Opportunity description
1. The subject matter of the contract is the supply by the Contractor of devices for the General Rehabilitation Department, including: For task 1 – Supply of a device for upper and lower limb exercises For task 2 – Supply of nebulizers For task 3 – Supply of a scale with bioimpedance analysis For task 4 – Supply of upper limb rotors For task 5 – Supply of bicycles-cycle ergometers (hereinafter: equipment), described in detail in the List of Required Functions and Technical Parameters constituting Appendix No. 6 to the SWZ, and in accordance with Appendix No. 2 to the SWZ and the Draft Contractual Provisions constituting Appendix No. 4 to the SWZ. 2. The purchase by the Contracting Authority of the equipment referred to in paragraph 1 will be made under Agreement No. UM_WR.431.3.266.2025 for co-financing the project “Purchase of rehabilitation equipment for the Dr. Wł. Biegański Regional Specialist Hospital in Grudziądz” No. FEKP.06.10-IZ.00-0005/25, co-financed by the European Regional Development Fund under Priority 6. European Funds for increasing the accessibility of regional infrastructure for residents, Measure 6.10 investments in healthcare infrastructure, regional ITIs, Specific Objective 4(v.) Ensuring equal access to healthcare and fostering resilience of health systems, including primary care, and promoting the transition from institutional to family-based and community-based care, of the European Funds for Kujawy and Pomerania 2021-2027 Programme, concluded between the Contracting Authority - the Kujawsko-Pomorskie Voivodeship (hereinafter: Managing Authority), represented by the Management Board of the Kujawsko-Pomorskie Voivodeship (hereinafter: Project). 3. Where the description of the subject matter of the contract contains references to standards, technical assessments, technical specifications and reference systems referred to in Art. 101 paragraph 1 point 2 and paragraph 3 of the p.z.p. Act, the Contracting Authority, pursuant to Art. 101 paragraph 4 of the p.z.p. Act, permits the use of solutions equivalent to those described. Whenever a standard, technical assessment, technical specification or technical reference system is indicated in this SWZ, it shall be assumed that the phrase “or equivalent” has been used in relation thereto. 4. If the Contracting Authority indicates in the description of the subject matter of the contract a trademark, patent or origin, source or particular process that characterizes the products, it shall be assumed that the indicated trademarks, patents, origin, etc. define the minimum parameters indicated in Appendix No. 6 to the SWZ, which constitute the criteria used to assess equivalence. Whenever a trademark, patent or origin, source or particular process that characterizes the products is indicated in this SWZ, it shall be assumed that the phrase “or equivalent” has been used in relation thereto (legal basis: Art. 99 paragraphs 5 and 6 of the p.z.p. Act). 5. In Appendix No. 6 to the SWZ, the Contracting Authority specified quality requirements relating at least to the main elements comprising the subject matter of the contract. The Contracting Authority informs that in these proceedings conducted under the open tender procedure, it envisages the possibility of applying the procedure referred to in Art. 139 paragraph 1 of the p.z.p. Act. When applying the aforementioned procedure, the Contracting Authority will first examine and evaluate the tenders and then perform the qualification of the Contractor whose tender received the highest score with regard to the absence of grounds for exclusion and fulfillment of the conditions for participation in the proceedings. The Contractor undertakes to comply with the horizontal principles referred to in Art. 9 of Regulation (EU) 2021/1060 of the European Parliament and of the Council of 24 June 2021 laying down common provisions on the European Regional Development Fund, the European Social Fund Plus, the Cohesion Fund, the Just Transition Fund and the European Maritime, Fisheries and Aquaculture Fund, and financial rules for those Funds and for the Asylum, Migration and Integration Fund, the Internal Security Fund and the Instrument for Financial Support for Border Management and Visa Policy (Official Journal of the EU L 231 of 30 June 2021, pp. 159-706, as amended), in particular with regard to equality, non-discrimination, accessibility and sustainable development. The Contractor undertakes to apply the principle of sustainable development and the DNSH principle. Contractors who meet the conditions specified in Art. 112 paragraph 2 of the p.z.p. Act concerning the following may apply for the award of the contract: 1) capacity to conduct business activities: The Contracting Authority has not specified a condition in this regard. 2) authorization to conduct a specific business or professional activity, insofar as this results from separate provisions. The Contracting Authority has not specified a condition in this regard. 3) economic or financial standing: The Contracting Authority has not specified a condition in this regard. 4) technical or professional capacity: The Contractor will meet the condition if it demonstrates that: - For task No. 1, it possesses the knowledge and experience necessary to perform the contract in question, resulting from having completed, during the last 3 years, at least 3 supplies in Poland of a minimum of 2 units of devices for lower and upper limb exercises of a type similar to those offered, with a value of no less than PLN 120,000.00 gross for each of them (in Part IV of the ESPD document, the alpha section must be checked) 1.
