1. The subject matter of the contract is the provision of services involving the collection, transport and management of municipal waste originating from inhabited and uninhabited properties located within the territory of the Świnna Municipality in 2027, in a manner ensuring the achievement of appropriate levels of recycling, preparation for reuse and recovery by other methods, as well as a reduction in the mass of biodegradable municipal waste sent to landfill, to a regional installation or a substitute installation serving the region, in accordance with the provisions of: • Act of 13 September 1996 on maintaining cleanliness and order in municipalities (consolidated text: Journal of Laws of 2025, item 733), • Act of 14 December 2012 on waste (Journal of Laws of 2023, item 1587, as amended), • Act of 27 April 2001, Environmental Protection Law (Journal of Laws of 2025, item 647, as amended), • Act of 6 March 2018, Entrepreneurs’ Law (Journal of Laws of 2024, item 236, as amended), • Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for the collection of municipal waste from property owners (Journal of Laws of 2013, item 122), • Regulation of the Minister of Climate and Environment of 3 August 2021 on the method for calculating levels of preparation for reuse and recycling of municipal waste (Journal of Laws of 2021, item 1530), • Regulation of the Minister of the Environment of 15 December 2017 on levels for reducing the landfilling of biodegradable municipal waste by mass (Journal of Laws of 2017, item 2412), • Regulation of the Minister of Climate of 2 January 2020 on the waste catalogue (Journal of Laws of 2020, item 10), • Regulation of the Minister of the Environment of 16 June 2009 on occupational health and safety in municipal waste management (Journal of Laws of 2009, No. 104, item 868), • Waste Management Plan for the Silesian Voivodeship — Resolution No. V/37/7/2017 of 24 April 2017 of the Silesian Voivodeship Assembly on the adoption of the Waste Management Plan for the Silesian Voivodeship for 2023–2028. And also: • Resolution No. XXXIII/194/26 of the Świnna Municipal Council of 27 March 2026 on the adoption of the Regulations for maintaining cleanliness and order within the territory of the Świnna Municipality, • Resolution No. VII/49/24 of the Świnna Municipal Council of 3 October 2024 on specifying the detailed manner and scope of providing services for the collection of municipal waste from property owners and the management of such waste in return for the fee paid. The Contractor is obliged to monitor any amendments to the aforementioned provisions, as well as newly introduced provisions, and apply them on an ongoing basis. The scope of the contract includes: 1) collection and management of municipal waste from inhabited properties, 2) collection and management of municipal waste from uninhabited properties, by which the contracting authority means properties on which, for example, business, social or public activities are conducted, as well as summer houses and buildings used for recreational and leisure purposes, and cemeteries. Only waste in the declared quantity will be collected from buildings in which business activities are conducted, 3) equipping inhabited properties, summer houses and recreational and leisure buildings with one container for collecting biodegradable waste and bags for separately collected waste. 2. The detailed scope of the subject matter of the contract is specified in Annex No. 9 to the Procurement Specifications – Description of the subject matter of the contract, while the requirements concerning performance of the contract are set out in Annex No. 8 to the Procurement Specifications – Draft contract. 3. The contracting authority requires the Contractor or subcontractor to employ, on the basis of an employment relationship, persons who, during performance of the contract, carry out basic technical activities such as waste removal and are classified as manual workers.
