Opportunity description

1. The subject of this contract is the supply of radiotherapy assortment for the Maria Skłodowska-Curie National Research Institute of Oncology, Gliwice Branch. 2. The description of the subject matter of the contract and the conditions for performance of the contract are contained in the annexes: 1) Assortment and price specification – Annex No. 2 to the SWZ, 2) Draft contractual provisions that will be incorporated into the contract – Annex No. 4 to the SWZ. 3. The Contracting Authority does not permit the submission of tenders for individual lots. 4. Tenders that do not cover the full scope of the subject matter of the contract will be rejected. 5. The Contracting Authority permits the submission of equivalent tenders—the description of equivalence is contained in Chapter IV of the SWZ. 6. The Contracting Authority does not require the Contractor to provide a bid bond; however, the Contractor whose tender is selected (deemed the most advantageous) is required, before concluding the public procurement contract, to provide a performance bond amounting to 2% of the total price stated in the tender. 7. The Contracting Authority does not provide for an electronic auction or supplementary contracts. 8. Each Contractor must attach to the tender the following evidence confirming that the offered subject matter of the contract meets the requirements specified by the Contracting Authority: 1) for the purpose of quality assessment, free samples of the offered products in the assortment and quantities specified in the SWZ. With regard to submitting evidence in the form of samples, pursuant to Article 65(1)(4) of the Pzp Act, the Contracting Authority waives the requirement to use electronic means of communication. 2) Declaration of conformity and/or CE certificate (depending on the medical device class) and relevant statements (if required) in accordance with Regulation 2017/745 on medical devices (MDR) or Council Directive 93/42/EEC (MDD), together with subsequent transitional provisions. With regard to Article 107(3) of the Pzp Act, the Contracting Authority informs that the evidence referred to: - in paragraph 8 point 1) may not be supplemented, - in paragraph 8 point 2) may be supplemented if it is not submitted or is incomplete. 9. Information concerning joint applications by Contractors for the award of the contract is contained in Chapter IX of the SWZ. 10. The Contracting Authority provides for the possibility of amending the provisions of the concluded contract (i.e. contractual amendments pursuant to Article 455(1)(1) of the Pzp Act) in relation to the content of the tender on the basis of which the Contractor was selected, in accordance with the conditions contained in Annex 4 to the SWZ. Each contract may also be amended in the cases referred to in Article 455(1)(2–4) and paragraph 2 of the Pzp Act. 11. The Contracting Authority has included in the SWZ the information clause arising from Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC. 12. Detailed information concerning this procedure is contained in the SWZ. 1. The subject of this contract is the supply of radiotherapy assortment for the Maria Skłodowska-Curie National Research Institute of Oncology, Gliwice Branch. 2. The description of the subject matter of the contract and the conditions for performance of the contract are contained in the annexes: 1) Assortment and price specification – Annex No. 2 to the SWZ, 2) Draft contractual provisions that will be incorporated into the contract – Annex No. 4 to the SWZ. 3. The tender validity period is: 90 days. The tender validity period begins upon expiry of the deadline for submission of tenders. That day is the first day of the tender validity period. The above means that the tender validity period expires on 28.12.2026. 4. Deadline for performance of the subject matter of the contract: up to 60 calendar days from the date of conclusion of the contract. 5. Tender evaluation criterion: Price 50%, Quality 50%, in accordance with the provisions of the SWZ. 6. In this tender procedure, the Contracting Authority will apply the procedure specified in Article 139(1) of the Pzp Act when evaluating tenders. Procedure: open.
