3. Description of the subject matter of the contract: 3.1. The subject matter of the contract is cafeteria services for DCOPiH Employees provided through access to a digital non-wage benefits platform. 3.2. A detailed description of the subject matter of the contract referred to in point 3.1. is contained in Annex No. 2 to the SWZ – Description of the Subject Matter of the Contract, Annex No. 4 to the SWZ – Tender Form, Annex No. 8 to the SWZ – Draft Contract, assortment and price form – Annex No. 10 to the SWZ. The public procurement procedure for social services is conducted under the open tender procedure pursuant to Article 132 in conjunction with Article 359 point 1 of the Act of 11 September 2019 – Public Procurement Law (consolidated text: Journal of Laws of 2026, item 793), hereinafter also referred to as the “Act” or “Pzp”. The subject matter of the contract is cafeteria services for DCOPiH Employees provided through access to a digital non-wage benefits platform. 3.2. A detailed description of the subject matter of the contract referred to in point 3.1. is contained in Annex No. 2 to the SWZ – Description of the Subject Matter of the Contract, Annex No. 4 to the SWZ – Tender Form, Annex No. 8 to the SWZ – Draft Contract, assortment and price form – Annex No. 10 to the SWZ. 6.3. If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland, instead of the documents referred to in section 6.2. of this chapter, it shall submit: a. information from the National Criminal Register referred to in Article 108, section 1, points 1, 2 and 4 – it shall submit information from the relevant register, such as a court register, or, if no such register exists, another equivalent document issued by the competent judicial or administrative authority of the country in which the contractor has its registered office or place of residence or in which the person to whom the information or document relates has their place of residence, b. instead of a certificate from the competent head of the tax office confirming that the contractor is not in arrears with the payment of taxes and fees, within the scope of Article 109, section 1, point 1 of the Act, instead of a certificate or other document from the competent local organizational unit of the Social Insurance Institution or the competent local branch of the Agricultural Social Insurance Fund within the scope of Article 109, section 1, point 1 of the Act, instead of an extract or information from the National Court Register or the relevant register or from the Central Register and Information on Economic Activity, within the scope of Article 109, section 1, point 4 – it shall submit a document or documents issued in the country in which the contractor has its registered office or place of residence, confirming respectively that: 1) it has not breached obligations relating to the payment of taxes, fees or social or health insurance contributions, 2) its liquidation has not been opened, bankruptcy has not been declared, its assets are not managed by a liquidator or a court, it has not entered into an arrangement with creditors, its business activity is not suspended, nor is it in any other similar situation resulting from a similar procedure provided for in the laws of the place where that procedure was initiated. 6.4. If, in the country in which the contractor has its registered office or place of residence or in which the person to whom the document relates has their place of residence, the documents referred to in point 6.2 point 1 are not issued, or where such documents do not cover all the cases referred to in Article 108 section 1 points 1, 2 and 4, Article 109 section 1 point 1, point 2 letters a and b, and point 3 of the Act, they shall be replaced, as appropriate, in whole or in part, by a document containing, as applicable, a declaration by the contractor, identifying the person or persons authorized to represent it, or a sworn declaration by the person to whom the document was to relate, or, if the laws of the country in which the contractor has its registered office or place of residence or in which the person to whom the document was to relate has their place of residence do not provide for sworn declarations, a declaration made before a judicial or administrative authority, a notary, or a professional or economic self-government body competent for the contractor’s registered office or place of residence or the place of residence of the person to whom the document was to relate. 6.5. If the Contractor indicates that the documents or declarations required in this chapter are available in electronic form at a specified website of publicly accessible and free databases, the Contracting Authority shall independently retrieve from those databases the declarations or documents indicated by the contractor. 6.6. The documents referred to in section 6.2 point 1 should be issued no earlier than 6 before their submission, and the document referred to in section 6 points 2 and 3 should be issued no earlier than 3 months before their submission. 6.7 Documents other than declarations shall be submitted as originals in the form of an electronic document or as an electronic copy of a document certified as a true copy of the original. 6.8. Documents drawn up in a foreign language shall be submitted together with a translation into Polish. 6.9. A Contractor relying on the resources of other entities, in order to demonstrate that there are no grounds for their exclusion and that, to the extent to which it relies on their resources, the conditions for participation in the procedure are met, shall submit single documents concerning those entities. – subject to point 6.10. 6.10. JEDZ. The Contractor must attach the standard form of the European Single Procurement Document – JEDZ, current as of the tender submission date. The information contained in the declaration shall constitute preliminary confirmation that the contractor is not subject to exclusion and meets the conditions for participation in the procedure.
