1. The subject matter of the contract is the performance of a service consisting of the collection and management of waste in the Municipality of Radzionków in the years 2027-2028. The subject matter of the contract includes the performance of the following services: for Part I: a) collection of unsorted (mixed) waste from single-family housing (single-family residential buildings) and multi-family housing (multi-unit buildings); b) collection of segregated waste from single-family housing (single-family residential buildings) and multi-family housing (multi-unit buildings) using a bag system; c) collection of segregated waste from multi-family housing (more than 7 units); d) collection of bulky waste and bulky electrical and electronic equipment from all inhabited properties (single-family and multi-family); for Part II (3 tasks): a) operation of the Municipal Selective Collection Point for Municipal Waste and collection and management of the municipal waste collected there; b) collection together with management of special waste, including: medicines from containers placed in pharmacies within the municipality and used small batteries and accumulators from containers placed in institutions within the municipality; c) operation of a point for the repair and reuse of products or parts of products that are not waste; 2. The subject matter of the contract is the performance of a service consisting of the collection and management of waste in the Municipality of Radzionków in the years 2027-2028. The subject matter of the contract for Part I includes the performance of the following services: a) collection of unsorted (mixed) waste from single-family housing (single-family residential buildings) and multi-family housing (multi-unit buildings); b) collection of segregated waste from single-family housing (single-family residential buildings) and multi-family housing (multi-unit buildings) using a bag system; c) collection of segregated waste from multi-family housing (more than 7 units); d) collection of bulky waste from all inhabited properties (single-family and multi-family). 2. The detailed scope of the subject matter of the contract is contained in – Annex No. 1 to the SWZ – Description of the subject matter of the contract (for Part I of the contract). 3. The Contracting Authority informs that all vehicles intended for the performance of services under Part I of the contract should be equipped with a device ensuring ongoing monitoring of their operation, i.e. GPS receivers, an appropriate communication module and a transmitter that will transmit data via the Internet to the Contracting Authority’s computer. Equipping vehicles with GPS receivers is intended to serve the Contracting Authority as a system for monitoring the performance of the contract and constitutes the basis for settlement of the Contractor’s performance of the service. Detailed information concerning the equipping of vehicles with GPS receivers – is described in point 4 of the OPZ for Part I of the contract (Annex No. 1 to the OPZ for Part I – Description of the subject matter of the contract). 4. Pursuant to Article 6d(4)(5) of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws of 2025, item 733), the Contractor shall indicate in the tender the facilities, in particular municipal facilities, to which the entity collecting municipal waste from property owners is obliged to transfer the collected waste. In the case of small quantities of separately collected waste, it is possible to indicate the entity collecting such waste. 5. The Contractor undertakes to perform the subject matter of the agreement while ensuring the use of category N2 and N3 vehicles powered by alternative fuels at the level required by the provisions contained in Article 68a(1) of the Act on Electromobility and Alternative Fuels (Journal of Laws of 2024, item 1289), taking into account any amendments to the provisions of the aforementioned Act, consisting in particular of a change in the proportion of vehicles powered by alternative fuels or a postponement of the dates indicated therein. 6. The Contractor ensures that the performance of this agreement will take place in accordance with the applicable provisions of law, in particular the Act on maintaining cleanliness and order in municipalities (Journal of Laws of 2025, item 733), the Waste Act (Journal of Laws of 2023, item 1587), implementing regulations and other applicable provisions, including provisions of local law, and that it has and will have, during the term of the agreement, the required permits, registrations and decisions necessary for the performance of the agreement, and if it loses any of them, regardless of the reason, the Contracting Authority shall be entitled to terminate the agreement without a notice period. 1.
