Opportunity description
The subject matter of the contract is the sale and delivery of laboratory equipment and materials (the subject matter of the contract has been divided into 2 parts). The subject matter of the contract is described in Appendix A to the SWZ. The Contractor shall deliver the subject matter of the contract at its own expense and risk to the locations specified by the Contracting Authority. Domestic and international transport, including insurance, all customs and fiscal charges, and all other charges shall be borne by the Contractor. Minimum warranty and service conditions—in accordance with the detailed description of the subject matter of the contract constituting Appendix A to this SWZ. The Contracting Authority permits the submission of equivalent tenders. Where trademarks appear in the description of the subject matter of the contract, the Contractor may offer an equivalent assortment that is no worse than the assortment indicated by the Contracting Authority. The Contracting Authority stipulates that any proprietary names of materials (products) provided in the SWZ or another document forming an integral part of the SWZ are not intended to violate the Pzp Act, but merely serve to specify the Contracting Authority’s quality and technological expectations. This should be understood as defining the required minimum performance, functional and technical parameters or quality standards. With regard to the certificates or attestations required in the SWZ, the Contracting Authority indicates that it will also accept certificates issued by other equivalent conformity assessment bodies. The Contracting Authority indicates that it will accept appropriate means of evidence relating to the subject matter, in particular the manufacturer’s technical documentation, where a given contractor has neither access to the certificates or test reports referred to in the SWZ nor the possibility of obtaining them within the appropriate time limit, provided that this lack of access cannot be attributed to the given contractor and that the given contractor proves that the supplies it provides meet the requirements, characteristics or criteria specified in the description of the subject matter of the contract or the tender evaluation criteria, or requirements related to contract performance. The subject matter of the contract is the sale and delivery of equipment. A detailed description of the subject matter of the contract is provided in Appendix A to the SWZ. The Contractor shall indicate in the assortment and price form (Appendix No. 2 to the SWZ) the name of the Manufacturer / Importer and the manufacturer’s code for each item. The unit price form for the contract, indicating the items and unit prices, shall constitute an appendix forming an integral part of the future contract. The Contractor shall attach to the tender the following means of evidence relating to the subject matter: a) A technical description of the offered subject matter of the contract containing all information necessary to assess the tender’s compliance with the description of the subject matter of the contract—Appendix A to the SWZ (i.e., in particular, catalogue cards for the offered equipment, information folders, a list specifying the manufacturer and model of the offered equipment, configuration and parameters in Polish, etc.). The Contracting Authority provides for the supplementation of these means of evidence relating to the subject matter pursuant to Art. 107(2) of the Public Procurement Law. b) The certificates referred to in point 18.2 subpoint 3 of the SWZ Table for the purpose of evaluating the tender under the environmental criterion—for each manufacturer of equipment offered by the Contractor in the Price Form, or equivalent. The Contracting Authority does not provide for the supplementation of these means of evidence relating to the subject matter pursuant to Art. 107(2) of the Public Procurement Law, because the means of evidence serve to evaluate the tender under the tender evaluation criterion (Art. 107(3) of the Public Procurement Law). The Contractor shall provide a minimum 24-month warranty for the offered subject matter of the contract. The warranty period constitutes one of the tender evaluation criteria. The warranty and service conditions are specified in the Draft contractual provisions constituting Appendix No. 4 to the SWZ. The subject matter of the contract is the successive sale and delivery of laboratory materials with an option right. A detailed description of the subject matter of the contract is provided in Appendix A to the SWZ. The Contractor shall indicate in the assortment and price form (Appendix No. 2 to the SWZ) the name of the Manufacturer / Importer and the manufacturer’s code for each item. The unit price form for the contract, indicating the items and unit prices, shall constitute an appendix forming an integral part of the future contract. The Contractor shall be required to deliver the goods in batches, the quantities and scope of which will depend on the Contracting Authority’s actual needs. The quantities of individual items specified in Appendix No. 2 to the SWZ are estimated quantities used to calculate the tender price and may change during the performance of the contract concluded as a result of this procedure. However, the total value of the individual deliveries may not exceed the maximum value of this contract. The final total contract value resulting from the sum of the gross prices of partial deliveries made pursuant to the Contracting Authority’s orders during the term of the contract may therefore be lower than the maximum gross value specified in the contract, and in such a case the Contractor shall not be entitled to claim payment of the difference between the final contract value determined in the manner indicated above and its maximum value. OPTION RIGHT: The Contracting Authority indicates that, with regard to the performance of the subject matter of the contract covered by this procedure, it provides for the option right referred to in Art. 31(2) and 441 of the Pzp Act. The option right for this contract consists in the Contracting Authority being obliged to purchase only part of the supplies covered by this contract (basic order), while with regard to the remaining scope, it may purchase those supplies but is not obliged to do so (optional order): 1) The Contracting Authority is obliged to purchase the subject matter of the contract with a gross value not lower than 60% of the maximum gross value of the Contractor’s Remuneration (the maximum gross value of the contract resulting from the Contractor’s tender) specified in § 4(2) of the contract—the so-called basic order; the quantity of individual items specified by the Contracting Authority in the procurement documents, i.e. in the price form, which constitutes only an indicative quantity (necessary to determine the tender price), may change during the performance of this contract (a decrease for a given item in favour of an increase in the quantity of another item/items), which does not constitute an amendment to this contract, and will ultimately result from the Contracting Authority’s needs arising during the term of this contract, depending on the statutory activities, projects, work or research carried out by the Contracting Authority, and from individual orders sent by the Contracting Authority, balancing each other interchangeably in terms of gross value within the amount of the Contractor’s maximum gross remuneration specified in § 4(2) of the contract, in accordance with the Contractor’s tender. 2) The Contracting Authority indicates that, under the option right, it is entitled to purchase from the Contractor the subject matter of the contract (within the assortment specified in the items of the unit price form identical to the items of the price form—Appendix No. 2 to the SWZ), constituting the subject matter of this contract, with a gross value not higher than 40% of the maximum gross value of the Contractor’s remuneration (the maximum gross value of the contract resulting from the Contractor’s tender) specified in § 4(2) of the contract—the so-called optional order. 3) The Contracting Authority is entitled to require the Contractor to perform the optional order referred to in point 2); however, the Contracting Authority is not obliged to exercise the option right (this depends solely on the Contracting Authority’s decision), whereas the Contractor is obliged to perform the optional order within the scope and time specified by the Contracting Authority if the Contracting Authority exercises the option right, under the same conditions as the basic order. Partial orders shall be fulfilled on the basis of unilateral instructions from persons authorised by the Contracting Authority within a maximum of 21 working days from the moment the partial order is placed at the request of a person authorised by the Contracting Authority, submitted by letter or email. The Contractor shall attach to the tender the following means of evidence relating to the subject matter: a) A CE Certificate for items 9 and 10 of the contract certifying that the given product meets the requirements specified in EU legislation, or equivalent. The Contracting Authority provides for the supplementation of these means of evidence relating to the subject matter pursuant to Art. 107(2) of the Public Procurement Law. b) The certificates referred to in point 18.2 subpoint 3 of the SWZ Table for the purpose of evaluating the tender under the environmental criterion—for each manufacturer of equipment offered by the Contractor in the Price Form, or equivalent.
