Opportunity description
1. The subject matter of the contract is the removal and disposal of all hazardous waste illegally accumulated and stored on the property located in Bonowice, Szczekociny Municipality, consisting of plots Nos.: 336, 337, 338 and 343 (hereinafter referred to as the Waste), placed in Big Bag-type bags and in piles on plots Nos. 336, 337, 338 and 343, and subjecting it to final recovery or disposal processes appropriate to the properties of the Waste, or processing the hazardous waste into a product while complying with the conditions for end-of-waste status – tests confirming the end of hazardous-waste status are required. The estimated quantity of Waste referred to in point 1.1. of the OPZ is approx. 14 500,00 Mg. The terms final recovery processes (final recovery) or final disposal process (final disposal) shall be understood in accordance with the statutory provision contained in Art. 27(3b) of the Act of 14 December 2012 on waste (consolidated text: Journal of Laws 2023.1587, as amended) – hereinafter abbreviated as uoo, whereby: 1) With regard to the final recovery process for the Waste – the Contracting Authority does not restrict the types of final recovery processes to which the Waste is to be subjected, 2) With regard to the final disposal process for the Waste – the Contracting Authority establishes the principle that, for the purposes of this contract, the final disposal process means, as a rule, process D5 or D9 or D10 (in accordance with Annex No. 2 to the uoo, unless expressly stipulated otherwise in the procurement documents). Due to the lack of knowledge regarding the exact composition and properties of the Waste located in the individual piles and Big Bag-type bags, the Waste shall be treated as Waste under code 16 81 01* - Waste exhibiting hazardous properties (subgroup: Waste resulting from accidents and unforeseen events) or 16 03 03* (inorganic waste containing hazardous substances) or 16 03 05* (organic waste containing hazardous substances) or 17 05 03* Soil and earth, including stones, containing hazardous substances (e.g. PCB). 3) With regard to the process of converting hazardous waste into a product while complying with the conditions for end-of-waste status, with the required test confirming the end of hazardous-waste status, this shall be understood in accordance with the statutory provision contained in Art. 14 of the Act of 14 December 2012 on waste (consolidated text: Journal of Laws of 2023, item 1587, as amended). 2. The description of the subject matter of the contract constitutes Annex No. 5 to the SWZ – OPZ (Description of the Subject Matter of the Contract). 3. Obligation to employ under an employment contract. The Contracting Authority requires the Contractor or subcontractor to employ, on the basis of an employment relationship within the meaning of the provisions of the Act of 26 June 1974, the Labour Code (consolidated text: Journal of Laws of 2025, item 277, as amended), employees performing work related to: the transport of hazardous waste and the process of final recovery or final disposal or processing into a product while maintaining the end-of-waste status, of waste at the installation. The remaining provisions in this regard, the method for verifying the employment of these persons, the Contracting Authority’s powers to monitor the Contractor’s compliance with employment-related requirements, and sanctions for failure to meet these requirements are described in the draft contractual provisions constituting Annex No. 6 to the SWZ. 4. The contract is being implemented using the Contracting Authority’s own funds in the amount of PLN 800 400,00 and a grant from the Ministry of Climate and Environment in the amount of PLN 79 239 600,00. 6. The Contracting Authority informs interested Contractors that it is organising a site visit concerning this contract in Bonowice, Szczekociny Municipality, consisting of plots Nos.: 336, 337, 338 and 343. The site visit with the participation of Contractors will take place on 11 June 2026 at 10:00. 7. All interested Contractors are requested to submit, by 11 June 2026 at 08.00, information on the approximate number of persons who will participate in the site visit on their behalf.
