exhibitions, complete and technically operational. The term “brand new” means that the subject matter of the contract is originally packaged and unused prior to the date of delivery, except for use necessary to test its proper operation after manufacture. 8. The subject matter of the contract must be free from any physical and legal defects and third-party claims. 9. The supplied subject matter of the contract must originate from the manufacturer’s distribution channel that does not exclude distribution to the Polish market and ensures the exercise of guarantee rights. 10. The subject matter of the contract must be delivered to the locations specified in Part IV of the SWZ under “Place of delivery for individual tasks”. 11. The subject matter of the contract must be delivered to the individual receiving entities together with operating instructions, drivers and any accompanying software necessary for the proper use of the subject matter of the contract (to obtain the full functionality specified in Part IV of the SWZ). The individual receiving entities will not be required to pay any additional amounts, in particular licence fees, and any licences will be granted as part of the contractor’s remuneration, without time or territorial limitations, unless expressly stated otherwise in Part IV of the SWZ. If licences, codes or other authorisations are required to launch and use this software, they must be supplied without additional fees. Codes, licences and other authorisations must also be supplied when they are necessary to launch or configure hardware components. The Contractor may fulfil the requirement referred to in the first sentence by providing the Contracting Authority with access to the manufacturer’s website, where instructions, software in Polish or English, etc. will be available. In such a case, the Contractor is required to provide the Contracting Authority, no later than on the date of signing the contract acceptance protocol, with codes, passwords, etc., insofar as they are necessary to use this service. 12. The supplied subject matter of the contract intended to be powered from the electrical grid must be equipped with an appropriate number of power cables allowing it to be connected to standard power sockets, unless stated otherwise in Part IV of the SWZ. 13. On the date the tender is prepared, the offered subject matter of the contract must not be designated by the manufacturer for withdrawal from production or sale. 14. The offered subject matter of the contract must bear the CE conformity marking (CE mark) or have a CE declaration of conformity. Where the offered subject matter of the contract is not subject to the CE marking requirement, it must have a declaration of conformity with the RoHS Directive or bear the RoHS mark – the items to which the marking applies are specified in Part IV of the SWZ. 15. The offered subject matter of the contract – the equipment, or, where justified by the size or function of the equipment, its packaging and the documents accompanying the equipment – must be marked with the separate collection symbol (crossed-out wheeled bin) – the items to which the marking applies are specified in Part IV of the SWZ.
