1. The subject matter of the contract is—under the conditions described in the contract to be concluded between the Contracting Authority and the Contractor, the SWZ and the Contractor’s tender—the successive collection, transport and management of waste collected by the Contractor from the Contracting Authority, classified under code 20 01 10 – Clothing and 20 01 11 – Textiles. The waste may be subjected exclusively to recovery processes R1 and/or R12, in accordance with the designation of these processes in the Waste Act of 14.12.2012 (consolidated text: Journal of Laws 2023.1587, as amended)/Annex IA to Regulation (EC) No 1013/2006 of the European Parliament and of the Council of the European Union of 14.06.2006 on shipments of waste (OJ EU L 190/1, as amended), whereby “subjecting to a recovery process” means the commencement and completion of that process. 2. The subject matter of the Contract includes: a) Waste classified under code 20 01 10 – Clothing in the quantity of 840 Mg and 20 01 11 – Textiles in the quantity of 200 Mg, collected separately. However, not less than 200 Mg of waste classified under code 20 01 10 and not less than 50 Mg of waste classified under code 20 01 11 (minimum performance) b) The waste is loose. 3. Collection of Waste: 1) The transfer and collection of Waste shall take place exclusively on the basis of and in accordance with written [form required under pain of nullity] individual orders from the Contracting Authority addressed to the Contractor and delivered to it by electronic mail, specifying the quantity of Waste and the date by which the Contracting Authority expects it to be collected. 2) The Contracting Authority shall place individual orders when the quantity of Waste accumulated by it and to be collected on one day amounts to a minimum of 10 Mg, 3) The Contractor shall collect the Waste while complying with the following technical infrastructure requirements at the Contracting Authority’s facility: a) the gross weight of a single incoming vehicle (empty vehicle for loading) entering the premises of the Contracting Authority’s facility may not exceed 18 tonnes b) the distance between the outermost axles of a single vehicle may not exceed 16 metres, and the length of the vehicle shall not exceed 18 m c) waste transferred loose is loaded from above by conveyor belt through the trailer (moving floor preferred) or using a loader with a long reach. d) After weighing the vehicle loaded with waste, the Contracting Authority shall issue a Waste Transfer Note in the BDO system. e) The Contractor shall be responsible for ensuring that the Operator of the Installation in which the recovery process will be carried out confirms the mass and type of waste specified in each Waste Transfer Note issued by the Contracting Authority, in accordance with the Waste Act. 4) If the shipment of Waste is international, the documents specified in Regulation (EC) No 1013/2006 of the European Parliament and of the Council of the European Union of 14 June 2006 on shipments of waste (OJ EU L 190/1, as amended) shall be prepared. The documents shall be prepared in accordance with the requirements of the aforementioned Regulation. 5) The Contractor undertakes to manage the Waste transferred to it by the Contracting Authority in accordance with applicable provisions of law, in particular the provisions concerning the management of waste generated as a result of the mechanical-biological treatment of unsorted (mixed) municipal waste. 6) The Contracting Authority does not envisage exercising the option right. 4. Procedure number: 1/8/2026/Odzież i Tekstylia. The Contracting Authority requires the specified procedure number to be cited in all correspondence concerning the procedure. Procedure: open.
