Collection from the ZUOK in Olsztyn and management of waste with codes 20 01 28 (Paints, inks, printing inks, adhesives, binders and resins other than those mentioned in 20 01 27) and 20 01 27* (Paints, inks, printing inks, adhesives, binders and resins containing hazardous substances) 1. The subject of the contract is the service of collecting and managing waste with the following codes: • 20 01 28 (paints, inks, printing inks, adhesives, binders and resins other than those mentioned in 20 01 27), • 20 01 27* (paints, inks, printing inks, adhesives, binders and resins containing hazardous substances) in a manner ensuring the transfer of responsibility for waste management to the next waste holder. 2. The quantity of waste intended for collection and management under the basic contract is up to 40 Mg (applies to waste with code 20 01 28). 3. The Contracting Authority has no influence over the stream of waste received due to the very high variability of this stream and therefore (in the event of an increase in the stream of waste with the above codes and the occurrence of a need to continue the service), the Contracting Authority reserves the possibility of exercising the option referred to in Article 441(1) of the PZP Act. The Contracting Authority may exercise the option in whole or in part, once or in several parts. An option is envisaged concerning an increase in the quantity of precipitation intended for collection and management: a. up to 35 Mg – waste with code 20 01 28 and b. up to 5 Mg – waste with code 20 01 27*. 4. The Contracting Authority will exercise the option right if there is a need for the further performance of the above-mentioned services. 5. Taking the above into account, the total quantity of waste intended for collection and management is up to 80 Mg, including: 40 Mg of waste with code 20 01 28 under the basic contract and up to 40 Mg under the option, of which: 35 Mg of waste with code 20 01 28 and 5Mg of waste with code 20 01 27*. 6. The Contractor will collect the above-mentioned waste from the Contracting Authority from the facility: Municipal Waste Disposal Plant, ul. P. Poleskiego 3, 10-410 Olsztyn. 7. Due to its subject matter, the contract must be performed, in particular, in accordance with the following provisions: 1) the Act of 14 December 2012 on waste; 2) the Act of 27 April 2001 Environmental Protection Law; 3) the Act of 13 September 1996 on maintaining cleanliness and order in municipalities, as well as other acts and regulations applicable to the subject of the contract. 8. Due to the fact that the Contracting Authority has no influence over and bears no responsibility for the quantities of waste directed to its facility or their quality, they are not guaranteed by the Contracting Authority. 9. For settlements between the Parties, the quantity of waste collected will be determined according to measurements on the Contracting Authority’s electronic vehicle scale. 10. The transfer of waste will be confirmed by means of a waste transfer card – in accordance with the applicable regulations. 11.
